Na temelju članka 5. stavka 2. Zakona o
sklapanju i izvršavanju međunarodnih ugovora (»Narodne novine«, br. 28/96),
Vlada Republike Hrvatske je na sjednici održanoj 2. lipnja 2005. godine
donijela
Članak 1.
Republika Hrvatska pristupa Protokolu o
izmjenama i dopunama Međunarodne konvencije o pojednostavnjenju i usklađivanju
carinskih postupaka, usvojenom u Bruxellesu 26. lipnja 1999. godine,
uključujući Prilog I – Međunarodna konvencija o pojednostavnjenju i usklađivanju
carinskih postupaka (kako je izmijenjena) i II – Opći aneks, u izvorniku na
engleskom i francuskom jeziku.
Članak 2.
Tekst Protokola, uključujući Priloge I. i II. iz
članka 1. ove Uredbe, u izvorniku na engleskom jeziku i u prijevodu na hrvatski
jezik glasi:

26. lipnja 1999.)
Ugovorne stranke Međunarodne konvencije o
pojednostavnjenju i usklađivanju carinskih postupaka (usvojene u Kyotu dana
18.svibnja 1973., i na snazi od dana 25. rujna 1974.), u nastavku zvane
»Konvencija«, sačinjene pod pokroviteljstvom Vijeća za carinsku suradnju, u
nastavku zvanog »Vijeće«,
SMATRAJUĆI da postizanje ciljeva:
– uklanjanja razlika između carinskih postupaka
i prakse kod ugovornih stranaka, koje mogu otežati međunarodnu trgovinu i
ostale međunarodne razmjene;
– izlaženja ususret međunarodnoj trgovini i
carinskim vlastima zbog olakšavanja, pojednostavnjenja i usklađivanja carinskih
postupaka i prakse;
– osiguranja odgovarajućih standarda carinskog
nadzora; i
– pružanja mogućnosti carinskim vlastima da se
odazovu velikim promjenama u poslovanju te administrativnim tehnikama i
metodama,
Zahtjeva izmjene i dopune Konvencije.
SMATRAJUĆI također, i da izmijenjena Konvencija
– mora omogućiti da se osnovna načela za takva
pojednostavnjenja i usklađivanja učine obveznima za ugovorne stranke u odnosu
na izmijenjenu i dopunjenu Konvenciju;
– mora opskrbiti carinarnice učinkovitim
postupcima praćenim odgovarajućim i efikasnim metodama nadzora; i
– može omogućiti postizanje visokog stupnja
pojednostavnjenja i usklađivanja carinskih postupaka i prakse, što je i osnovni
cilj Vijeća, te time učiniti veliki doprinos olakšavanju međunarodne trgovine,
dogovorile su sljedeće:
Članak 1.
Preambula i članci Konvencije izmijenjeni su
kako je navedeno u tekstu, ovdje sadržanom u Prilogu I.
Članak 2.
Aneksi Konvencije zamijenjeni su Općim Aneksom u
Prilogu II. te Posebnim Aneksima, koji su ovdje sadržani u Prilogu III.
Članak 3.
1. Svaka ugovorna stranka može izraziti svoj
pristanak biti vezana ovim Protokolom, uključujući i Priloge I. i II., i to:
(a) potpisom, bez rezerve ratifikacije
(b) polaganjem isprave o ratifikaciji nakon potpisivanja
uz rezervu ratifikacije; ili
(c) pristupom.
2. Ovaj je Protokol otvoren za potpisivanje od
strane ugovornih stranaka Konvencije do 30. lipnja 2000. u glavnom sjedištu
Vijeća u Bruxellesu. Nakon toga će biti otvoren za pristup.
3. Ovaj Protokol, uključujući Priloge I. i II.,
stupa na snagu tri mjeseca nakon što četrdeset ugovornih stranaka potpiše ovaj
Protokol bez rezerve ratifikacije, ili položi svoju ispravu o ratifikaciji ili
pristupu.
4. Nakon što četrdeset ugovornih stranaka izrazi
svoj pristanak biti vezana ovim Protokolom u skladu sa stavkom 1., ugovorna
stranka Konvencije prihvaća izmjene i dopune Konvencije jedino tako, da postane
stranka ovog Protokola. Za takvu ugovornu stranku ovaj Protokol stupa na snagu
tri mjeseca nakon potpisivanja ovog Protokola bez rezerve ratifikacije, ili
polaganja svoje isprave o ratifikaciji ili pristupu.
Članak 4.
Svaka ugovorna stranka Konvencije, nakon što
izrazi svoj pristanak biti vezana ovim Protokolom, može prihvatiti bilo koji od
posebnih Aneksa ili poglavlja sadržanih u Prilogu III. te izvješćuje glavnog
tajnika Vijeća o svom pristanku i Preporukama za praktičnu primjenu, u odnosu
na koje stavlja rezerve.
Članak 5.
Nakon stupanja ovog Protokola na snagu, glavni
tajnik Vijeća više ne prihvaća nikakvu ispravu o ratifikaciji ili pristupu
Konvenciji.
Članak 6.
U odnosima između stranaka ovaj Protokol sa
svojim Prilozima zamjenjuje Konvenciju.
Članak 7.
Glavni tajnik Vijeća je depozitar ovog Protokola
i obavlja funkcije kako je predviđeno člankom 19., sadržanim u Prilogu I. ovog
Protokola.
Članak 8.
Ovaj je Protokol otvoren za potpisivanje od
strane ugovornih stranaka Konvencije u glavnom sjedištu Vijeća u Bruxellesu od
dana 26. lipnja 1999. godine.
Članak 9.
U skladu sa člankom 102. Povelje Ujedinjenih
naroda, ovaj Protokol i njegovi Prilozi registriraju se u tajništvu Ujedinjenih
naroda na zahtjev glavnog tajnika Vijeća.
U potvrdu navedenog, niže potpisani, propisno za
to ovlašteni potpisali su ovaj Protokol.
Sačinjeno u Bruxellesu, na dvadeset i šestog
dana mjeseca lipnja tisuću devet stotina devedeset i devete godine, na
engleskom i francuskom jeziku, pri čemu su oba teksta jednako vjerodostojna, u
jednom izvorniku koji će biti pohranjen kod glavnog tajnika Vijeća, koji će
ovjerene preslike dostaviti svim tijelima iz stavka 1. članka 8. Priloga I.
ovog Protokola.
Prilog I.
MEĐUNARODNA KONVENCIJA O
POJEDNOSTAVNJENJU I USKLAĐIVANJU CARINSKIH POSTUPAKA (izmijenjena i dopunjena)
PREAMBULA
Ugovorne stranke ove Konvencije, osnovane pod
pokroviteljstvom Vijeća za carinsku suradnju,
NASTOJEĆI ukloniti razlike između carinskih
postupaka i prakse kod ugovornih stranaka, koje mogu otežati međunarodnu
trgovinu i ostale međunarodne razmjene,
ŽELEĆI djelotvorno doprinijeti razvitku takve
trgovine i razmjene pojednostavnjenjem i usklađivanjem carinskih postupaka i
prakse, te podupiranjem međunarodne suradnje,
SVJESNE da se značajne prednosti mogu postići
olakšavanjem međunarodne trgovine bez ugrožavanja odgovarajućih standarda
carinskog nadzora,
UVIĐAJUĆI da se takvo pojednostavnjenje i
usklađivanje može ostvariti naročito primjenom sljedećih načela:
– primjenom programa usmjerenih na neprekidno
osuvremenjivanje carinskih postupaka i prakse, a time i povećanje učinkovitosti
i djelotvornosti,
– primjenjivanjem carinskih postupaka i propisa
na predvidiv, dosljedan i jasan način,
– pružanjem svih potrebnih podataka vezanih uz
carinske zakone, propise, administrativne upute, postupke i praksu
zainteresiranim strankama.
– prihvaćanjem suvremenih tehnika kao što su
upravljanja rizikom kontrola poslovnih knjiga, te korištenjem informacijske
tehnologije na najpraktičniji način
– suradnjom sa drugim domaćim tijelima, ostalim
carinskim administracijama i trgovinskim zajednicama, kad je god moguće,
– primjenom odgovarajućih međunarodnih
standarda,
– pružanjem lako dostupnih postupaka upravne i
sudske revizije oštećenim strankama,
UVJERENE da bi međunarodni instrument koji
sadržava gore navedene ciljeve i načela i koji ugovorne stranke namjeravaju
primjenjivati, doveo do visokog stupnja pojednostavnjenja i usklađivanja
carinskih postupaka i prakse, što je i osnovni cilj Vijeća za carinsku
suradnju, te time dala značajni doprinos olakšavanju međunarodne trgovine,
sporazumjele su se kako slijedi:
Glava I.
Definicije
Članak 1.
Za potrebe ove Konvencije:
(a) »Norma«
podrazumijeva odredbu, čija se primjena smatra neophodnom za postizanje
usklađivanja i pojednostavnjenja carinskih postupaka i prakse;
(b) »Prijelazna
norma« podrazumijeva normu iz Općeg Aneksa, za koju je odobreno duže
razdoblje za provedbu;
(c) »Preporuke
za praktičnu primjenu« podrazumijevaju odredbe u Posebnom Aneksu, koje su
priznate kao bitan napredak u pravcu usklađivanja pojednostavnjenja carinskih
postupaka i prakse, a čija se najšira moguća primjena smatra poželjnom;
(d) »Nacionalno
zakonodavstvo« podrazumijeva zakone, propise i druge mjere koje primjenjuju
nadležna tijela ugovorne stranke na čitavom području ugovorne stranke u pitanju
ili ugovore na snazi koji obvezuju tu stranku,
(e) »Opći
Aneks« podrazumijeva skup odredaba primjenjivih na sve carinske postupke i
praksu na koje se odnosi ova Konvencija;
(f) »Poseban
Aneks« podrazumijeva skup odredaba primjenjivih na jedan ili više carinskih
postupaka i propisa, koji su vezani uz ovu Konvenciju;
(g) »Smjernice«
podrazumijevaju skup objašnjenja odredaba Općeg Aneksa, posebnih Aneksa i glava
unutar njih, koja ukazuju na moguće načine djelovanja koji se trebaju slijediti
u primjeni normi, prijelaznih normi i preporuka za praktičnu primjenu, a
posebice koja opisuju najbolju praksu i preporučuju primjeravajuće olakšice;
(h) »Stalni
Tehnički Odbor« podrazumijeva Stalni tehnički odbor Vijeća;
(ij) »Vijeće«
podrazumijeva organizaciju uspostavljenu Konvencijom, koja je u Bruxellesu 15.
prosinca 1950. godine osnovana kao Vijeće za carinsku suradnju;
(k) »Carinska
ili ekonomska unija« podrazumijeva uniju osnovanu i sastavljenu od država,
nadležnu za usvajanje svojih vlastitih pravila koja su obvezujuća za te države
s obzirom na materiju reguliranu ovom Konvencijom, i nadležnu za donošenje
odluka, u skladu sa svojim unutarnjim postupcima, o potpisivanju, ratifikaciji
ili pristupu ovoj Konvenciji.
Glava II.
PODRUČJE PRIMJENE I
STRUKTURA
Područje primjene Konvencije
Članak 2.
Svaka ugovorna stranka obvezuje se promicati
pojednostavnjenje i ujednačavanje carinskog postupka, te u tu svrhu postupati
sukladno odredbama ove Konvencije, normama, prijelaznim normama i preporukama
za praktičnu primjenu, navedenim u aneksima ove Konvencije. Međutim, ugovornu
stranku ništa ne priječi da odobri olakšice veće od onih ovdje predviđenih, te
se svakoj ugovornoj stranki preporučuje da odobri takve veće olakšice u što je
moguće širem opsegu.
Članak 3.
Odredbe ove Konvencije ne utječu na primjenu
nacionalnog zakonodavstva s obzirom na njegove zabrane ili ograničenja za robe
koje podliježu carinskom nadzoru.
Struktura Konvencije
Članak 4.
1. Konvencija obuhvaća Osnovni tekst, Opći aneks
i posebne Anekse.
2. Opći aneks i svaki od posebnih aneksa ove
Konvencije u načelu se sastoje od glava koje razdjeljuju anekse i sadrže:
(a) definicije; i
(b) norme, od kojih su neke u Općem aneksu i
Prijelazne norme.
3. Svaki poseban aneks također sadrži preporuke
za praktičnu primjenu.
4. Svaki aneks praćen je i smjernicama, čiji
tekstovi nisu obvezujući za ugovorne stranke.
Članak 5.
Za potrebe ove Konvencije, svaki poseban
aneks(i) ili glava(e) naveden u njoj, u odnosu na koje se ugovorna stranka
obvezala, smatraju se sastavnim dijelom Konvencije, a u odnosu na ugovornu
stranku svako pozivanje na Konvenciju, smatra se da uključuje i pozivanje na
aneks(e) ili glavu(e).
Glava III.
UPRAVA KONVENCIJE
Upravni odbor
Članak 6.
1. Osniva se Upravni odbor za razmatranje
provedbe ove Konvencije, svih mjera za osiguranje njenog jednoobraznog
tumačenja i primjene te svih njenih predloženih izmjena i dopuna.
2. Ugovorne stranke su članice Upravnog odbora.
3. Nadležno tijelo bilo kojeg entiteta, koji
ispunjava uvjete da postane ugovorna stranka ove Konvencije u skladu s
odredbama članka 8., ili bilo koja članica Svjetske trgovinske organizacije,
ovlaštena je da prisustvuje sjednicama Upravnog odbora kao promatrač. Položaj i
prava takvih promatrača utvrđuju se Odlukom Vijeća. Ranije spomenuta prava ne
mogu se ostvarivati prije nego što Odluka stupi na snagu.
4. Upravni odbor može pozvati predstavnike
međunarodnih vladinih i nevladinih organizacija da prisustvuju sjednicama Upravnog
odbora kao promatrači.
5. Upravni odbor:
(a) će preporučiti ugovornim strankama:
(i) izmjene i dopune Osnovnog dijela Konvencije;
(ii) izmjene i dopune Općeg aneksa, posebnih
aneksa i glava u njoj, te uključivanje novih glava u Opći aneks; i
(iii) uključivanje novih posebnih aneksa i novih
glava u posebne anekse
(b) može odlučivati o izmjeni i dopuni preporuka
za praktičnu primjenu ili uključiti nove preporuke za praktičnu primjenu u
Posebne anekse ili glave u njima u skladu sa člankom 16;
(c) razmatra provedbu odredbi ove Konvencije u
skladu sa člankom 13, stavak 4;
(d) revidira i upotpunjava smjernice novim
podacima
(e) razmatra sva druga pitanja od značaja za ovu
Konvenciju koja bi se mogla odnositi na nju;
(f) Izvješćuje Stalni tehnički odbor i Vijeće o
svojim odlukama.
6. Nadležna uprava ugovornih stranaka dostavlja
u skladu sa stavcima 5. (a), (b), (c) ili (d) ovoga članka glavnom tajniku
Vijeća prijedloge i obrazloženja istih, zajedno sa svim zahtjevima za
uključivanje pojedinih pitanja na dnevni red sjednica Upravnog odbora. Glavni
tajnik Vijeća upoznaje s prijedlozima nadležnih uprava ostale ugovorne stranke
i promatrače iz stavaka 2., 3. i 4. ovoga članka.
7. Upravni odbor sastaje se najmanje jednom
godišnje. Predsjednika i potpredsjednika bira jednom godišnje. Glavni tajnik
Vijeća dostavlja pozivnice i nacrt dnevnog reda nadležnim upravama ugovornih
stranaka i promatračima spomenutima u stavcima 2., 3. i 4. ovoga članka
najmanje šest tjedana prije sastanka Upravnog odbora.
8. Kada se do odluke ne može doći jednoglasno,
na Upravnom odboru se o predmetima odlučuje glasovanjem prisutnih ugovornih
stranaka. Prijedlozi iz stavaka 5. (a), (b) ili (c) ovog članka odobravaju se
dvotrećinskom većinom glasova. O svim ostalim pitanjima Upravni odbor odlučuje
većinom glasova.
9. U slučaju primjene članka 8., stavka 5. ove
Konvencije, carinske ili ekonomske unije koje su ugovorne stranke imaju u
slučaju glasovanja samo broj glasova koji je jednak ukupnom broju glasova
dodjeljenih što pripada njihovim članicama, koje su ugovorne stranke.
10. Prije zatvaranja sjednice, Upravni odbor
usvaja izvješće. To se izvješće prosljeđuje Vijeću i ugovornim strankama i
promatračima spomenutima u stavcima 2., 3. i 4. ovoga članka.
11. U nedostatku odgovarajućih odredaba u ovom
članku, primjenjuju se Pravila postupka Vijeća, ukoliko Upravni odbor ne odluči
drugačije.
Članak 7.
Za potrebe glasovanja u Upravnom odboru, o
svakom posebnom Aneksu i svakoj glavi Posebnog aneksa odvojeno se glasuje.
(a) Svaka ugovorna stranka ima pravo glasovati u
predmetima koji se odnose na tumačenje, primjenu ili izmjenu i dopunu Osnovnog
teksta i Općeg aneksa Konvencije.
(b) O pitanjima u svezi s posebnim aneksima ili
glavama posebnih aneksa koje su već na snazi, pravo glasa imaju samo one
ugovorne stranke koje su prihvatile taj poseban aneks ili glavu.
(c) Svaka ugovorna stranka ima pravo glasovati o
nacrtima novih posebnih aneksa ili novih glava posebnih aneksa.
Glava IV.
UGOVORNA STRANKA
Ratifikacija konvencije
Članak 8.
1. Svaka članica Vijeća i svaka članica
Ujedinjenih naroda ili njegovih specijaliziranih ustanova može postati ugovorna
stranka ove Konvencije:
(a) potpisivanjem bez rezerve ratifikacije;
(b) polaganjem isprave o ratifikaciji nakon
potpisivanja uz rezervu ratifikacije; ili
(c) pristupom.
2. Ova Konvencija otvorena je za potpisivanje u
glavnom sjedištu Vijeća u Bruxellesu od strane članica spomenutih u stavku 1.
ovog članka do 30. lipnja 1974. godine. Nakon toga, otvorena je za pristup tim
članicama.
3. Svaka ugovorna stranka će u trenutku potpisivanja,
ratifikacije ili pristupa ovoj Konvenciji točno odrediti, koji od posebnih
aneksa ili glava u njoj prihvaća. Ona može naknadno izvijestiti depozitara da
prihvaća jedan ili više posebnih aneksa ili glava u njoj.
4. Ugovorne stranke koje prihvaćaju bilo koji
novi Poseban Aneks ili novu glavu posebnog aneksa izvještavaju depozitara u
skladu sa stavkom 3. ovog članka.
5. (a) Svaka carinska ili ekonomska unija može
postati, u skladu sa stavcima 1., 2. i 3. ovoga članka, ugovorna stranka ove
Konvencije. Takva carinska ili ekonomska unija izvještava depozitara o svojoj
nadležnosti u odnosu na pitanja uređena ovom Konvencijom. Takva carinska ili
ekonomska unija također izvješćuje depozitara o svakoj bitnoj promjeni opsega
njenih nadležnosti.
(b) Carinska
ili ekonomska unija, koja je ugovorna stranka ove Konvencije, u pitanjima iz
svoje nadležnosti u svoje vlastito ime ostvaruje svoja prava i ispunjava obveze
koje ova Konvencija dodjeljuje članicama takve Unije, koje su ugovorne stranke
ove Konvencije. U tom slučaju, članica takve unije nije ovlaštena zasebno
ostvarivati ta prava, uključujući i njezino glasovanje.
Članak 9.
1. Svaka ugovorna stranka koja ratificira ovu
Konvenciju ili joj pristupi, vezana je svim izmjenama i dopunama ove
Konvencije, uključujući i Opći aneks, koje su na snazi na dan polaganja njezine
isprave o ratifikaciji ili pristupu.
2. Svaka ugovorna stranka koja prihvati Posebni
aneks ili poglavlja u njemu vezana je svakom izmjenom ili dopunom normi
sadržanih u tom Posebnom aneksu ili poglavlju, koje su na snazi na dan
izvješćivanja depozitara o svom prihvatu, osim ukoliko ne stavi rezervu u
odnosu na jednu ili više ovih preporuka za praktičnu primjenu u skladu s
člankom 12. ove Konvencije.
Primjena Konvencije
Članak 10.
1. Svaka se ugovorna stranka može, u vrijeme
potpisivanja polaganja isprave o ratifikaciji ili pristupu, ili u bilo koje
vrijeme kasnije, priopćiti notifikacijom upućenom depozitaru da ovu Konvenciju
proširuje na čitavo područje ili svako od područje za čije je međunarodne
odnose ona odgovorna. Takva notifikacija proizvodi učinak 3 mjeseca od datuma
primitka iste od strane depozitara. Međutim, ova se Konvencija neće
primjenjivati na područja navedena u toj notifikaciji prije nego što ova
Konvencija stupi na snagu za odnosnu ugovornu stranku, koje se to tiče.
2. Svaka ugovorna stranka koja je dostavila
obavijest prema stavku 1. ovoga članka proširujući ovu Konvenciju na bilo koje
od područja za čije je međunarodne odnose odgovorna, može, u skladu s postupkom
po članku 19. ove Konvencije, izvijestiti depozitara da se na odnosno područje
ova Konvencija više ne primjenjuje.
Članak 11.
Za potrebe primjene ove Konvencije carinska ili
ekonomska unija koja je ugovorna stranka izvješćuje glavnog tajnika Vijeća o
područjima koja čine carinsku ili ekonomsku uniju, te da se ta područja trebaju
smatrati jedinstvenim područjem.
Prihvat odredbi i rezerve
Članak 12.
1. Sve ugovorne stranke vezane su Općim Aneksom.
2. Ugovorna stranka može prihvatiti jedan ili
više posebnih aneksa ili jedno ili više glava u njima. Ugovorna stranka koja
prihvati poseban aneks ili glavu(e) vezana je svim u njima sadržanim normama.
Ugovorna stranka koja prihvati poseban aneks ili glavu(e) vezana je svim
preporukama za praktičnu primjenu sadržanim u njima, osim ako u vrijeme
prihvata ili u bilo koje kasnije vrijeme ne izvijeste depozitara o
preporuci(kama) za praktičnu primjenu u svezi kojih stavlja rezervu, navodeći
postojeće razlike između odredbi svog nacionalnog zakonodavstva i onih u
odnosnoj preporuci(ma) za praktičnu primjenu. Svaka ugovorna stranka koja je
stavila rezerve može ih u svako vrijeme povući, u cijelosti ili djelomično,
notifikacijom o tome depozitaru navodeći točan datum od kojeg takvo povlačenje
proizvodi učinak.
3. Svaka ugovorna stranka koja je obvezana
Posebnim aneksom ili glavom(ama) u njima razmotrit će mogućnost povlačenja svih
rezervi na preporuke za praktičnu primjenu koji je stavila temeljem stavka 2. i
izvijestiti glavnog tajnika Vijeća o rezultatima tog razmatranja krajem svakog
trogodišnjeg razdoblja, počevši od dana stupanja Konvencije na snagu za tu
ugovornu stranku, navodeći odredbe svog nacionalnog zakonodavstva koje su, po
njenu mišljenju, protivne povlačenju rezervi.
Provedba odredbi
Članak 13.
1. Svaka ugovorna stranka provesti će norme
navedene u Općem aneksu te u posebnom(im) aneksu(ima) ili glavom(ama) u njima
koje je prihvatila unutar 36 mjeseci nakon što je(su) ovaj(i) aneks(i) i
glava(e) stupio(li) na snagu za tu ugovornu stranku.
2. Svaka ugovorna stranka primjenjuje Prijelazne
norme navedene u Općem aneksu unutar 60 mjeseci od datuma od kojeg je Opći
aneks stupio na snagu za tu ugovornu stranku.
3. Svaka ugovorna stranka primjenjuje Preporuke
za praktičnu primjenu navedene u posebnom(im) aneksu(ima) ili glavom(ama) u njima
koje je prihvatila unutar 36 mjeseci nakon što je(su) ovaj(i) poseban(i)
aneks(i) ili glava(e) stupio(li) na snagu za tu ugovornu stranku, osim ako
nijestavila rezervu na jednu ili više ovih preporuka za praktičnu primjenu.
4. (a) Ako je rok, predviđen u stavcima 1. ili
2. ovog članka u praksi nedovoljan za neku ugovornu stranku da provede odredbe
Općeg aneksa, takva ugovorna stranka može zatražiti Upravni odbor, prije isteka
roka spomenutog u stavcima 1. i 2. ovog članka, da joj odobri produženje tog roka.
Podnoseći zahtjev, ugovorna stranka treba navesti odredbu(e) Općeg aneksa u
vezi koje(ih) traži produženje roka, te razloge za podnošenje takvog zahtjeva.
(b) U iznimnim okolnostima, Upravni odbor može
odlučiti da odobrava takvo produženje. Svaka odluka Upravnog odbora kojom se
odobrava takvo produženje sadržava navode o iznimnim okolnostima koje
opravdavaju njeizno donošenje, pri čemu produženje ne može ni u kojem slučaju
biti na više od jedne godine. Po isteku tako produženog roka, ugovorna stranka obavještava
depozitara o provedbi odredbi zbog kojih je produženje i bilo odobreno.
Rješavanje sporova
Članak 14.
1. Svaki spor između dviju ili više ugovornih
stranaka u vezi tumačenja ili primjene ove Konvencije rješavat će se što je moguće
više međusobnim pregovorima između njih.
2. Svaki spor koji nije riješen pregovorima,
ugovorne stranke koje su u sporu proslijedit će Upravnom odboru koji potom
razmatra spor i donosi preporuke za njegovo rješavanje.
3. Ugovorne stranke u sporu mogu se unaprijed
suglasiti da će prihvatiti preporuke Upravnog odbora kao obvezujuće.
Izmjene i dopune Konvencije
Članak 15.
1. Tekst svake izmjene i dopune Konvencije koju
Upravni odbor preporuči ugovornim strankama u skladu s člankom 6., stavak 5.
(a)(i) i (ii), glavni tajnik Vijeća dostavlja svim ugovornim strankama i onim
članicama Vijeća, koje nisu ugovorne stranke.
2. Izmjene i dopune Glavnog dijela Konvencije
stupaju na snagu za sve ugovorne stranke dvanaest mjeseci nakon polaganja
isprave o prihvatu od strane onih ugovornih stranaka koje su prisutne na
sjednici Upravnog odbora tijekom koje su ove izmjene i dopune bile preporučene,
pod uvjetom da nije uložen nikakav prigovor od strane bilo koje ugovorne
stranke unutar roka od dvanaest mjeseci od datuma izvješćivanja o takvim
izmjenama i dopunama.
3. Svaka preporučena izmjena i dopuna Općeg
aneksa ili posebnih aneksa ili glava u njima smatra se prihvaćenom šest
mjeseci od datuma kada je preporučena izmjena i dopuna priopćena ugovornim
strankama, izuzev:
(a) ako je uložen prigovor od ugovorne stranke
koja je vezana tim posebnim aneksom ili glavom; ili
(b) ako ugovorna stranka izvijesti glavnog
tajnika Vijeća da, iako namjerava prihvatiti preporučenu izmjenu i dopunu, još
nisu ispunjeni potrebni uvjeti za takav prihvat.
4. Ako ugovorna stranka dostavi glavnom tajniku
Vijeća obavijest kako je predviđeno stavkom 3. (b) ovog članka, ona može dok ne
izvijesti glavnog tajnika Vijeća o svom prihvatu preporučene izmjene i dopune,
podnijeti prigovor na ovu izmjenu i dopunu u roku od osamnaest mjeseci nakon
isteka šestomjesečnog razdoblja iz stavka 3. ovog članka.
5. Ako je prigovor na preporučenu izmjenu
primljen u skladu s uvjetima stavka 3. (a) ili 4. ovog članka, izmjena i dopuna
neće se smatrati prihvaćenom i neće imati nikakav učinak.
6. Ako neka ugovorna stranka uputi obavijest u
skladu sa stavkom 3. (b) ovoga članka, izmjena će se smatrati prihvaćenom na
raniji od sljedeća dva datuma:
(a) na datum s kojim su sve ugovorne stranke,
koje su poslale takve obavijesti, izvijestile glavnog tajnika Vijeća o svom
prihvatu preporučene izmjene, pod pretpostavkom da, ukoliko su svi prihvati
bili primljeni prije isteka roka od šest mjeseci spomenutog u stavku 3. ovog
članka, taj će se datum smatrati datumom isteka spomenutog roka od šest
mjeseci;
(b) na datum isteka roka od osamnaest mjeseci
spomenutog u stavku 4. ovog članka.
7. Svaka izmjena općeg aneksa ili posebnih
aneksa ili glava u njima koja se smatra prihvaćenom stupa na snagu ili šest
mjeseci nakon datuma s kojim se smatra prihvaćenom, ili, ako je u preporučenoj
izmjeni spomenut drugačiji rok, s istekom tog roka nakon datuma s kojim se
smatra prihvaćenom.
8. Glavni tajnik Vijeća će, čim to bude moguće,
izvijestiti ugovorne stranke ove Konvencije o svakom prigovoru na preporučenu
izmjenu i dopunu, koji je dostavljen u skladu sa stavkom 3. (a) ovoga članka,
te o bilo kojoj obavijesti primljenoj u skladu sa stavkom 3. (b) ovoga članka.
Glavni tajnik Vijeća također će nakon toga izvijestiti ugovorne stranke o tome,
izjavljuje li ugovorna stranka ili stranke koje su uputile takvu obavijest
prigovor na preporučenu izmjenu ili dopunu, ili je prihvaćaju.
Članak 16.
1. Bez obzira na postupak o izmjenama, utvrđenu
člankom 15. ove Konvencije, Upravni odbor može u skladu sa člankom 6. odlučiti
da izmijeni svaku od Preporuka za praktičnu primjenu ili da nove Preporuke za
praktičnu primjenu uključi u neki od Posebnih Aneksa ili glava u njima. Svaka
ugovorna stranka biti će pozvana od strane glavnog tajnika Vijeća da sudjeluje
u razmatranjima Upravnog odbora. Tekst svake od tih izmjena ili novih Preporuka
za praktičnu primjenu o kojemu se tako odluči, glavni tajnik Vijeća dostavit će
ugovornim strankama i onim članicama Vijeća, koje nisu ugovorne stranke ove
Konvencije.
2. Svaka izmjena ili uključivanje novih
Preporuka za praktičnu primjenu o kojima se odlučilo u skladu sa stavkom 1.
ovog članka, stupa na snagu šest mjeseci nakon što je glavni tajnik Vijeća
izvijestio o njima. Svaka ugovorna stranka koja je vezana Posebnim Aneksom ili
glavom u njemu koji je postao predmet takve izmjene i dopune ili uključivanja
novih Preporuka za praktičnu primjenu, smatrat će se da je prihvatila te
izmjene i dopune ili nove Preporuke za praktičnu primjenu, ukoliko ne stavi
rezervu na način naveden u članku 12. ove Konvencije.
Trajanje pristupa
Članak 17.
1. Ova Konvencija nema ograničeno trajanje, ali
je svaka ugovorna stranka može je otkazati u svako vrijeme nakon datuma njenog
stupanja na snagu u skladu s njenim člankom 18. 2. Otkazivanje se priopćava ispravom
u pisanom obliku, položenom kod depozitara.
3. Otkazivanje proizvodi učinak šest mjeseci
nakon što depozitar primi ispravu o otkazivanju.
4. Odredbe stavaka 2. i 3. ovog članka također
se primjenjuju i s obzirom na posebne anekse ili glave u njima, za koje svaka
ugovorna stranka može povući svoj pristanak u svako doba nakon datuma njihovog
stupanja na snagu.
5. Za svaku ugovornu stranku, koja povuče svoj
pristanak na Opći aneks, smatrat će se da je otkazala Konvenciju. U tom se
slučaju također primjenjuju odredbe stavaka 2. i 3.
Glava V.
ZAVRŠNE ODREDBE
Stupanje Konvencije na snagu
Članak 18.
1. Ova Konvencija stupa na snagu tri mjeseca
nakon što pet entiteta spomenutih u stavcima 1. i 5. članka 8. potpiše Konvenciju
bez rezerve ratifikacije ili položi svoje isprave o ratifikaciji ili pristupu.
2. Ova Konvencija stupa na snagu za svaku
ugovornu stranku tri mjeseca nakon što je izvijestila o svojem prihvatu
sukladno odredbama članka 8.
3. Svaki poseban aneks ili glava u njemu ove
Konvencije stupa na snagu tri mjeseca nakon što pet ugovornih stranaka prihvati
taj poseban aneks ili tu glavu.
4. Nakon stupanja na snagu bilo kojeg posebnog
aneksa ili glave u njemu sukladno stavku 3. ovoga članka, taj poseban aneks ili
glava u njemu stupa na snagu za svaku ugovornu stranku tri mjeseca nakon što je
izvijestila o svom prihvaćanju. Međutim, niti jedan poseban aneks ili glava u
njemu neće za ugovornu stranku stupiti na snagu prije no što za tu ugovornu
stranku stupi na snagu ova Konvencija.
Depozitar Konvencije
Članak 19.
1. Ova Konvencija, svi potpisi sa ili bez
rezerve ratifikacije i sve isprave o ratifikaciji ili pristupu polažu se kod
glavnog tajnika Vijeća.
2. Depozitar će:
(a) primati i čuvati izvornike tekstova ove
Konvencije;
(b) pripremati ovjerene preslike izvornika
tekstova ove Konvencije, onim članicama Vijeća koje nisu ugovorne stranke te
glavnom tajniku Ujedinjenih naroda;
(c) primati svaki potpis s ili bez rezerve
ratifikacije, isprave o ratifikaciji ili pristupu ovoj Konvenciji te primati i
čuvati svaku ispravu, notifikaciju ili obavijest vezanu uz nju;
(d) utvrditi da li je potpis ili svaka isprava,
obavijest ili priopćenje vezano uz ovu Konvenciju dostavljeno u valjanom i
utvrđenom obliku te, ako je potrebno, obratiti pozornost ugovornoj stranki na
nedostatak u predmetu;
(e) izvijestiti ugovorne stranke, one članice
Vijeća koje nisu ugovorne stranke i glavnog tajnika Ujedinjenih naroda o:
– potpisima, ratifikacijama, pristupima i
prihvatima Aneksa i glava sukladno članku 8 ove Konvencije;
– novim glavama Općeg Aneksa i novim Posebnim
Aneksima ili glavama u njima, o kojima Upravni odbor odluči preporučiti za
uključivanje u ovu Konvenciju;
– datumu stupanja na snagu ove Konvencije, Općeg
Aneksa i svakog od Posebnih Aneksa ili glava u njima u skladu sa člankom 18.
ove Konvencije;
– primljenim notifikacijama sukladno člancima
8., 10., 12. i 13. ove Konvencije;
– povlačenjima prihvata Aneksa/glava od strane
ugovornih stranaka;
– otkazivanjima po članku 17. ove Konvencije; i
– svim prihvaćenim izmjenama u skladu s člankom
15. ove Konvencije i datumu njihovog stupanja na snagu.
3. U slučaju bilo kakvih razlika koje bi se
mogle pojaviti između ugovorne stranke i depozitara u vezi obavljanja
spomenutih funkcija, depozitar ili ugovorna stranka ukazat će na to pitanje
ostalim ugovornim strankama i potpisnicama, ili, ovisno o slučaju, Upravnom
odboru Vijeća.
Članak 20.
Registracija i vjerodostojni tekstovi
U skladu sa člankom 102. Povelje Ujedinjenih
naroda, ova Konvencija se registrira u tajništvu Ujedinjenih naroda na zahtjev
glavnog tajnika Vijeća.
U potvrdu navedenog, niže potpisani, propisno za
to ovlašteni, potpisali su ovu Konvenciju.
Sačinjeno u Kyotu, osamnaestog dana mjeseca
svibnja tisuću devet stotina sedamdeset i treće godine na engleskom i
francuskom jeziku, pri čemu su oba teksta jednako vjerodostojna, u jednom
izvorniku koji će biti pohranjen kod glavnog tajnika Vijeća koji će ovjerene
preslike dostaviti svim entitetima na koje se odnosi stavak 1. članka 8. ove
Konvencije.
OPĆI ANEKS
Glava 1.
OPĆA NAČELA
1.1. Norma
Definicije, norme i prijelazne norme u ovom
Aneksu primjenjuju se na carinske postupke i propise navedene u ovom Aneksu i
na postupke i propise iz posebnih aneksa, ukoliko se oni primjenjuju.
1.2. Norma
Uvjeti koji trebaju biti ispunjeni i carinske
formalnosti koje treba obaviti za postupke i propise navedene u ovom Aneksu i u
posebnim aneksima utvrđeni su nacionalnim zakonodavstvom i trebaju biti što je
moguće jednostavniji.
1.3. Norma
Carinska služba uspostavlja i održava
odgovarajuće savjetodavne odnose s trgovinom da bi povećali suradnju i olakšali
učestvovanje prilikom pronalaženja najučinkovitijih metoda rada, primjerenih
nacionalnim propisima i međunarodnim sporazumima.
Glava 2.
DEFINICIJE
Za potrebe Aneksa ove Konvencije:
E1./F23. »žalba« označava radnju kojom osoba na
koju se neposredno odnosi odluka ili propust carinske službe, a koja se time
smatra oštećenom, traži svoje pravo pred ovlaštenim tijelima;
E2./F19. »obračun carine i poreza« označava
određivanje iznosa carina i poreza, koje treba platiti.
E3./F4. »knjigovodstvena kontrola« označava
radnje kojima carinska služba provjerava točnost i vjerodostojnost deklaracija
pregledom odgovarajućih knjiga, evidencija, poslovnih sustava i trgovačkih
podataka vođenih od strane osoba na koje se to odnosi.
E4./F15. »provjera carinske deklaracije«
označava radnje koje carinska služba poduzima da bi utvrdila da li je carinska
deklaracija ispravno sačinjena i da li prateći zahtijevani dokumenti ispunjavaju
propisane uvjete;
E5./F9. »carinjenje« označava obavljanje
carinskih formalnosti nužnih kako bi roba mogla ući u uporabu u zemlji, biti
izvezena ili podvrgnuta nekom drugom carinskom postupku.
E6./F10. »carinska služba« označava državnu
službu koja je odgovorna za provođenje Carinskog zakona i ubiranje carina i
poreza te koja odgovara također i za primjenu drugih zakona i propisa vezanih
uz uvoz, izvoz, kretanje ili skladištenje robe;
E7./F3. »carinska kontrola« označava mjere, koje
carinska služba primjenjuje, da bi se osigurala pravilna primjena carinskih
propisa;
E8./F11. »carinska davanja« označava davanja
propisana Carinskom tarifom, kojoj roba podliježe prilikom ulaza ili izlaza iz
carinskog područja;
E9./F16. »carinske formalnosti« označavaju sve
radnje koje trebaju poduzeti osobe na koje se to odnosi i carinska služba, kako
bi se pravilno primijenili carinski propisi;
E10./F18. »carinsko pravo« označava zakonske i
provedbene propise vezane uz uvoz, izvoz, prijevoz ili skladištenje robe, čija je
primjena i provedba posebna zadaća carinske službe, kao i sve propise koje
carinska služba donosi na temelju svojih zakonskih ovlasti;
E11./F2. »carinarnica« označava carinsku
administrativnu jednicu ovlaštenu za provedbu carinskih formalnosti, te prostorije
ili druge prostore odobrene u te svrhe od strane ovlaštenih tijela;

u carinskoj deklaraciji;

carinska i sva druga davanja, poreze ili pristojbe koje se ubiru na ili u svezi
s izvozom robe, ali ne uključujući plaćanja, koja u iznosima određenim prema
približnim troškovima usluga, pruža ili prikuplja carinarnica u korist nekog
drugog državnog tijela;
E19./F8. »carinska deklaracija« označava izjavu,
podnijetu na način propisan od strane carinarnice, kojom osobe o kojima se radi
stavljaju do znanja da se na tu robu treba primijeniti carinski postupak te
navode podatke koje carinska služba zahtijeva za njegovu primjenu;
E20./F14. »uvozne carine i porezi« označavaju
carinska i sva druga davanja, poreze ili pristojbe koje se ubiru na ili u svezi
s uvozom robe, ali ne uključujući plaćanja, koja u iznosima određenim prema

službe da u razumnom roku o pitanju koje im je uredno podneseno, donesu odluku
koja se od njih zahtijeva na temelju carinskih propisa;

osobu, osim ako se drugačije ne odredi;
E24./F20. »puštanje robe« označava radnju kojom
carinska služba dopušta da se roba, koja se podvrgla carinjenju, stavi na
raspolaganje određenoj osobi;
E25./F24. »povrat« označava vraćanje, u
cijelosti ili djelomičnog, iznosa carine i poreza plaćenog na robu, te otpust,
u cijelosti ili djelomičnog, iznosa carine i poreza na robu koji još nije
plaćen;
E26./F17. »osiguranje« označava ono, što pruža
sigurnost carinskoj službi da će obveza prema njoj biti namirena. Osiguranje se
opisuje kao »opće«, ako osigurava da se iz njega mogu namiriti obveze nastale u
nekoliko navrata.
E27./F26. »treća strana« označava svaku osobu
koja radi izravno sa carinskom službom, za i u ime druge osobe, u vezi uvoza,
izvoza, prijevoza ili skladištenja robe.
Glava 3.
CARINJENJE I OSTALE
CARINSKE FORMALNOSTI
Ovlaštene carinarnice i ispostave
3.1. Norma
Carinska služba određuje carinarnice i ispostave
kod kojih se roba može podnositi i cariniti. U određivanju ovlaštenja i
rasporeda ovih carinarnica i ispostava i njihovog radnog vremena trebaju se
uzeti u obzir oni čimbenici, koji naročito uključuju zahtjeve trgovine.
3.2. Norma
Na zahtjev osobe o kojoj se radi i iz razloga
koje carinska služba smatra opravdanima, ona će ovisno o mogućnostima obaviti
radnje propisane za svrhe provedbe carinskog postupka i propisa i izvan
određenog radnog vremena ili na mjestu udaljenom od carinarnice ili ispostave.
3.3. Norma
Tamo gdje su carinarnice i ispostave smještene
na uobičajenim graničnim prijelazima, carinska služba treba uskladiti radno
vrijeme i nadležnosti tih jedinica.
3.4. Prijelazna norma
Na uobičajenim graničnim prijelazima, carinske
službe kojih se to tiče obavljaju zajednički nadzor, gdje god je to moguće.
3.5. Prijelazna norma
Ako carinska služba namjerava osnovati novu
carinarnicu ili ispostavu ili postojeću pretvoriti u uobičajeni granični
prijelaz, gdje god je to moguće surađivat će sa carinskom službom susjedne
zemlje da bi jednu do druge zasnovale takvu carinarnicu ili ispostavu koja bi
olakšala zajedničke kontrole.
Deklarant
(a) Osobe ovlaštene da djeluju kao deklaranti
3.6. Norma
Nacionalno zakonodavstvo određuje uvjete pod
kojima je osoba ovlaštena da djeluje kao deklarant.
3.7. Norma
Svaka osoba koja ima pravo raspolagati robom
ovlaštena je da djeluje kao deklarant.
(b) Odgovornosti deklaranta
3.8. Norma
Deklarant se smatra odgovornim carinarnici za
točnost podataka iznijetih u carinskoj deklaraciji te za plaćanje carine i
poreza.
(c) Prava deklaranta
3.9. Norma
Prije podnošenja carinske deklaracije,
deklarantu se odobrava pod uvjetima koje je utvrdila carinarnica:
(a) da provjeri robu; i
(b) da uzme uzorke.
3.10. Norma
Carinarnica neće zahtijevati zasebnu carinsku
deklaraciju koja bi se odnosila na uzorke za koje je odobreno da se uzmu pod
carinskim nazorom, pod uvjetom da su ovi uzorci uključeni u carinsku deklaraciju
koja se odnosi na pošiljku o kojoj se radi.
Carinska deklaracija
(a) Oblik i sadržaj carinske deklaracije
3.11 Norma
Sadržaj carinske deklaracije propisuje carinska
služba. Format papira na kojem je otisnuta carinska deklaracija usklađen je s
predloškom koji su ispostavili Ujedinjeni narodi.
Za automatizirane postupke carinjenja, format
carinske deklaracije podnesen elektronski zasniva se na međunarodnim normama za
elektronsku razmjenu informacija, kako je to propisano u Preporukama Vijeća za
carinsku suradnju o informacijskoj tehnologiji.
3.12. Norma
Carinska služba će ograničiti podatke koji se
zahtijevaju u carinskoj deklaraciji samo na one pojedinosti, koje se smatraju
potrebnima za obračun i ubiranje carine i poreza, za potrebe statistike i
primjenu carinskih propisa.
3.13. Norma
U slučaju kada deklarant, iz razloga koje
carinska služba smatra opravdanima, ne raspolaže svim informacijama
zahtijevanima za izradu carinske deklaracije, dopustit će mu se da podnese
privremenu ili nepotpunu carinsku deklaraciju, pod uvjetom da sadrži
pojedinosti koje carinska služba smatra neophodnima, te da deklarant preuzme
obvezu o njenom dopunjavanju unutar određenog roka.
3.14. Norma
Ukoliko carinska služba prihvati privremenu ili
nepotpunu carinsku deklaraciju, postupak tarifiranja koji se primjenjuje na
robu ne razlikuje se od onoga koji bi bio primijenjen, da je već u početku bila
podnijeta potpuna i ispravna carinska deklaracija.
3.15. Norma
Carinska služba će zahtijevati podnošenje
izvornika carinske deklaracije i najmanji potreban broj preslika.
(b) Prateće isprave koje se prilažu uz carinsku
deklaraciju
3.16. Norma
Kao priloge carinskoj deklaraciji, carinska
služba će zahtijevati samo one isprave koje su neophodne da bi omogućili
kontrolu provedbe i koji osiguravaju usklađenost sa svim zahtjevima, vezanim uz
primjenu carinskih propisa.
3.17. Norma
Ukoliko se uz carinsku deklaraciju ne mogu
priložiti određene prateće isprave iz razloga koji se carinarnici čine
opravdanima, ona će odobriti podnošenje tih isprava unutar određenog roka.
3.18. Prijelazna norma
Carinska služba će dopustiti podnošenje pratećih
isprava putem elektronskih sredstava.
3.19. Norma
Carinska služba neće zahtijevati prijevod
pojedinosti iz pratećih isprava, osim ako je to nužno zbog obrade carinske
deklaracije.
Podnošenje, evidentiranje i provjera carinske
deklaracije
3.20. Norma
Carinska služba će dopustiti podnošenje carinske
deklaracije kod svake carinarnice i ispostave, unaprijed imenovanoj za to.
3.21. Prijelazna norma
Carinska služba će dopustiti podnošenje carinske
deklaracije putem elektronskih sredstava.
3.22. Norma
Carinska deklaracija podnosi se tijekom radnih
sati koje odredi carinska služba.
3.23. Norma
Ukoliko nacionalno zakonodavstvo propisuje rok
za podnošenje carinske deklaracije, isti treba biti dostatan da bi omogućio
deklarantu dopunjavanje carinske deklaracije i pribavljanje zahtijevanih
pratećih isprava.
3.24. Norma
Na zahtjev deklaranta i to zbog razloga koje
carinska služba ocijeni opravdanima, produžiti će se propisani rok za
podnošenje carinske deklaracije.
3.25. Norma
Nacionalno zakonodavstvo donosi odredbe za
podnošenje, evidentiranje ili provjeru carinske deklaracije i pratećih isprava
prije prispijeća robe.
3.26. Norma
Ukoliko carinska služba ne može evidentirati
carinsku deklaraciju, navodi deklarantu razloge za to.
3.27. Norma
Carinska služba će dopustiti deklarantu da
izmijeni carinsku deklaraciju koja je već podnesena, pod uvjetom da je takav
zahtjev primljen prije nego što je započela provjera carinske deklaracije ili
pregled robe.
3.28. Prijelazna odredba
Carinska služba će dopustiti deklarantu da
izmijeni carinsku deklaraciju kada je takav zahtjev primljen i nakon što je
obavljena provjera carinske deklaracije, ukoliko razloge koje navodi deklarant
carinska služba smatra opravdanima.
3.29. Prijelazna norma
Deklarantu će biti odobreno da povuče carinsku
deklaraciju i zahtjeva drugi carinski postupak pod uvjetom da je takav zahtjev
podnijet carinskoj službi prije nego što je roba puštena na raspolaganje te
ukoliko razloge koje navodi deklarant carinska služba smatra opravdanima.
3.30. Norma
Provjera
carinske deklaracije obavlja se u isto vrijeme ili što je moguće prije nakon
što je carinska deklaracija evidentirana.
3.31. Norma
Za potrebe provjere carinske deklaracije,
carinska služba poduzima samo one radnje koje smatra neophodnim da bi se
osigurala usklađenost sa carinskim propisima.
Posebni postupci za ovlaštene osobe
3.32. Prijelazna norma
Za ovlaštene osobe koje udovoljavaju kriterijima
utvrđenim od strane carinske službe, uključujući i posjedovanje odgovarajuće
evidencije o udovoljavanju zahtjevima carinske službe kao i zadovoljavajući
sustav vođenja svoje trgovačke evidencije, carinska služba će se pobrinuti za:
– puštanje robe na raspolaganje nakon podnošenja
minimuma podataka potrebnih za identificiranje robe te odobriti naknadno
dopunjavanje konačne carinske deklaracije;
– carinjenje robe u deklarantovim prostorijama
ili na drugom mjestu odobrenom od strane carinske službe; i, dodatno, u mogućem
obimu, i druge posebne postupke kao što su:
– odobrenje jedne carinske deklaracije za sve
uvoze ili izvoze unutar datog roka kada se roba učestalo uvozi ili izvozi od
strane iste osobe;
– uporabu trgovačke evidencije ovlaštene osobe da
sama obračuna svoje carinske i porezne obveze i, kada je prikladno, osigura
udovoljavanje prema ostalim zahtjevima carinske službe;
– odobrenje podnošenja carinske deklaracije
putem sredstava unošenja u evidenciju ovlaštene osobe za koju kasnije treba podnijeti
naknadnu carinsku deklaraciju.
Pregled robe
a) Vrijeme zahtijevano za pregled robe
3.33. Norma
Kad carinska služba odluči da se deklarirana
roba treba pregledati, taj se pregled treba poduzeti što je prije moguće nakon
što se carinska deklaracija evidentira.
3.34. Norma
Kod rasporeda pregleda, prvenstvo treba dati
pregledu živih životinja i pokvarljive robe, kao i druge robe koje carinska
služba prihvaća kao hitne.
3.35. Prijelazna norma
Ukoliko i druga ovlaštena tijela trebaju
provjeriti robu koju je carinska služba također rasporedila za pregled,
carinska služba će osigurati da se ovi pregledi usklade i, ako je to moguće,
provedu u isto vrijeme.
b) Prisutnost deklaranta prilikom pregleda robe
3.36. Norma
Carinska služba će razmotriti zahtjev deklaranta
da bude prisutan ili da bude zastupljen tijekom pregleda robe. Takvi zahtjevi
se odobravaju ukoliko ne postoje izuzetne okolnosti.
3.37. Norma
Ako to smatra potrebnim, carinska služba može
zahtijevati da deklarant bude prisutan ili zastupljen tijekom pregleda robe
radi pružanja bilo koje vrste pomoći, potrebne da bi se pregled olakšao.
c) Uzimanje uzoraka od strane carinske službe
3.38. Norma
Uzorci se uzimaju samo kad carinska služba to
smatra potrebnim da bi utvrdila tarifni opis i / ili vrijednost deklarirane
robe, ili da bi osigurala primjenu ostalih propisa nacionalnog zakonodavstva.
Uzeti uzorci trebaju biti što je moguće manji.
Pogreške
3.39. Norma
Carinska služba neće odmjeravati teže kazne za
pogreške kod kojih se zadovolji utvrđivanjem da su te greške nastale nehotice i
da nije postojala namjera prijevare ili velikog nemara. Ako smatra da je
potrebno obeshrabriti ponavljanje takvih grešaka, može odmjeriti kaznu, ali ne
veću nego što je potrebno za tu svrhu.
Puštanje robe
3.40. Norma
Deklarirana roba ima se pustiti odmah nakon što
carinska služba izvrši njen pregled ili odluči da roba neće biti pregledana,
pod uvjetom da:
– nije pronađen nikakav prekršaj;
– su pribavljene dozvole za uvoz ili izvoz ili
bilo koji drugi zahtijevane isprave;
– su pribavljena sva odobrenja vezana uz
postupak o kojem se radi; i
– su plaćene sve carine i porezi ili da je
poduzeta odgovarajuća radnja kako bi se osiguralo njihovo ubiranje.
3.41. Norma
Ako carinska služba smatra da će deklarant naknadno
ispuniti sve formalnosti s obzirom na carinjenje, pustiti će robu pod uvjetima
da deklarant podnese trgovačku ili službenu ispravu prihvatljivu carinskoj
službi, jer pruža osnovne podatke o pošiljci o kojoj se radi, i da je predano
osiguranje za ubiranje svih carina i poreza koje se primjenjuju tamo gdje se to
zahtjeva.
3.42. Norma
Ako carinska služba odluči da će zahtijevati
laboratorijsku analizu uzoraka, podrobne tehničke dokumente ili savjet
stručnjaka, ona pušta robu i prije no što su poznati rezultati takve analize,
pod uvjetom da je predano svako zahtijevano osiguranje i pod uvjetom da se ne
radi o robi koja je predmet zabrane ili ograničenja.
3.43. Norma
Kad je otkriven prekršaj, carinska služba ne
čeka na završetak istrage ili prekršajnog odnosno kaznenog postupka prije
puštanja robe, pod uvjetom da roba ne podliježe konfiskaciji ili zapljeni ili
da neće biti potrebna kao dokaz u nekom kasnijem postupanju, i da deklarant
plati carinu i porez te podnese osiguranje za ubiranje bilo kakvih dodatnih
carina i poreza, kao i kazni koje bi se mogle nametnuti.
Ustupanje ili uništenje robe
3.44. Norma
Ukoliko roba još nije puštena u slobodan promet
ili je smještena pod drugi carinski postupak, pod uvjetom da nije utvrđen
nikakav prekršaj, od osobe o kojoj se radi neće se zahtijevati plaćanje carine
i poreza ili će imati pravo na njihov povrat:
– kada je, na njen zahtjev, takva roba
ustupljena državi ili uništena ili vraćena kao trgovinski bezvrijedna pod
carinski nadzor, kako to može odlučiti carinska služba. Sve troškove vezane uz
to snosi osoba na koju se to odnosi;
– kada je takva roba uništena ili nepovratno
izgubljena u slučaju nezgode ili više sile, pod uvjetom da je takvo uništenje
ili gubitak utvrđen na način koji je za carinsku službu prihvatljiv;
– kod manjka uzrokovanog prirodom robe, ako je
takav manjak utvrđen na način koji je za carinsku službu prihvatljiv;
Bilo kakav otpad ili ostaci preostali nakon
uništenja, ukoliko su preuzeti radi uporabe ili izvezeni, podliježu plaćanju
carine i poreza koja bi se primijenila na takav otpad ili ostatke, da su bili
uvezeni ili izvezeni u takvom stanju.
3.45. Prijelazna norma
Kad carinska služba prodaje robu koja nije bila
deklarirana unutar odobrenog roka ili ne može biti puštena iako nije bio
otkriven nikakav prekršaj, prihodi ostvareni od prodaje, nakon odbitka carine,
poreza i svih ostalih davanja i nastalih troškova, predaju se onim osobama koje
su ovlaštene da ih preuzmu ili se, ako to nije moguće, drže određeno vrijeme
njima na raspolaganje.
Glava 4.CARINE I POREZI
A. OBRAČUN, UBIRANJE I PLAĆANJECARINA I POREZA
4.1. Norma
Nacionalno zakonodavstvo određuje okolnosti kada
nastaje obveza plaćanja carine i poreza.
4.2. Norma
Rok unutar kojeg se obračunava carina i porez
koji se primjenjuju, određen je nacionalnim zakonodavstvom. Obračun treba
uslijediti što je prije moguće nakon što je podnijeta carinska deklaracija ili
je obveza nastala na drugi način.
4.3. Norma
Čimbenici na kojima se temelji obračun carine i
poreza te uvjeti pod kojima su određeni, pobliže se određuju nacionalnim
zakonodavstvom.
4.4. Norma
Stope carine i poreza trebaju biti objavljene u
službenim novinama.
4.5. Norma
Nacionalno zakonodavstvo određuje trenutak koji
se uzima u obzir za svrhe određivanja stopa carina i poreza.
4.6. Norma
Nacionalno zakonodavstvo određuje metode koje se
mogu koristiti za plaćanje carine i poreza.
4.7. Norma
Nacionalno zakonodavstvo određuje osobu(e)
odgovornu(e) za plaćanje carine i poreza.
4.8. Norma
Nacionalno zakonodavstvo određuje datum dospijeća
i mjesto gdje se plaćanje treba izvršiti.
4.9. Norma
Kad nacionalno zakonodavstvo odredi da datum
dospijeća može biti i nakon podnošenja robe, taj datum treba biti najmanje
deset dana nakon puštanja robe. Za razdoblje između datuma puštanja i datuma
dospijeća ne naplaćuje se kamata.
4.10. Norma
Nacionalno zakonodavstvo određuje rok unutar
kojeg carinska služba može poduzeti zakonske radnje za ubiranje carina i poreza
koje nisu plaćene do datuma dospijeća.
4.11. Norma
Nacionalno zakonodavstvo određuje kamatnu stopu
koja će se obračunati na iznose carina i poreza neplaćenih do datuma dospijeća,
kao i uvjete za primjenu takve kamate.
4.12. Norma
Kada su carina i porez plaćeni, uplatitelju se
ispostavlja potvrda kao dokaz o plaćanju, osim ako evidencija ne služi kao
dokaz o plaćanju.
4.13. Prijelazna norma
Domaće
zakonodavstvo određuje najmanju vrijednost i / ili najmanji iznos carine i
poreza ispod kojeg se carine i porezi ne ubiru.
4.14. Norma
Ako carinska služba utvrdi da će pogreške u
carinskoj deklaraciji ili u obračunu carine i poreza uzrokovati ili su
uzrokovale ubiranje ili utjerivanje iznosa carine i poreza koji je manji nego
što je zakonom trebalo obračunati, ona ispravlja pogreške i ubire manje plaćeni
iznos. Međutim, ako je iznos o kojem se radi manji od najmanjeg iznosa

B. ODGOĐENO PLAĆANJE CARINA I POREZA
4.15. Norma

odobrava.
4.16. Norma
Odgođeno plaćanje carina i poreza odobrava se
bez obračunavanja kamata do obima, koji je dopušten.

Rok za odgođeno plaćanje carine i poreza treba
iznositi najmanje četrnaest dana.
C. POVRAT CARINE I POREZA
4.18. Norma
Povrat se treba odobriti kad se utvrdi da su
carina i porez previše naplaćeni kao rezultat pogreške nastale u njihovom
obračunu.
4.19. Norma
Povrat se odobrava s obzirom na uvezenu ili
izvezenu robu za koju je utvrđeno da je neispravna ili da na drugi način nije u
skladu sa dogovorenim osobinama u vrijeme uvoza ili izvoza pa se vraća
dobavljaču ili drugoj osobi koju dobavljač imenuje, ukoliko su ispunjeni
sljedeći uvjeti:
– roba nije bila obrađivana, popravljana ili
korištena u zemlji uvoza, i ponovo se izvozi unutar razumnog vremena;
– roba nije bila obrađivana, popravljana ili
korištena u zemlji u koju je bila izvezena, i ponovo se uvozi unutar razumnog
vremena;
Međutim, korištenje robe neće spriječiti povrat ako
je takvo korištenje bilo neizbježno da bi se otkrila neispravnost ili druge
okolnosti koje su uzrokovale ponovni izvoz ili ponovni uvoz robe.
Kao alternativa ponovnom izvozu ili ponovnom
uvozu, roba se može ustupiti državi, ili uništiti, ili vratiti kao trgovački
bezvrijedna pod carinski nadzor, kako carinarnica odluči. Takvo ustupanje ili

odgađanja, a povrat previše naplaćenih iznosa treba izvršiti što je prije
moguće nakon provjere zahtjeva.

Kad carinska služba utvrdi da je više naplaćeni
iznos rezultat pogreške od strane carinske službe prilikom obračuna carina i
poreza, takav povrat treba imati prednost pred ostalima.
4.23. Norma
Kad su utvrđeni rokovi iznad kojih se zahtjev za
povrat neće prihvatiti, takva ograničenja trebaju trajati dovoljno dugo da bi
se uzele u obzir različite okolnosti koje se odnose na svaki oblik slučaja u
kojem se povrat može odobriti.
4.24. Norma

neće odobriti ako je iznos o kojem se radi manji od najmanjeg iznosa određenog

Glava 5.OSIGURANJE
5.1. Norma
Nacionalno zakonodavstvo određuje slučajeve u

podnosi.

Carinska služba određuje iznos osiguranja.
5.3. Norma
Svakoj osobi od koje se zahtijeva da položi
osiguranje, odobrava se da sama odabere oblik osiguranja, pod uvjetom da je
prihvatljiv carinarnici.

Kada nacionalno zakonodavstvo to omogućava,
carinska služba neće zahtijevati osiguranje ukoliko je uvjerena, da će obveze
prema carinskoj službi biti ispunjene.
5.5. Norma
Kad se osiguranje traži kako bi osiguralo da će
obveze proizašle iz carinskog postupka biti ispunjene, carinska služba prihvaća
opće osiguranje, i to naročito od onih deklaranata koji redovito deklariraju
robu kod raznih carinarnica unutar carinskog područja.
5.6. Norma

troškove, te učinkovito i za carinska služba, i za trgovinu. Carinska služba odeđuje
uvjete za njenu primjenu.
7.2. Norma
Kad se uvodi primjena računala, carinska služba
koristi odgovarajuće međunarodno prihvaćene standarde.
7.3. Norma
Uvođenje informacijske tehnologije treba se
provesti uz savjetovanje sa svim stranama na koje se to izravno odnosi, i to u
najvećoj mogućoj mjeri.
7.4. Norma
Novo ili izmijenjeno nacionalno zakonodavstvo
pobrinut će se za:
– elektronske trgovinske metode kao alternativu
zahtjevima za dokumentima zasnovanima na papiru;
– provjeru vjerodostojnosti elektronskih metoda
kao i onih zasnovanih na papiru;
– pravo carinske službe da zadrži informacije za
vlastitu uporabu i, kako je primjereno, da razmjenjuje takve informacije s
ostalim carinskim službama i svim drugim zakonski odobrenim stranama putem
sredstava elektronske trgovinske tehnike.
Glava 8.ODNOS IZMEĐU CARINSKE SLUŽBEI TREĆIH
OSOBA
8.1. Norma
Osobe na koje se to odnosi imaju mogućnost
poslovanja sa carinskom službom izravno ili imenujući treću osobu da djeluje za
njihov račun.
8.2. Norma
Nacionalno zakonodavstvo određuje uvjete pod
kojima osoba može djelovati za račun druge osobe u poslovanju sa carinskom
službom, i utvrđuje obveze trećih strana prema carinskoj službi s obzirom na
carine, poreze i bilo kakve nepravilnosti.
8.3. Norma
Prema carinskim transakcijama u kojima osoba o
kojoj se radi odabere poslovanje za svoj vlastiti račun, neće se ophoditi s
manjim pogodnostima niti će biti predmet strožih zahtjeva nego kod onih
carinskih transakcija koje za osobu o kojoj se radi obavlja treća strana.
8.4. Norma
Osoba imenovana kao treća strana ima ista prava
kao i osoba koja ju je imenovala za ove predmete vezane uz poslovanje sa
carinskom službom.
8.5. Norma
Carinska služba dopušta trećim stranama da
učestvuju u njenim službenim savjetovanjima s trgovinom.
8.6. Norma
Carinska služba određuje okolnosti pod kojima
nije spremna poslovati s trećom stranom.
8.7. Norma
Carinska služba treba u pisanom obliku
obavijestiti treću stranu o odluci da ne posluje s njom.
Glava 9.OBAVIJESTI, RJEŠENJA I ODLUKE KOJE
ISPOSTAVLJA CARINSKA SLUŽBA
A. OBAVIJESTI OPĆEG KARAKTERA
9.1. Norma
Carinska služba osigurava da sve obavijesti za
opću primjenu koje se odnose na carinske propise budu dostupne svakoj
zainteresiranoj osobi.
9.2. Norma
Kad se obavijest koja je učinjena dostupnom mora
izmijeniti zbog promjena u carinskim propisima, administrativnim mjerama ili
zahtjevima, carinska služba će sve izmijenjene obavijesti učiniti dostupnima
dosta ranije od stupanja tih izmjena na snagu da bi omogućila svim
zainteresiranim osobama da ih uzmu u obzir, osim ako je obaviještavanje
unaprijed isključeno.

Na zahtjev zainteresirane osobe, carinska služba
će osigurati što je moguće brže i točnije obavijesti vezane uz određena pitanja
koja postavi zainteresirana osoba, a u vezi su sa carinskim propisima.
9.5. Norma
Carinska služba ne pruža samo obavijesti koje se
izrično zahtijevaju, već i sve druge obavijesti za koje smatra da bi ih
zainteresirana osoba na koju se to odnosi trebala znati.
9.6. Norma
Kad carinska služba daje obavijesti, mora
osigurati da one ne otkrivaju pojedinosti osobne ili povjerljive prirode koje
se tiču carinske službe ili treće osobe, osim ukoliko takvo razotkrivanje
zahtijeva ili odobrava nacionalno zakonodavstvo.
9.7. Norma
Kad carinska služba ne može dati besplatne
obavijesti, svako plaćanje treba ograničiti na približne troškove usluge.
C. RJEŠENJA I ODLUKE
9.8. Norma
Na pisani zahtjev osobe na koju se to odnosi,
carinska služba obavještava o svom rješenju u pisanom obliku unutar roka
određenog nacionalnim zakonodavstvom. Ako je rješenje nepovoljno za osobu na
koju se odnosi, u njemu se navode razlozi i upućuje o pravu na žalbu.
9.9. Norma
Carinska služba ispostavlja obvezujuća mišljenja
na zahtjev zainteresirane osobe, pod pretpostavkom da carinska služba raspolaže
svim podacima koje smatra potrebnima.
Glava 10.ŽALBE U CARINSKIM PREDMETIMA
A. PRAVO NA ŽALBU
10.1. Norma
Nacionalno zakonodavstvo osigurava pravo na
žalbu u carinskim predmetima.
10.2. Norma
Svaka osoba, koja je izravno pogođena rješenjem
ili propustom carinske službe, ima pravo na žalbu.
10.3. Norma
Osobi koja je izravno pogođena rješenjem ili
propustom carinske službe, nakon što podnese zahtjev carinskoj službi, navode
se razlozi za donošenje takvog rješenja ili propusta unutar roka utvrđenog
nacionalnim zakonodavstvom. Ovo može ili ne mora rezultirati žalbom.
10.4. Norma
Nacionalno
zakonodavstvo treba omogućiti pravo žalbe carinskoj službi kao prvostupanjskom
tijelu.
10.5. Norma
Kada žalba carinska služba nije uvažena,
žalitelj treba imati pravo na podnošenje daljnje žalbe tijelu koje je neovisno
o carinskoj službi.
10.6. Norma
U krajnjoj instanciji, žalitelj treba imati
pravo na žalbu sudskim vlastima.
B. OBLIK I SADRŽAJ ŽALBE
10.7. Norma
Žalba se podnosi u pisanom obliku i mora
sadržavati razloge zbog kojih se podnosi.

Za podnošenje žalbe protiv rješenja carinske službe
treba odrediti vremenski rok, koji treba biti takav da žalitelju omogući
dovoljno vremena kako bi proučio osporavano rješenje i pripremio žalbu.

Kad se žalba podnosi carinskoj službi, neće se
zahtijevati da se zajedno sa žalbom podnose dokazi koji idu u prilog žalbi, već

C. RAZMATRANJE ŽALBE
10.10. Norma
Carinska služba donosi odluku o žalbi i
obavještava žalitelja o njoj u pisanom obliku što je moguće prije.
10.11. Norma
Kada je žalba carinskoj službi odbijena,
carinska služba navodi razloge za to u pisanom obliku i upućuje žalitelja o
njegovom pravu na podnošenje daljnje žalbe upravnim ili neovisnim vlastima, kao
i o roku za podnošenje takve žalbe.
10.12. Norma
Kada je žalba uvažena, carinska služba će što
prije postupiti prema rješenju ili odluci neovisnog ili sudskog tijela, osim u
slučajevima kad se carinska služba žali protiv odluke.

procedures and practices of Contracting Parties that can hamper international
trade and other international exchanges;
– meeting the needs of international trade and
the Customs for facilitation, simplification and harmonization of Customs
procedures and practices;
– ensuring appropriate standards of Customs
control; and
– enabling the Customs to respond to major
changes in business and administrative methods and techniques,
the Convention must be amended,
CONSIDERING also that the amended Convention:
– must provide that the core principles for such
simplification and harmonization are made obligatory on Contracting Parties to
the amended Convention;
– must provide the Customs with efficient
procedures supported by appropriate and effective control methods; and
– will enable the achievement of a high degree
of simplification and harmonization of Customs procedures and practices which
is an essential aim of the Council, and thus make a major contribution to
facilitation of international trade,
Have agreed as follows:
Article 1
The Preamble and the Articles of the Convention
are amended as set out in the text contained in Appendix I hereto.
Article 2
The Annexes of the Convention are replaced by
the General Annex contained in Appendix II and by the Specific Annexes
contained in Appendix III hereto.
Article 3
1. Any Contracting Party to the Convention may
express its consent to be bound by this Protocol, including Appendices I and
II, by:
(a) signing it without reservation of
ratification;
(b) depositing an instrument of ratification
after signing it subject to ratification; or
(c) acceding to it.
2. This Protocol shall be open until 30 th June
2000 for signature at the Headquarters of the Council in Brussels by the
Contracting Parties to the Convention. Thereafter, it shall be open for
accession.
3. This Protocol, including Appendices I and II,
shall enter into force three months after forty Contracting Parties have signed
this Protocol without reservation of ratification or have deposited their
instrument of ratification or accession.
4. After forty Contracting Parties have
expressed their consent to be bound by this Protocol in accordance with
paragraph 1, a Contracting Party to the Convention shall accept the amendments
to the Convention only by becoming a party to this Protocol. For such a
Contracting Party, this Protocol shall come into force three months after it
signs this Protocol without reservation of ratification or deposits an
instrument of ratification or accession.
Article 4
Any Contracting Party to the Convention may,
when it expresses its consent to be bound by this Protocol, accept any of the
Specific Annexes or Chapters therein contained in Appendix III hereto and shall
notify the Secretary General of the Council of such acceptance and of the
Recommended Practices in respect of which it enters reservations.
Article 5
After the entry into force of this Protocol, the
Secretary General of the Council shall not accept any instrument of
ratification or accession to the Convention.
Article 6
In relations between the Parties hereto, this
Protocol with its Appendices shall supersede the Convention.
Article 7
The Secretary General of the Council shall be
the depositary of this Protocol and shall perform the functions as provided for
in Article 19 contained in Appendix I to this Protocol.
Article 8
This Protocol shall be open for signature by the
Contracting Parties to the Convention at the Headquarters of the Council in
Brussels from 26 th June 1999.
Article 9
In accordance with Article 102 of the Charter of
the United Nations, this Protocol and its Appendices shall be registered with
the Secretariat of the United Nations at the request of the Secretary General
of the Council.
In witness whereof the undersigned, being duly
authorized thereto, have signed this Protocol.
Done at Brussels, this twenty-sixth day of June
nineteen hundred and ninety-nine, in the English and French languages, both
texts being equally authentic, in a single original which shall be deposited
with the Secretary General of the Council who shall transmit certified copies
to all the entities referred to in paragraph 1 of Article 8 contained in
Appendix I to this Protocol.
Appendix I.
INTERNATIONAL CONVENTION
ON THE SIMPLIFICATION AND HARMONIZATION OF CUSTOMS PROCEDURES (as amended)
PREAMBLE
The Contracting Parties to the present
Convention established under the auspices of the Customs Co-operation Council,
ENDEAVOURING to eliminate divergence between the
Customs procedures and practices of Contracting Parties that can hamper
international trade and other international exchanges,
DESIRING to contribute effectively to the
development of such trade and exchanges by simplifying and harmonizing Customs
procedures and practices and by fostering international co-operation,
NOTING that the significant benefits of
facilitation of international trade may be achieved without compromising
appropriate standards of Customs control,
RECOGNIZING that such simplification and harmonization
can be accomplished by applying, in particular, the following principles:
– the implementation of programmes aimed at
continuously modernizing Customs procedures and practices and thus enhancing
efficiency and effectiveness,
– the application of Customs procedures and
practices in a predictable, consistent and transparent manner,
– the provision to interested parties of all the
necessary information regarding Customs laws, regulations, administrative
guidelines, procedures and practices,
– the adoption of modern techniques such as risk
management and audit-based controls, and the maximum practicable use of
information technology,
– co-operation wherever appropriate with other
national authorities, other Customs administrations and the trading communities,
– the implementation of relevant international
standards,
– the provision to affected parties of easily
accessible processes of administrative and judicial review,
CONVINCED that an international instrument
incorporating the above objectives and principles that Contracting Parties
undertake to apply would lead to the high degree of simplification and
harmonization of Customs procedures and practices which is an essential aim of
the Customs Co-operation Council, and so make a major contribution to
facilitation of international trade,
Have agreed as follows:
Chapter I
Definitions
Article 1
For the purposes of this Convention:
A. «Standard» means a provision the
implementation of which is recognized as necessary for the achievement of
harmonization and simplification of Customs procedures and practices;
B. «Transitional Standard» means a Standard in
the General Annex for which a longer period for implementation is permitted;
C. «Recommended Practice» means a provision in a
Specific Annex which is recognized as constituting progress towards the
harmonization and the simplification of Customs procedures and practices, the
widest possible application of which is considered to be desirable;
D. «National legislation» means laws,
regulations and other measures imposed by a competent authority of a
Contracting Party and applicable throughout the territory of the Contracting
Party concerned, or treaties in force by which that Party is bound;
E. «General Annex» means the set of provisions
applicable to all the Customs procedures and practices referred to in this
Convention;
F. «Specific Annex» means a set of provisions
applicable to one or more Customs procedures and practices referred to in this
Convention;
G. «Guidelines» means a set of explanations of
the provisions of the General Annex, Specific Annexes and Chapters therein
which indicate some of the possible courses of action to be followed in
applying the Standards, Transitional Standards and Recommended Practices, and
in particular describing best practices and recommending examples of greater
facilities;
H. «Permanent Technical Committee» means the
Permanent Technical Committee of the Council;
I. «Council» means the Organization set up by
the Convention establishing a Customs Co-operation Council, done at Brussels on
15 December 1950;
J. «Customs or Economic Union» means a Union
constituted by, and composed of, States which has competence to adopt its own
regulations that are binding on those States in respect of matters governed by
this Convention, and has competence to decide, in accordance with its internal
procedures, to sign, ratify or accede to this Convention.
Chapter IISCOPE AND STRUCTURE
Article 2
Scope of the Convention
Each Contracting Party undertakes to promote the
simplification and harmonization of Customs procedures and, to that end, to
conform, in accordance with the provisions of this Convention, to the
Standards, Transitional Standards and Recommended Practices in the Annexes to
this Convention. However, nothing shall prevent a Contracting Party from
granting facilities greater than those provided for therein, and each
Contracting Party is recommended to grant such greater facilities as
extensively as possible.
Article 3
The provisions of this Convention shall not preclude
the application of national legislation with regard to either prohibitions or
restrictions on goods which are subject to Customs control.
Article 4
Structure of the Convention
1. The Convention comprises a Body, a General
Annex and Specific Annexes.
2. The General Annex and each Specific Annex to
this Convention consist, in principle, of Chapters which subdivide an Annex and
comprise:
A. definitions; and
B. Standards, some of which in the General Annex
are Transitional Standards.
3. Each Specific Annex also contains Recommended
Practices.
4. Each Annex is accompanied by Guidelines, the
texts of which are not binding upon Contracting Parties.
Article 5
For the purposes of this Convention, any
Specific Annex(es) or Chapter(s) therein to which a Contracting Party is bound
shall be construed to be an integral part of the Convention, and in relation to
that Contracting Party any reference to the Convention shall be deemed to
include a reference to such Annex(es) or Chapter(s).
Chapter IIIMANAGEMENT OF THE CONVENTION
Article 6
Management Committee
1. There shall be established a Management
Committee to consider the implementation of this Convention, any measures to
secure uniformity in the interpretation and application thereof, and any
amendments proposed thereto.
2. The Contracting Parties shall be members of
the Management Committee.
3. The competent administration of any entity
qualified to become a Contracting Party to this Convention under the provisions
of Article 8 or of any Member of the World Trade Organization shall be entitled
to attend the sessions of the Management Committee as an observer. The status
and rights of such Observers shall be determined by a Council Decision. The
aforementioned rights cannot be exercised before the entry into force of the
Decision.
4. The Management Committee may invite the
representatives of international governmental and non-governmental
organizations to attend the sessions of the Management Committee as observers.
5. The Management Committee:
A. shall recommend to the Contracting Parties:
I. amendments to the Body of this Convention;
II. amendments to the General Annex, the
Specific Annexes and Chapters therein and the incorporation of new Chapters to
the General Annex; and
III. the incorporation of new Specific Annexes
and new Chapters to Specific Annexes;
B. may decide to amend Recommended Practices or
to incorporate new Recommended Practices to Specific Annexes or Chapters
therein in accordance with Article 16;
C. shall consider implementation of the
provisions of this Convention in accordance with Article 13, paragraph 4;
D. shall review and update the Guidelines;
E. shall consider any other issues of relevance
to this Convention that may be referred to it;
F. shall inform the Permanent Technical
Committee and the Council of its decisions.
6. The competent administrations of the
Contracting Parties shall communicate to the Secretary General of the Council
proposals under paragraph 5 (a), (b), (c) or (d) of this Article and the
reasons therefor, together with any requests for the inclusion of items on the
Agenda of the sessions of the Management Committee. The Secretary General of
the Council shall bring proposals to the attention of the competent
administrations of the Contracting Parties and of the observers referred to in
paragraphs 2, 3 and 4 of this Article.
7. The Management Committee shall meet at least
once each year. It shall annually elect a Chairman and Vice-Chairman. The
Secretary General of the Council shall circulate the invitation and the draft Agenda
to the competent administrations of the Contracting Parties and to the
observers referred to in paragraphs 2, 3 and 4 of this Article at least six
weeks before the Management Committee meets.
8. Where a decision cannot be arrived at by
consensus, matters before the Management Committee shall be decided by voting
of the Contracting Parties present. Proposals under paragraph 5 (a), (b) or (c)
of this Article shall be approved by a two-thirds majority of the votes cast.
All other matters shall be decided by the Management Committee by a majority of
the votes cast.
9. Where Article 8, paragraph 5 of this
Convention applies, the Customs or Economic Unions which are Contracting
Parties shall have, in case of voting, only a number of votes equal to the
total votes allotted to their Members which are Contracting Parties.
10. Before the closure of its session, the
Management Committee shall adopt a report. This report shall be transmitted to
the Council and to the Contracting Parties and observers mentioned in paragraphs
2, 3 and 4.
11. In the absence of relevant provisions in
this Article, the Rules of Procedure of the Council shall be applicable, unless
the Management Committee decides otherwise.
Article 7
For the purpose of voting in the Management
Committee, there shall be separate voting on each Specific Annex and each
Chapter of a Specific Annex.
A. Each Contracting Party shall be entitled to
vote on matters relating to the interpretation, application or amendment of the
Body and General Annex of the Convention.
B. As regards matters concerning a Specific
Annex or Chapter of a Specific Annex that is already in force, only those
Contracting Parties that have accepted that Specific Annex or Chapter therein
shall have the right to vote.
C. Each Contracting Party shall be entitled to
vote on drafts of new Specific Annexes or new Chapters of a Specific Annex.
Chapter IVCONTRACTING PARTY
Article 8
Ratification of the Convention
1. Any Member of the Council and any Member of
the United Nations or its specialized agencies may become a Contracting Party
to this Convention:
A. by signing it without reservation of
ratification;
B. by depositing an instrument of ratification
after signing it subject to ratification; or
C. by acceding to it.
2. This Convention shall be open until 30th June
1974 for signature at the Headquarters of the Council in Brussels by the
Members referred to in paragraph 1 of this Article. Thereafter, it shall be
open for accession by such Members.
3. Any Contracting Party shall, at the time of
signing, ratifying or acceding to this Convention, specify which if any of the
Specific Annexes or Chapters therein it accepts. It may subsequently notify the
depositary that it accepts one or more Specific Annexes or Chapters therein.
4. Contracting Parties accepting any new
Specific Annex or any new Chapter of a Specific Annex shall notify the
depositary in accordance with paragraph 3 of this Article.
5. (a) Any Customs or Economic Union may become,
in accordance with paragraphs 1, 2 and 3 of this Article, a Contracting Party
to this Convention. Such Customs or Economic Union shall inform the depositary
of its competence with respect to the matters governed by this Convention. Such
Customs or Economic Union shall also inform the depositary of any substantial modification
in the extent of its competence.
(b) A Customs or Economic Union which is a
Contracting Party to this Convention shall, for the matters within its
competence, exercise in its own name the rights, and fulfil the
responsibilities, which the Convention confers on the Members of such a Union
which are Contracting Parties to this Convention. In such a case, the Members
of such a Union shall not be entitled to individually exercise these rights,
including the right to vote.
Article 9
1. Any Contracting Party which ratifies this
Convention or accedes thereto shall be bound by any amendments to this
Convention, including the General Annex, which have entered into force at the
date of deposit of its instrument of ratification or accession.
2. Any Contracting Party which accepts a
Specific Annex or Chapter therein shall be bound by any amendments to the
Standards contained in that Specific Annex or Chapter which have entered into
force at the date on which it notifies its acceptance to the depositary. Any Contracting
Party which accepts a Specific Annex or Chapter therein shall be bound by any
amendments to the Recommended Practices contained therein, which have entered
into force at the date on which it notifies its acceptance to the depositary,
unless it enters reservations against one or more of those Recommended
Practices in accordance with Article 12 of this Convention.
Article 10
Application of the Convention
1. Any Contracting Party may, at the time of
signing this Convention without reservation of ratification or of depositing
its instrument of ratification or accession, or at any time thereafter, declare
by notification given to the depositary that this Convention shall extend to
all or any of the territories for whose international relations it is responsible.
Such notification shall take effect three months after the date of the receipt
thereof by the depositary. However, this Convention shall not apply to the
territories named in the notification before this Convention has entered into
force for the Contracting Party concerned.
2. Any Contracting Party which has made a
notification under paragraph 1 of this Article extending this Convention to any
territory for whose international relations it is responsible may notify the
depositary, under the procedure of Article 19 of this Convention, that the
territory in question will no longer apply this Convention.
Article 11
For the application of this Convention, a
Customs or Economic Union that is a Contracting Party shall notify to the Secretary
General of the Council the territories which form the Customs or Economic
Union, and these territories are to be taken as a single territory.
Article 12
Acceptance of the provisions and reservations
1. All Contracting Parties are hereby bound by the
General Annex.
2. A Contracting Party may accept one or more of
the Specific Annexes or one or more of the Chapters therein. A Contracting
Party which accepts a Specific Annex or Chapter(s) therein shall be bound by
all the Standards therein. A Contracting Party which accepts a Specific Annex
or Chapter(s) therein shall be bound by all the Recommended Practices therein
unless, at the time of acceptance or at any time thereafter, it notifies the
depositary of the Recommended Practice(s) in respect of which it enters
reservations, stating the differences existing between the provisions of its
national legislation and those of the Recommended Practice(s) concerned. Any
Contracting Party which has entered reservations may withdraw them, in whole or
in part, at any time by notification to the depositary specifying the date on
which such withdrawal takes effect.
3. Each Contracting Party bound by a Specific
Annex or Chapter(s) therein shall examine the possibility of withdrawing any
reservations to the Recommended Practices entered under the terms of paragraph
2 and notify the Secretary General of the Council of the results of that review
at the end of every three-year period commencing from the date of the entry
into force of this Convention for that Contracting Party, specifying the
provisions of its national legislation which, in its opinion, are contrary to
the withdrawal of the reservations.
Article 13
Implementation of the provisions
1. Each Contracting Party shall implement the
Standards in the General Annex and in the Specific Annex(es) or Chapter(s)
therein that it has accepted within 36 months after such Annex(es) or
Chapter(s) have entered into force for that Contracting Party.
2. Each Contracting Party shall implement the
Transitional Standards in the General Annex within 60 months of the date that
the General Annex has entered into force for that Contracting Party.
3. Each Contracting Party shall implement the
Recommended Practices in the Specific Annex(es) or Chapter(s) therein that it
has accepted within 36 months after such Specific Annex(es) or Chapter(s) have
entered into force for that Contracting Party, unless reservations have been
entered as to one or more of those Recommended Practices.
4. (a) Where the periods provided for in
paragraph 1 or 2 of this Article would, in practice, be insufficient for any
Contracting Party to implement the provisions of the General Annex, that
Contracting Party may request the Management Committee, before the end of the
period referred to in paragraph 1 or 2 of this Article, to provide an extension
of that period. In making the request, the Contracting Party shall state the
provision(s) of the General Annex with regard to which an extension of the
period is required and the reasons for such request.
(b) In exceptional circumstances, the Management
Committee may decide to grant such an extension. Any decision by the Management
Committee granting such an extension shall state the exceptional circumstances
justifying the decision and the extension shall in no case be more than one
year. At the expiry of the period of extension, the Contracting Party shall
notify the depositary of the implementation of the provisions with regard to
which the extension was granted.
Article 14
Settlement of disputes
1. Any dispute between two or more Contracting
Parties concerning the interpretation or application of this Convention shall
so far as possible be settled by negotiation between them.
2. Any dispute which is not settled by
negotiation shall be referred by the Contracting Parties in dispute to the
Management Committee which shall thereupon consider the dispute and make
recommendations for its settlement.
3. The Contracting Parties in dispute may agree
in advance to accept the recommendations of the Management Committee as
binding.
Article 15
Amendments to the Convention
1. The text of any amendment recommended to the
Contracting Parties by the Management Committee in accordance with Article 6,
paragraph 5 (a) (i) and (ii) shall be communicated by the Secretary General of
the Council to all Contracting Parties and to those Members of the Council that
are not Contracting Parties.
2. Amendments to the Body of the Convention
shall enter into force for all Contracting Parties twelve months after deposit
of the instruments of acceptance by those Contracting Parties present at the
session of the Management Committee during which the amendments were
recommended, provided that no objection is lodged by any of the Contracting
Parties within a period of twelve months from the date of communication of such
amendments.
3. Any recommended amendment to the General
Annex or the Specific Annexes or Chapters therein shall be deemed to have been
accepted six months after the date the recommended amendment was communicated
to Contracting Parties, unless:
A. there has been an objection by a Contracting
Party or, in the case of a Specific Annex or Chapter, by a Contracting Party
bound by that Specific Annex or Chapter; or
B. a Contracting Party informs the Secretary
General of the Council that, although it intends to accept the recommended
amendment, the conditions necessary for such acceptance are not yet fulfilled.
4. If a Contracting Party sends the Secretary
General of the Council a communication as provided for in paragraph 3 (b) of
this Article, it may, so long as it has not notified the Secretary General of
the Council of its acceptance of the recommended amendment, submit an objection
to that amendment within a period of eighteen months following the expiry of
the six-month period referred to in paragraph 3 of this Article.
5. If an objection to the recommended amendment
is notified in accordance with the terms of paragraph 3 (a) or 4 of this
Article, the amendment shall be deemed not to have been accepted and shall be
of no effect.
6. If any Contracting Party has sent a
communication in accordance with paragraph 3 (b) of this Article, the amendment
shall be deemed to have been accepted on the earlier of the following two
dates:
A the date by which all the Contracting Parties which
sent such communications have notified the Secretary General of the Council of
their acceptance of the recommended amendment, provided that, if all the
acceptances were notified before the expiry of the period of six months
referred to in paragraph 3 of this Article, that date shall be taken to be the
date of expiry of the said six-month period;
B the date of expiry of the eighteen-month
period referred to in paragraph 4 of this Article.
7. Any amendment to the General Annex or the
Specific Annexes or Chapters therein deemed to be accepted shall enter into
force either six months after the date on which it was deemed to be accepted
or, if a different period is specified in the recommended amendment, on the
expiry of that period after the date on which the amendment was deemed to be
accepted.
8. The Secretary General of the Council shall,
as soon as possible, notify the Contracting Parties to this Convention of any
objection to the recommended amendment made in accordance with paragraph 3 (a),
and of any communication received in accordance with paragraph 3 (b), of this
Article. The Secretary General of the Council shall subsequently inform the
Contracting Parties whether the Contracting Party or Parties which have sent
such a communication raise an objection to the recommended amendment or accept
it.
Article 16
1. Notwithstanding the amendment procedure laid
down in Article 15 of this Convention, the Management Committee in accordance
with Article 6 may decide to amend any Recommended Practice or to incorporate
new Recommended Practices to any Specific Annex or Chapter therein. Each
Contracting Party shall be invited by the Secretary General of the Council to
participate in the deliberations of the Management Committee. The text of any
such amendment or new Recommended Practice so decided upon shall be
communicated by the Secretary General of the Council to the Contracting Parties
and those Members of the Council that are not Contracting Parties to this
Convention.
2. Any amendment or incorporation of new Recommended
Practices decided upon under paragraph 1 of this Article shall enter into force
six months after their communication by the Secretary General of the Council.
Each Contracting Party bound by a Specific Annex or Chapter therein forming the
subject of such amendments or incorporation of new Recommended Practices shall
be deemed to have accepted those amendments or new Recommended Practices unless
it enters a reservation under the procedure of Article 12 of this Convention.
Article 17
Duration of accession
1. This Convention is of unlimited duration but
any Contracting Party may denounce it at any time after the date of its entry
into force under Article 18 thereof.
2. The denunciation shall be notified by an
instrument in writing, deposited with the depositary.
3. The denunciation shall take effect six months
after the receipt of the instrument of denunciation by the depositary.
4. The provisions of paragraphs 2 and 3 of this
Article shall also apply in respect of the Specific Annexes or Chapters therein,
for which any Contracting Party may withdraw its acceptance at any time after
the date of the entry into force.
5. Any Contracting Party which withdraws its
acceptance of the General Annex shall be deemed to have denounced the
Convention. In this case, the provisions of paragraphs 2 and 3 also apply.
Chapter VFINAL PROVISIONS
Article 18
Entry into force of the Convention
1. This Convention shall enter into force three
months after five of the entities referred to in paragraphs 1 and 5 of Article
8 thereof have signed the Convention without reservation of ratification or
have deposited their instruments of ratification or accession.
2. This Convention shall enter into force for
any Contracting Party three months after it has become a Contracting Party in
accordance with the provisions of Article 8.
3. Any Specific Annex or Chapter therein to this
Convention shall enter into force three months after five Contracting Parties
have accepted that Specific Annex or that Chapter.
4. After any Specific Annex or Chapter therein
has entered into force in accordance with paragraph 3 of this Article, that
Specific Annex or Chapter therein shall enter into force for any Contracting
Party three months after it has notified its acceptance. No Specific Annex or
Chapter therein shall, however, enter into force for a Contracting Party before
this Convention has entered into force for that Contracting Party.
Article 19
Depositary of the Convention
1. This Convention, all signatures with or
without reservation of ratification and all instruments of ratification or
accession shall be deposited with the Secretary General of the Council.
2. The depositary shall:
A. receive and keep custody of the original
texts of this Convention;
B. prepare certified copies of the original texts
of this Convention and transmit them to the Contracting Parties and those
Members of the Council that are not Contracting Parties and the Secretary
General of the United Nations;
C. receive any signature with or without
reservation of ratification, ratification or accession to this Convention and
receive and keep custody of any instruments, notifications and communications
relating to it;
D. examine whether the signature or any
instrument, notification or communication relating to this Convention is in due
and proper form and, if need be, bring the matter to the attention of the
Contracting Party in question;
E. notify the Contracting Parties, those Members
of the Council that are not Contracting Parties, and the Secretary General of
the United Nations of:
– signatures, ratifications, accessions and
acceptances of Annexes and Chapters under Article 8 of this Convention;
– new Chapters of the General Annex and new
Specific Annexes or Chapters therein which the Management Committee decides to
recommend to incorporate in this Convention;
– the date of entry into force of this
Convention, of the General Annex and of each Specific Annex or Chapter therein
in accordance with Article 18 of this Convention;
– notifications received in accordance with
Articles 8, 10, 11,12 and 13 of this Convention; 14.
– withdrawals of acceptances of Annexes/Chapters
by Contracting Parties;
– denunciations under Article 17 of this
Convention; and
– any amendment accepted in accordance with
Article 15 of this Convention and the date of its entry into force.
3. In the event of any difference appearing
between a Contracting Party and the depositary as to the performance of the
latter’s functions, the depositary or that Contracting Party shall bring the
question to the attention of the other Contracting Parties and the signatories
or, as the case may be, the Management Committee or the Council.
Article 20
Registration and authentic texts
In accordance with Article 102 of the Charter of
the United Nations, this Convention shall be registered with the Secretariat of
the United Nations at the request of the Secretary General of the Council.
In witness whereof the undersigned, being duly
authorized thereto, have signed this Convention.
Done at Kyoto, this eighteenth day of May
nineteen hundred and seventy-three in the English and French languages, both
texts being equally authentic, in a single original which shall be deposited
with the Secretary General of the Council who shall transmit certified copies
to all the entities referred to in paragraph 1 of Article 8 of this Convention.
GENERAL ANNEX
Chapter 1
GENERAL PRINCIPLES
1.1. Standard
The Definitions, Standards and Transitional
Standards in this Annex shall apply to Customs procedures and practices
specified in this Annex and, insofar as applicable, to procedures and practices
in the Specific Annexes.
1.2. Standard
The conditions to be fulfilled and Customs
formalities to be accomplished for procedures and practices in this Annex and
in the Specific Annexes shall be specified in national legislation and shall be
as simple as possible.
1.3. Standard
The Customs shall institute and maintain formal
consultative relationships with the trade to increase co-operation and
facilitate participation in establishing the most effective methods of working
commensurate with national provisions and international agreements.
Chapter 2
DEFINITIONS
For the purposes of the Annexes to this
Convention:
E1./F23. «appeal» means the act by which a
person who is directly affected by a decision or omission of the Customs and
who considers himself to be aggrieved thereby seeks redress before a competent
authority;
E2./F19. «assessment of duties and taxes» means
the determination of the amount of duties and taxes payable;
E3./F4. «audit-based control» means measures by
which the Customs satisfy themselves as to the accuracy and authenticity of
declarations through the examination of the relevant books, records, business
systems and commercial data held by persons concerned;
E4./F15. «checking the Goods declaration» means
the action taken by the Customs to satisfy themselves that the Goods
declaration is correctly made out and that the supporting documents required
fulfil the prescribed conditions;
E5./F9. «clearance» means the accomplishment of
the Customs formalities necessary to allow goods to enter home use, to be
exported or to be placed under another Customs procedure;
E6./F10. «Customs» means the Government Service
which is responsible for the administration of Customs law and the collection of
duties and taxes and which also has the responsibility for the application of
other laws and regulations relating to the importation, exportation, movement
or storage of goods;
E7./ F3. «Customs control» means measures
applied by the Customs to ensure compliance with Customs law;
E8./ F11. «Customs duties» means the duties laid
down in the Customs tariff to which goods are liable on entering or leaving the
Customs territory;
E9./ F16. «Customs formalities» means all the
operations which must be carried out by the persons concerned and by the
Customs in order to comply with the Customs law;
E10./ F18. «Customs law» means the statutory and
regulatory provisions relating to the importation, exportation, movement or
storage of goods, the administration and enforcement of which are specifically
charged to the Customs, and any regulations made by the Customs under their
statutory powers;
E11./ F2. «Customs office» means the Customs
administrative unit competent for the performance of Customs formalities, and
the premises or other areas approved for that purpose by the competent
authorities;
E12./ F25. «Customs territory» means the
territory in which the Customs law of a Contracting Party applies;
E13./ F6. «decision» means the individual act by
which the Customs decide upon a matter relating to Customs law;
E14./ F7. «declarant» means any person who makes
a Goods declaration or in whose name such a declaration is made;
E15./ F5. «due date» means the date when payment
of duties and taxes is due;
E16./ F12. «duties and taxes» means import
duties and taxes and/or export duties and taxes;
E17./ F27. «examination of goods» means the
physical inspection of goods by the Customs to satisfy themselves that the
nature, origin, condition, quantity and value of the goods are in accordance
with the particulars furnished in the Goods declaration;
E18./ F13. «export duties and taxes» means
Customs duties and all other duties, taxes or charges which are collected on or
in connection with the exportation of goods, but not including any charges
which are limited in amount to the approximate cost of services rendered or
collected by the Customs on behalf of another national authority;
E19./ F8. «Goods declaration» means a statement
made in the manner prescribed by the Customs, by which the persons concerned
indicate the Customs procedure to be applied to the goods and furnish the
particulars which the Customs require for its application;
E20./ F14. «import duties and taxes» means
Customs duties and all other duties, taxes or charges which are collected on or
in connection with the importation of goods, but not including any charges
which are limited in amount to the approximate cost of services rendered or
collected by the Customs on behalf of another national authority;
E21./ F1. «mutual administrative assistance»
means actions of a Customs administration on behalf of or in collaboration with
another Customs administration for the proper application of Customs law and
for the prevention, investigation and repression of Customs offences;
E22./ F21. «omission» means the failure to act
or give a decision required of the Customs by Customs law within a reasonable
time on a matter duly submitted to them;
E23./ F22. «person» means both natural and legal
persons, unless the context otherwise requires;
E24./ F20. «release of goods» means the action
by the Customs to permit goods undergoing clearance to be placed at the
disposal of the persons concerned;
E25./ F24. «repayment» means the refund, in
whole or in part, of duties and taxes paid on goods and the remission, in whole
or in part, of duties and taxes where payment has not been made;
E26./ F17. «security» means that which ensures
to the satisfaction of the Customs that an obligation to the Customs will be
fulfilled. Security is described as «general» when it ensures that the
obligations arising from several operations will be fulfilled;
E27./ F26. «third party» means any person who
deals directly with the Customs, for and on behalf of another person, relating
to the importation, exportation, movement or storage of goods.
Chapter 3
CLEARANCE AND OTHER
CUSTOMS FORMALITIES
Competent Customs offices
3.1. Standard
The Customs shall designate the Customs offices
at which goods may be produced or cleared. In determining the competence and
location of these offices and their hours of business, the factors to be taken
into account shall include in particular the requirements of the trade.
3.2. Standard
At the request of the person concerned and for
reasons deemed valid by the Customs, the latter shall, subject to the
availability of resources, perform the functions laid down for the purposes of
a Customs procedure and practice outside the designated hours of business or
away from Customs offices. Any expenses chargeable by the Customs shall be
limited to the approximate cost of the services rendered.
3.3. Standard
Where Customs offices are located at a common
border crossing, the Customs administrations concerned shall correlate the
business hours and the competence of those offices.
3.4. Transitional Standard
At common border crossings, the Customs
administrations concerned shall, whenever possible, operate joint controls.
3.5. Transitional Standard
Where the Customs intend to establish a new
Customs office or to convert an existing one at a common border crossing, they
shall, wherever possible, co-operate with the neighbouring Customs to establish
a juxtaposed Customs office to facilitate joint controls.
The declarant
(a) Persons entitled to act as declarant
3.6. Standard
National legislation shall specify the
conditions under which a person is entitled to act as declarant.
3.7. Standard
Any person having the right to dispose of the
goods shall be entitled to act as declarant.
(b) Responsibilities of the declarant
3.8. Standard
The declarant shall be held responsible to the
Customs for the accuracy of the particulars given in the Goods declaration and
the payment of the duties and taxes.
(c) Rights of the declarant
3.9. Standard
Before lodging the Goods declaration the
declarant shall be allowed, under such conditions as may be laid down by the
Customs:
a. to inspect the goods; and
b. to draw samples.
3.10. Standard
The Customs shall not require a separate Goods
declaration in respect of samples allowed to be drawn under Customs supervision,
provided that such samples are included in the Goods declaration concerning the
relevant consignment.
The Goods declaration
(a) Goods declaration format and contents
3.11. Standard
The contents of the Goods declaration shall be
prescribed by the Customs. The paper format of the Goods declaration shall
conform to the UN-layout key.
For automated Customs clearance processes, the
format of the electronically lodged Goods declaration shall be based on
international standards for electronic information exchange as prescribed in
the Customs Co-operation Council Recommendations on information technology.
3.12. Standard
The Customs shall limit the data required in the
Goods declaration to only such particulars as are deemed necessary for the
assessment and collection of duties and taxes, the compilation of statistics
and the application of Customs law.
3.13. Standard
Where, for reasons deemed valid by the Customs,
the declarant does not have all the information required to make the Goods declaration,
a provisional or incomplete Goods declaration shall be allowed to be lodged,
provided that it contains the particulars deemed necessary by the Customs and
that the declarant undertakes to complete it within a specified period.
3.14. Standard
If the Customs register a provisional or
incomplete Goods declaration, the tariff treatment to be accorded to the goods
shall not be different from that which would have been accorded had a complete
and correct Goods declaration been lodged in the first instance. The release of
the goods shall not be delayed provided that any security required has been
furnished to ensure collection of any applicable duties and taxes.
3.15. Standard
The Customs shall require the lodgement of the
original Goods declaration and only the minimum number of copies necessary.
(b) Documents supporting the Goods declaration
3.16. Standard
In support of the Goods declaration the Customs
shall require only those documents necessary to permit control of the operation
and to ensure that all requirements relating to the application of Customs law
have been complied with.
3.17. Standard
Where certain supporting documents cannot be
lodged with the Goods declaration for reasons deemed valid by the Customs, they
shall allow production of those documents within a specified period.
3.18. Transitional Standard
The Customs shall permit the lodgement of
supporting documents by electronic means.
3.19. Standard
The Customs shall not require a translation of
the particulars of supporting documents except when necessary to permit
processing of the Goods declaration.
Lodgement, registration and checking of the
Goods declaration
3.20. Standard
The Customs shall permit the lodging of the
Goods declaration at any designated Customs office.
3.21. Transitional Standard
The Customs shall permit the lodging of the
Goods declaration by electronic means.
3.22. Standard
The Goods declaration shall be lodged during the
hours designated by the Customs.
3.23. Standard
Where national legislation lays down a time
limit for lodging the Goods declaration, the time allowed shall be sufficient
to enable the declarant to complete the Goods declaration and to obtain the
supporting documents required.
3.24. Standard
At the request of the declarant and for reasons
deemed valid by the Customs, the latter shall extend the time limit prescribed
for lodging the Goods declaration.
3.25. Standard
National legislation shall make provision for
the lodging and registering or checking of the Goods declaration and supporting
documents prior to the arrival of the goods.
3.26. Standard
When the Customs cannot register the Goods
declaration, they shall state the reasons to the declarant.
3.27. Standard
The Customs shall permit the declarant to amend the
Goods declaration that has already been lodged, provided that when the request
is received they have not begun to check the Goods declaration or to examine
the goods.
3.28. Transitional Standard
The Customs shall permit the declarant to amend
the Goods declaration if a request is received after checking of the Goods
declaration has commenced, if the reasons given by the declarant are deemed
valid by the Customs.
3.29. Transitional Standard
The declarant shall be allowed to withdraw the
Goods declaration and apply for another Customs procedure, provided that the
request to do so is made to the Customs before the goods have been released and
that the reasons are deemed valid by the Customs.
3.30. Standard
Checking the Goods declaration shall be effected
at the same time or as soon as possible after the Goods declaration is
registered.
3.31. Standard
For the purpose of checking the Goods
declaration, the Customs shall take only such action as they deem essential to
ensure compliance with Customs law.
Special procedures for authorized persons
3.32. Transitional Standard
For authorized persons who meet criteria
specified by the Customs, including having an appropriate record of compliance
with Customs requirements and a satisfactory system for managing their commercial
records, the Customs shall provide for:
– release of the goods on the provision of the
minimum information necessary to identify the goods and permit the subsequent
completion of the final Goods declaration;
– clearance of the goods at the declarant’s
premises or another place authorized by the Customs; and, in addition, to the
extent possible, other special procedures such as:
– allowing a single Goods declaration for all
imports or exports in a given period where goods are imported or exported frequently
by the same person;
– use of the authorized persons’ commercial
records to self-assess their duty and tax liability and, where appropriate, to
ensure compliance with other Customs requirements;
– allowing the lodgement of the Goods
declaration by means of an entry in the records of the authorized person to be
supported subsequently by a supplementary Goods declaration.
Examination of the goods
(a) Time required for examination of goods
3.33. Standard
When the Customs decide that goods declared shall
be examined, this examination shall take place as soon as possible after the
Goods declaration has been registered.
3.34. Standard
When scheduling examinations, priority shall be
given to the examination of live animals and perishable goods and to other
goods which the Customs accept are urgently required.
3.35. Transitional Standard
If the goods must be inspected by other
competent authorities and the Customs also schedules an examination, the
Customs shall ensure that the inspections are co-ordinated and, if possible,
carried out at the same time.
(b) Presence of the declarant at examination of
goods
3.36. Standard
The Customs shall consider requests by the
declarant to be present or to be represented at the examination of the goods.
Such requests shall be granted unless exceptional circumstances exist.
3.37. Standard
If the Customs deem it useful, they shall
require the declarant to be present or to be represented at the examination of the
goods to give them any assistance necessary to facilitate the examination.
(c) Sampling by the Customs
3.38. Standard
Samples shall be taken only where deemed
necessary by the Customs to establish the tariff description and/or value of
goods declared or to ensure the application of other provisions of national
legislation. Samples drawn shall be as small as possible.
Errors
3.39. Standard
The Customs shall not impose substantial
penalties for errors where they are satisfied that such errors are inadvertent
and that there has been no fraudulent intent or gross negligence. Where they
consider it necessary to discourage a repetition of such errors, a penalty may
be imposed but shall be no greater than is necessary for this purpose.
Release of goods
3.40. Standard
Goods declared shall be released as soon as the
Customs have examined them or decided not to examine them, provided that:
– no offence has been found;
– the import or export licence or any other
documents required have been acquired;
– all permits relating to the procedure
concerned have been acquired; and
– any duties and taxes have been paid or that
appropriate action has been taken to ensure their collection.
3.41. Standard
If the Customs are satisfied that the declarant
will subsequently accomplish all the formalities in respect of clearance they
shall release the goods, provided that the declarant produces a commercial or
official document giving the main particulars of the consignment concerned and
acceptable to the Customs, and that security, where required, has been
furnished to ensure collection of any applicable duties and taxes.
3.42. Standard
When the Customs decide that they require
laboratory analysis of samples, detailed technical documents or expert advice,
they shall release the goods before the results of such examination are known,
provided that any security required has been furnished and provided they are
satisfied that the goods are not subject to prohibitions or restrictions.
3.43. Standard
When an offence has been detected, the Customs
shall not wait for the completion of administrative or legal action before they
release the goods, provided that the goods are not liable to confiscation or
forfeiture or to be needed as evidence at some later stage and that the
declarant pays the duties and taxes and furnishes security to ensure collection
of any additional duties and taxes and of any penalties which may be imposed.
Abandonment or destruction of goods
3.44. Standard
When goods have not yet been released for home
use or when they have been placed under another Customs procedure, and provided
that no offence has been detected, the person concerned shall not be required
to pay the duties and taxes or shall be entitled to repayment thereof:
– when, at his request, such goods are abandoned
to the Revenue or destroyed or rendered commercially valueless under Customs
control, as the Customs may decide. Any costs involved shall be borne by the
person concerned;
– when such goods are destroyed or irrecoverably
lost by accident or force majeure, provided that such destruction or loss is
duly established to the satisfaction of the Customs;
– on shortages due to the nature of the goods
when such shortages are duly established to the satisfaction of the Customs.
Any waste or scrap remaining after destruction
shall be liable, if taken into home use or exported, to the duties and taxes
that would be applicable to such waste or scrap imported or exported in that
state.
3.45. Transitional Standard
When the Customs sell goods which have not been declared
within the time allowed or could not be released although no offence has been
discovered, the proceeds of the sale, after deduction of any duties and taxes
and all other charges and expenses incurred, shall be made over to those
persons entitled to receive them or, when this is not possible, held at their
disposal for a specified period.
Chapter 4
DUTIES AND TAXES
A. ASSESSMENT,
COLLECTION AND PAYMENT OF DUTIES AND TAXES
4.1. Standard
National legislation shall define the
circumstances when liability to duties and taxes is incurred.
4.2. Standard
The time period within which the applicable
duties and taxes are assessed shall be stipulated in national legislation. The
assessment shall follow as soon as possible after the Goods declaration is
lodged or the liability is otherwise incurred.
4.3. Standard
The factors on which the assessment of duties
and taxes is based and the conditions under which they are determined shall be
specified in national legislation.
4.4. Standard
The rates of duties and taxes shall be set out
in official publications.
4.5. Standard
National legislation shall specify the point in
time to be taken into consideration for the purpose of determining the rates of
duties and taxes.
4.6. Standard
National legislation shall specify the methods
that may be used to pay the duties and taxes.
4.7. Standard
National legislation shall specify the person(s)
responsible for the payment of duties and taxes.
4.8. Standard
National legislation shall determine the due
date and the place where payment is to be made.
4.9. Standard
When national legislation specifies that the due
date may be after the release of the goods, that date shall be at least ten
days after the release. No interest shall be charged for the period between the
date of release and the due date.
4.10. Standard
National legislation shall specify the period
within which the Customs may take legal action to collect duties and taxes not
paid by the due date.
4.11. Standard
National legislation shall determine the rate of
interest chargeable on amounts of duties and taxes that have not been paid by
the due date and the conditions of application of such interest.
4.12. Standard
When the duties and taxes have been paid, a
receipt constituting proof of payment shall be issued to the payer, unless
there is other evidence constituting proof of payment.
4.13. Transitional Standard
National legislation shall specify a minimum
value and/or a minimum amount of duties and taxes below which no duties and
taxes will be collected.
4.14. Standard
If the Customs find that errors in the Goods
declaration or in the assessment of the duties and taxes will cause or have
caused the collection or recovery of an amount of duties and taxes less than
that legally chargeable, they shall correct the errors and collect the amount
underpaid. However, if the amount involved is less than the minimum amount
specified in national legislation, the Customs shall not collect or recover
that amount.
B. DEFERRED PAYMENT OF DUTIES AND TAXES
4.15. Standard
Where national legislation provides for the
deferred payment of duties and taxes, it shall specify the conditions under
which such facility is allowed.
4.16. Standard
Deferred payment shall be allowed without
interest charges to the extent possible.
4.17. Standard
The period for deferred payment of duties and
taxes shall be at least fourteen days.
C. REPAYMENT OF DUTIES AND TAXES
4.18. Standard
Repayment shall be granted where it is
established that duties and taxes have been overcharged as a result of an error
in their assessment.
4.19. Standard
Repayment shall be granted in respect of
imported or exported goods which are found to have been defective or otherwise
not in accordance with the agreed specifications at the time of importation or
exportation and are returned either to the supplier or to another person
designated by the supplier, subject to the following conditions:
– the goods have not been worked, repaired or
used in the country of importation, and are re-exported within a reasonable
time;
– the goods have not been worked, repaired or
used in the country to which they
were exported, and are re-imported within a
reasonable time.
Use of the goods shall, however, not hinder the
repayment if such use was indispensable to discover the defects or other
circumstances which caused the reexportation or re-importation of the goods.
As an alternative to re-exportation or
re-importation, the goods may be abandoned to the Revenue or destroyed or
rendered commercially valueless under Customs control, as the Customs may
decide. Such abandonment or destruction shall not entail any cost to the
Revenue.
4.20. Transitional Standard
Where permission is given by the Customs for
goods originally declared for a Customs procedure with payment of duties and
taxes to be placed under another Customs procedure, repayment shall be made of
any duties and taxes charged in excess of the amount due under the new
procedure.
4.21. Standard
Decisions on claims for repayment shall be
reached, and notified in writing to the persons concerned, without undue delay,
and repayment of amounts overcharged shall be made as soon as possible after
the verification of claims.
4.22. Standard
Where it is established by the Customs that the
overcharge is a result of an error on the part of the Customs in assessing the
duties and taxes, repayment shall be made as a matter of priority.
4.23. Standard
Where time limits are fixed beyond which claims
for repayment will not be accepted, such limits shall be of sufficient duration
to take account of the differing circumstances pertaining to each type of case
in which repayment may be granted.
4.24. Standard
Repayment shall not be granted if the amount
involved is less than the minimum amount specified in national legislation.
Chapter 5
SECURITY
5.1. Standard
National legislation shall enumerate the cases
in which security is required and shall specify the forms in which security is
to be provided.
5.2. Standard
The Customs shall determine the amount of
security.
5.3. Standard
Any person required to provide security shall be
allowed to choose any form of security provided that it is acceptable to the
Customs.
5.4. Standard
Where national legislation provides, the Customs
shall not require security when they are satisfied that an obligation to the
Customs will be fulfilled.
5.5. Standard
When security is required to ensure that the
obligations arising from a Customs procedure will be fulfilled, the Customs
shall accept a general security, in particular from declarants who regularly
declare goods at different offices in the Customs territory.
5.6. Standard
Where security is required, the amount of
security to be provided shall be as low as possible and, in respect of the
payment of duties and taxes, shall not exceed the amount potentially
chargeable.
5.7. Standard
Where security has been furnished, it shall be
discharged as soon as possible after the Customs are satisfied that the
obligations under which the security was required have been duly fulfilled.
Chapter 6
CUSTOMS CONTROL
6.1. Standard
All goods, including means of transport, which
enter or leave the Customs territory, regardless of whether they are liable to
duties and taxes, shall be subject to Customs control.
6.2. Standard
Customs control shall be limited to that
necessary to ensure compliance with the Customs law.
6.3. Standard
In the application of Customs control, the
Customs shall use risk management.
6.4. Standard
The Customs shall use risk analysis to determine
which persons and which goods, including means of transport, should be examined
and the extent of the examination.
6.5. Standard
The Customs shall adopt a compliance measurement
strategy to support risk management.
6.6. Standard
Customs control systems shall include
audit-based controls.
6.7. Standard
The Customs shall seek to co-operate with other
Customs administrations and seek to conclude mutual administrative assistance
agreements to enhance Customs control.
6.8. Standard
The Customs shall seek to co-operate with the
trade and seek to conclude Memoranda of Understanding to enhance Customs
control.
6.9. Transitional Standard
The Customs shall use information technology and
electronic commerce to the greatest possible extent to enhance Customs control.
6.10. Standard
The Customs shall evaluate traders’ commercial
systems where those systems have an impact on Customs operations to ensure
compliance with Customs requirements.
Chapter 7
APPLICATION OF
INFORMATION TECHNOLOGY
7.1. Standard
The Customs shall apply information technology
to support Customs operations, where it is cost-effective and efficient for the
Customs and for the trade. The Customs shall specify the conditions for its
application.
7.2. Standard
When introducing computer applications, the
Customs shall use relevant internationally accepted standards.
7.3. Standard
The introduction of information technology shall
be carried out in consultation with all relevant parties directly affected, to
the greatest extent possible.
7.4. Standard
New or revised national legislation shall
provide for:
– electronic commerce methods as an alternative
to paper-based documentary requirements;
– electronic as well as paper-based
authentication methods;
– the right of the Customs to retain information
for their own use and, as appropriate, to exchange such information with other
Customs administrations and all other legally approved parties by means of
electronic commerce techniques.
Chapter 8
RELATIONSHIP BETWEEN THE
CUSTOMSAND THIRD PARTIES
8.1. Standard
Persons concerned shall have the choice of
transacting business with the Customs either directly or by designating a third
party to act on their behalf.
8.2. Standard
National legislation shall set out the
conditions under which a person may act for and on behalf of another person in
dealing with the Customs and shall lay down the liability of third parties to
the Customs for duties and taxes and for any irregularities.
8.3. Standard
The Customs transactions where the person
concerned elects to do business on his own account shall not be treated less
favourably or be subject to more stringent requirements than those Customs
transactions which are handled for the person concerned by a third party.
8.4. Standard
A person designated as a third party shall have
the same rights as the person who designated him in those matters related to
transacting business with the Customs.
8.5. Standard
The Customs shall provide for third parties to
participate in their formal consultations with the trade.
8.6. Standard
The Customs shall specify the circumstances under
which they are not prepared to transact business with a third party.
8.7. Standard
The Customs shall give written notification to
the third party of a decision not to transact business.
Chapter 9
INFORMATION, DECISIONS
AND RULINGS SUPPLIED BY THE CUSTOMS
A. INFORMATION OF GENERAL APPLICATION
9.1. Standard
The Customs shall ensure that all relevant
information of general application pertaining to Customs law is readily
available to any interested person.
9.2. Standard
When information that has been made available
must be amended due to changes in Customs law, administrative arrangements or
requirements, the Customs shall make the revised information readily available
sufficiently in advance of the entry into force of the changes to enable
interested persons to take account of them, unless advance notice is precluded.
9.3. Transitional Standard
The Customs shall use information technology to
enhance the provision of information.
B. INFORMATION OF A
SPECIFIC NATURE
9.4. Standard
At the request of the interested person, the
Customs shall provide, as quickly and as accurately as possible, information
relating to the specific matters raised by the interested person and pertaining
to Customs law.
9.5. Standard
The Customs shall supply not only the
information specifically requested but also any other pertinent information
which they consider the interested person should be made aware of.
9.6. Standard
When the Customs supply information, they shall
ensure that they do not divulge details of a private or confidential nature
affecting the Customs or third parties unless such disclosure is required or
authorized by national legislation.
9.7. Standard
When the Customs cannot supply information free
of charge, any charge shall be limited to the approximate cost of the services
rendered.
C. DECISIONS AND RULINGS
9.8. Standard
At the written request of the person concerned,
the Customs shall notify their decision in writing within a period specified in
national legislation. Where the decision is adverse to the person concerned,
the reasons shall be given and the right of appeal advised.
9.9. Standard
The Customs shall issue binding rulings at the
request of the interested person, provided that the Customs have all the
information they deem necessary.
Chapter 10
APPEALS IN CUSTOMS
MATTERS
A. RIGHT OF APPEAL
10.1. Standard
National legislation shall provide for a right
of appeal in Customs matters.
10.2. Standard
Any person who is directly affected by a
decision or omission of the Customs shall have a right of appeal.
10.3. Standard
The person directly affected by a decision or
omission of the Customs shall be given, after having made a request to the
Customs, the reasons for such decision or omission within a period specified in
national legislation. This may or may not result in an appeal.
10.4. Standard
National legislation shall provide for the right
of an initial appeal to the Customs.
10.5. Standard
Where an appeal to the Customs is dismissed, the
appellant shall have the right of a further appeal to an authority independent
of the Customs administration.
10.6. Standard
In the final instance, the appellant shall have
the right of appeal to a judicial authority.
B. FORM AND GROUNDS OF
APPEAL
10.7. Standard
An appeal shall be lodged in writing and shall
state the grounds on which it is being made.
10.8. Standard
A time limit shall be fixed for the lodgement of
an appeal against a decision of the Customs and it shall be such as to allow
the appellant sufficient time to study the contested decision and to prepare an
appeal.
10.9. Standard
Where an appeal is to the Customs they shall
not, as a matter of course, require that any supporting evidence be lodged
together with the appeal but shall, in appropriate circumstances, allow a
reasonable time for the lodgement of such evidence.
C. CONSIDERATION OF
APPEAL
10.10. Standard
The Customs shall give its ruling upon an appeal
and written notice thereof to the appellant as soon as possible.
10.11. Standard
Where an appeal to the Customs is dismissed, the
Customs shall set out the reasons therefor in writing and shall advise the
appellant of his right to lodge any further appeal with an administrative or
independent authority and of any time limit for the lodgement of such appeal.
10.12. Standard
Where an appeal is allowed, the Customs shall
put their decision or the ruling of the independent or judicial authority into
effect as soon as possible, except in cases where the Customs appeal against
the ruling.
Članak 3.
Izvršenje Protokola iz članka 1. ove Uredbe u nadležnosti
je Ministarstva financija – Carinske uprave.
Članak 4.
Na dan donošenja ove Uredbe, Protokol iz članka
1. ove Uredbe nije na snazi za Republiku Hrvatsku, te će se podaci o njegovu
stupanju na snagu objaviti sukladno odredbi članka 30. stavak 3. Zakona o
sklapanju i izvršavanju međunarodnih ugovora.
Ova Uredba stupa na snagu danom objave u
»Narodnim novinama«.
