Na temelju članka 5. stavka 2. Zakona o sklapanju i izvršavanju međunarodnih ugovora (»Narodne novine«, broj 28/96), Vlada Republike Hrvatske je na sjednici održanoj 21. lipnja 2000. godine donijela
Članak 1.
Republika Hrvatska pristupa Međunarodnoj konvenciji o uzajamnoj administrativnoj pomoći radi prevencije, istraživanja i suzbijanja carinskih prekršaja, sačinjenoj u Nairobiju, 9. lipnja 1977. godine, u izvorniku na engleskom i francuskom jeziku.
Republika Hrvatska prihvaća Anekse I do XI navedene Konvencije.
Članak 2.
Tekst međunarodnog ugovora iz članka 1. ove Uredbe u prijevodu na hrvatski jezik i u izvorniku na engleskom jeziku glasi:
INTERNATIONAL CONVENTION ON VISUAL ADMINISTRATIVE ASSISTANCE FOR THE PREVENTION, INVESTIGATION AND REPRESSION OF CUSTOMS OFFENCES
PREAMBLE
THE CONTRACTING PARTIES to the present Convention, established under the auspices of the Customs Co-operation Council,
Considering that offences against Customs law are prejudicial to the economic, social and fiscal interests of States and to the legitimate interests of trade,
Considering that action against Customs offences can be rendered more effective by co-operation between Customs administrations, and that such co-operation is one of the aims of the Convention establishing a Customs Co-operation Council,
Have agreed as follows:
Chapter I
Definitions
Article 1
For the purposes of this Convention:
(a) the term »Customs law« means all the statutory or regulatory provisions enforced or administered by the Customs administrations concerning the importation, exportation or transit of goods:
(b) the term »Customs offence« means any breach, or attempted breach, of Customs law;
(c) the term »Customs fraud« means a Customs offence by which a person deceives the Customs and thus evades, wholly or partly, the payment of import or export duties and taxes or the application of prohibitions or restrictions laid down by Customs law or obtains any advantage contrary to Customs law;
(d) the term »smuggling« means Customs fraud consisting in the movement of goods across a Customs frontier in any clandestine manner;
(e) the term »import or export duties and taxes« means Customs duties and all other duties, taxes, fees or other charges which are collected on or in connection with the importation or exportation of goods but not including fees and charges which are limited in amount to the approximate cost of services rendered;
(f) the term »person« means both natural and legal persons, unless the context otherwise requires;
(g) the term »the Council« means the organization set up by the Convention establishing a Customs Co-operation Council, done at Brussels on 15 December 1950;
(h) the term »Permanent Technical Committee« means the Permanent Technical Committee of the Council;
(ij) the term »ratification« means ratification, acceptance or approval.
Chapter II
Scope
of the Convention
Article 2
1. The Contracting Parties bound by one or more Annexes to this Convention agree that their Customs administrations shall afford each other mutual assistance with a view to preventing, investigating and repressing Customs offences, in accordance with the provisions of this Convention.
2. The Customs administration of a Contracting Party may request mutual assistance as provided for in paragraph 1 of this Article in the course of any investigation or in connection with any judicial or administrative proceedings being undertaken by that Contracting Party. If the Customs administration is not itself conducting the proceedings, it may request mutual assistance only within the limits of its competence in these proceedings. Similarly, if proceedings are undertaken in the country of the requested administration, the latter provides the assistance requested within the limits of its competence in these proceedings.
3. Mutual assistance as provided for in paragraph 1 of this Article shall not extend to requests for the arrest of persons or for the recovery of duties, taxes, charges, fines or any other monies on behalf of another Contracting Party.
Article 3
If a Contracting Party considers that the assistance sought would infringe upon its sovereignty, security or other substantial national interests or prejudice the legitimate commercial interests of any enterprise, public or private, it may decline to provide that assistance or give it subject to certain conditions or requirements.
Article 4
If the Customs administration of a Contracting Party requests assistance which it itself would be unable to give if requested to do so by the other Contracting Party, it shall draw attention to the fact in its request. Compliance with such a request shall be within the discretion of the requested Contracting Party.
Chapter III
GENERAL ASSISTANCE
PROCEDURES
Article 5
1. Any intelligence, documents or other information communicated or obtained under this Convention:
(a) shall be used only for the purposes specified in this Convention, including use in judicial or administrative proceedings, and subject to such restrictions as may be laid down by the Customs administration which furnished them; and
(b) shall be afforded in the receiving country the same protection in respect of confidentiality and official secrecy as applies in that country to the same kind of intelligence, documents and other information obtained in its own territory.
2. Such intelligence, documents or other information may be used for other purposes only with the written consent of the Customs administration which furnished them and subject to any restrictions laid down by that administration and to the provisions of paragraph 1 (b) of this Article.
Article 6
1. The communications between Contracting Parties provided for by this Convention shall pass directly between Customs administrations. The Customs administrations of the Contracting Parties shall designate the services or officials responsible for such communications and shall advise the Secretary General of the Council of the names and addresses of those services of officials. The Secretary General shall communicate this information to the other Contracting Parties.
2. The Customs administration of the requested Contracting Party shall, subject to the laws and regulations in force in its territory, take all necessary measures to comply with a request for assistance.
3. The Customs administration of the requested Contracting Party shall reply to a request for assistance as soon as possible.
Article 7
1. Requests for assistance under this Convention shall normally be made in writing; they shall contain the requisite information and be accompanied by such documents as may be deemed useful.
2. Requests in writing shall be in a language acceptable to the Contracting Parties concerned. Any documents accompanying such requests shall be translated into a mutually acceptable language, if necessary.
3. Contracting Parties shall in all cases accept requests for assistance and accompanying documents in English or French accompanied by a translation into English or French.
4. When, for reasons of urgency in particular, requests for assistance have not been made in writing, the requested Contracting Party may require written confirmation.
Article 8
Any expenses incurred under this Convention in respect of experts or witnesses shall be borne by the requesting Contracting Party. The Contracting Parties shall waive all claims for reimbursement of any other costs incurred in the execution of this Convention.
Chapter IV
Miscellaneous
provisions
Article 9
The Council and the Customs administrations of the Contracting Parties shall arrange for the services responssible for the prevention, investigation, and repression of Customs offences to maintain personal and direct relations with a view to furthering the general aims of the Convention.
Article 10
For the purposes of this Convention any Annex or Annexes to which a Contracting Party is bound shall be construed to be an integral part of the Convention, and in relation to that Contracting Party any reference to the Convention shall be deemed to include a reference to such Annex or Annexes.
Article 11
The provisions of this Convention shall not preclude the application of any more extensive mutual assistance which certain Contracting Parties grant or may grant in future.
Chapter V
Role
of the Council and of the Permanent Technical Committee
Article 12
1. The Council shall, in accordance with the provisions of this Convention, be responsible for the administration and development of this Convention.
2. To these ends the Permanent Technical Committee shall, under the authority of the Council and in accordance with any directions given by the Council, have the following functions:
(a) to submit to the Council proposals for such amendments to this Convention as it may consider necessary;
(b) to furnish opinions on the interpretation of provisions of the Convention;
(c) to maintain relations with the other international organizations concerned and, in particular, with the competent bodies of the United Nations, with UNESCO and with the International Criminal Police Organization/Interpol, as regards action against illicit traffic in narcotic drugs and psychotropic substances, and action against illicit traffic in works of art, antiques and other cultural property;
(d) to take any action likely to further the general aims of the Convention and in particular to study new methodss and procedures to facilitate the prevention, investigation and repression of Customs offences, to convene meetings, etc.;
(e) to perform such tasks as the Council may direct in relation to the provisions of the Convention.
Article 13
For the purposes of voting in the Council and in the Permanent Technical Committee each Annex shall be taken to be a separate Convention.
Chapter VI
Final provisions
Article 14
Any dispute between two or more Contracting Parties concerning the interpretation or application of this Convention shall be settled by negotiation between them.
Article 15
1. Any State Member of the Council and any State Member of the United Nations or its specialized agencies may become a Contracting Party to this Convention*;
(a) by signing it without reservation of ratification;
(b) by depositing an instrument of ratification after signing it subject to ratification; or
(c) by acceding to it.
2. This Convention shall be open until 30th June 1978 for signature at the Headquarters of the Council in Brussels by the States referred to in paragraph 1 of this Article. Thereafter, it shall be open for their accession.
3. Each State referred to in paragraph 1 of this Article shall at the time of signing, ratifying or acceding to this Convention specify the Annex or Annexes it accepts, it being necessary to accept at least one Annex. It may subsequently notify the Secretary General of the Council that it accepts one or more further Annexes.
4. The instruments of ratification or accession shall be deposited with the Secretary General of the Council.
5. Customs or economic unions may, together with all their Member States or at any time after their Member States have become Contracting Parties to this Convention, also become Contracting Parties to this Convention in accordance with the provisions of paragraphs 1, 2 and 3 of this Article. However, such unions shall not have the right to vote.
Article 16
1. This Convention shall enter into force three months after five of the States referred to in paragraph 1 of Article 15 thereof have signed the Convention without reservation of ratification or have deposited their instruments of ratification or accession.
2. For any Contracting Party signing without reservation of ratification, ratifying or acceding to this Convention after five States have signed it without reservation of ratification or have deposited their instruments of ratification or accession, this Convention shall enter into force three months after the said Contracting Party has signed without reservation of ratification or deposited its instrument of ratification or accession.
3. Any Annex to this Convention shall enter into force three months after two States have accepted that Annex. For any Contracting Party which subsequently accepts an Annex after two States have accepted it, that Annex shall enter into force three months after the said Contracting Party has notified its acceptance. No Annex shall however enter into force for a Contracting Party before the Convention has entered into force for that Contracting Party.
Article 17
1. Any State may, at the time of signing this Convention without reservation of ratification or of depositing its instruments of ratification or accession, or any time thereafter, declare by notification given to the Secretary General of the Council that this Convention shall extend to all or any of the territories for whose international relations its is responsible. Such notification shall take effect three months after the date of receipt thereof by the Secretary General of the Council. However, the Convention shall not apply to the territories named in the notification before the Convention has entered into force for the State concerned.
2. Any State which has made a notification under paragraph 1 of this Article extending this Convention to any territory for whose international relations it is responsible may notify the Secretary General of the Council, under the procedure of Article 19 of this Convention, that the territory in question will no longer apply the Convention.
Article 18*
Each Contracting Party shall be deemed to have acceded to, or accepted all the provisions in the Convention or the Annexes thereto unless, at the time of acceding to the Convention or separately accepting an Annex or at any time thereafter, it has notified the Secretary General of the Council of any reservations in respect of provisions to which it cannot subscribe. It shall undertake to examine periodically the provisions in respect of which it has entered reservations any notify the Secretary General of the Council in the event of the withdrawal of the reservations.
Article 19
1. This Convention is of unlimited duration but any Contracting Party may denounce it at any time after the date of its entry into force under Article 16 thereof.
2. The denunciation shall be notified by an instrument in writing, deposited with the Secretary General of the Council.
3. The denunciation shall take effect six months after the receipt of the instrument of denunciation by the Secretary General of the Council.
4. The provisions of paragraphs 2 and 3 of this Article shall also apply in respect of the Annexes to this Convention, any Contracting Party being entitled at any time after the date of their entry into force under Article 16 of the Convention, to withdraw its acceptance of one or more Annexes. Any Contracting Party which withdraws its acceptance of all the Annexes shall be deemed to have denounced the Convention.
5. Any Contracting Party which denounces the Convention or withdraws its acceptance of one or more Annexes shall remain bound by the provisions or Article 5 of this Convention for as long as it retains in its possession any intelligence, documents or other information obtained under the Convention.
Article 20
1. The Council may recommend amendments to this Convention.
2. The text of any amendment so recommended shall be communicated by the Secretary General of the Council to all Contracting Parties to this Convention, to the other signatory States and to those States Members of the Council that are not Contracting Parties to this Convention.
3. Any proposed amendment communicated in accordance with the preceding paragraph shall come into force with respect to all Contracting Parties three months after the expiry of a period of two years following the date of communication of the proposed amendment during which period no objection to the proposed amendment has been communicated to the Secretary General of the Council by a State which is a Contracting Party.
4. If an objection to the proposed amendment has been communicated to the Secretary General of the Council by a State which is a Contracting Party before the expiry of the period of two years specified in paragraph 3 of this Article, the amendment shall be deemed not to have been accepted and shall have no effect whatsoever.
Article 21
1. Any Contracting Party ratifying or acceding to this Convention shall be deemed to have accepted any amendments thereto which have entered into force at the date of deposit of its instrument of ratification or accession.
2. Any Contracting Party which accepts an Annex shall be deemed to have accepted any amendments to that Annex which have entered into force at the date on which it notifies its acceptance to the Secretary General of the Council.
Article 22
The Secretary General of the Council shall notify the Contracting Parties to this Convention, the other signatory States, those States Members of the Council that are not Contracting Parties to this Convention, and the Secretary General of the United Nations of:
(a) signatures, ratifications, accessions and notifications under Article 15 of this Convention;
(b) the date of entry into force of this Convention and of each of the Annexes in accordance with Article 16;
(c) notification received in accordance with Article 17;
(d) denunciation under Article 19;
(e) any amendment deemed to have been accepted in accordance with Article 20 and the date of its entry into force.
Article 23
Upon its entry into force this Convention shall be registered with the Secretariat of the United Nations, in accordance with Article 102 of the Charter of the United Nations.
In witness whereof the undersigned, being duly authorized thereto, have signed this Convention.
Done at Nairobi, this ninth day of June nineteen hundred and seventy-seven, in the English and French languages, both texts being equally authentic, in a single original which shall be deposited with the Secretary General of the Council who shall transmit certified copies to all the States referred to in paragraph 1 of Article 15 of this Convention.
ANNEX I
ASSISTANCE BY A CUSTOMS ADMINISTRATION ON ITS OWN INITIATIVE
1. The Customs administration of a Contracting Party shall, on its own initiative, communicate to the Customs administration of the Contracting Party concerned, any information of a substantial nature which has come to light in the course of its normal activities and which gives good reason to believe that a serious Customs offence will be committed in the territory of the other Contracting Party. The information to be communicated shall concern, in particular, the movements of persons, goods and means of transport.
2. The Customs administration of a Contracting Party shall, where deemed appropriate, communicate on its own initiative to the Customs administration of another Contracting Party documents, reports, records of evidence or certified copies thereof in support of the information furnished under paragraph 1.
3. The Customs administration of a Contracting Party shall, on its own initiative, communicate to the Customs administration of another Contracting Party that is directly concerned, any information likely to be of material assistance to it in connection with Customs offences and, particularly, in connection with new means or methods of committing such offences.
ANNEX II
ASSISTANCE, ON REQUEST, IN THE ASSESSMENT OF IMPORT OR EXPORT DUTIES AND TAXES
I. At the request of the Customs administration of a Contracting Party which has good reason to believe that a serious Customs offence has been committed in its country, the Customs administration of the requested Contracting Party shall communicate all available information which may help to ensure the proper assessment of import or export duties and taxes.
2. A Contracting Party shall be taken to have fulfilled its obligations in this respect if, for example, it communicates as appropriate in response to a request the following information or documents available to it:
(a) in respect of the value of goods for Customs purposes: the commercial invoices presented to the Customs of the country of exportation or importation or copies of such invoices, certified or not by the Customs, as the circumstances may require; documentation showing current export or import prices; a copy of the declaration of value made on exportation or importation of the goods; trade catalogues, price lists, etc. published in the country of exportation or in the country of importation;
(b) in respect of the tariff classification of goods: analyses carried out by laboratory services to determine the tariff classification of the goods; the tariff description declared on importation or exportation:
(c) in respect of the origin of goods: the declaration of origin made on exportation, when such declaration is required; the Customs status of the goods in the country of exportation (Customs transit Customs warehouse, temporary admission, free zone, free circulation, exported under drawback, etc.).
ANNEX III
ASSISTANCE, ON REQUEST, RELATING TO CONTROLS
At the request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall communicate to that Customs administration information concerning the following matters:
(a) the authenticity of official documents produced in support of a Goods declaration made to the Customs authorities of the requesting Contracting Party;
(b) whether goods imported into the territory of the requesting Contracting Party have been lawfully exported from the territory of the other Contracting Party;
(c) whether goods exported from the territory of the requesting Contracting Party have been lawfully imported into the territory of the requested Contracting Party.
ANNEX IV
ASSISTANCE, ON REQUEST, RELATING TO SURVEILLANCE
At the request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall, to the extent of its competence and ability, maintain special surveillance for a specified period over:
(a) the movements, particularly the entry into and exit from its territory, of particular persons reasonably believed to be professionally or habitually engaged in Customs offences in the territory of the requesting Contracting Party;
(b) movements of particular goods which are reported by the Customs administration of the requesting Contracting Party as giving rise to important illicit traffic towards of from the territory of that Contracting Party;
(c) particular places where stocks of goods have been built up, giving reason to assume that they are to be used for illicit importation into the territory of the requesting Contracting Party;
(d) particular vehicles, ships, aircraft or other means of transport reasonably believed to be used to commit Customs offences in the territory of the requesting Contracting Party,
and shall communicate a report thereon to the Customs administration of the requesting Contracting Party.
ANNEX V
ENQUIRIES AND NOTIFICATIONS, ON REQUEST, ON BEHALF OF ANOTHER CONTRACTING PARTY
1. At the request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall, subject to the laws and regulations in force in its territory, make enquiries to obtain evidence concerning a Customs offence under investigation in the territory of the requesting Contracting Party, and take statements from any persons sought in connection with that offence or from witnesses or experts, and communicate the results of the enquiry, as well as any documents or other evidence, to the Customs administration of the requesting Contracting Party.
2. At the written request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall, subject to the laws and regulations in force in its territory, notify the persons concerned residing in its territory or have them notified by the competent authorities of any action or decisions taken by the requesting Contracting Party concerning any matter falling within the scope of this Convention.
ANNEX VI
APPEARANCE BY CUSTOMS OFFICIALS BEFORE A COURT OR TRIBUNAL ABROAD
Where it is not sufficient for evidence to be given solely in the form of a written statement, at the request of the Customs administration of a Contracting Party the Customs administration of another Contracting Party, to the extent of its ability shall authorize its officials to appear before a court or tribunal in the territory of the requesting Contracting Party as witnesses or experts in the matter of a Customs offence. The request for appearance shall specify, in particular, in what case and in what capacity the official is to be heard The Customs administration of the Contracting Party accepting the request shall, in authorizing appearance, state any limits with which its officials should comply in giving evidence.
ANNEX VII
PRESENCE OF CUSTOMS OFFICIALS OF ONE CONTRACTING PARTY IN THE TERRITORY OF ANOTHER CONTRACTING PARTY
1. At the written request of the Customs administration of a Contracting Party investigating a specific Customs offence, the Customs administration of another Contracting Party shall, where deemed appropriate, authorize officials specially designated by the requesting Contracting Party to consult, in its offices, the relevant books, registers and other documents or data media held in those offices, take copies thereof, or extract any information or particulars relating to the offence.
2. In the application of the provisions of paragraph 1 above all possible assistance and co-operation shall be afforded to the officials of the requesting Contracting Party to facilitate their investigations.
3. At the written request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall, where deemed appropriate, authorize officials of the requesting administration to be present in the territory of the requested Contracting Party in connection with enquiries into or the official reporting of a Customs offence of concern to the requesting Contracting Party.
ANNEX VIII
PARTICIPATION
IN INVESTIGATIONS ABROAD
Where deemed appropriate by both Contracting Parties, the officials of the Customs administration of a Contracting Party shall, at the request of another Contracting Party, participate in investigations carried out in the territory of that other Contracting Party.
ANNEX IX
POOLING OF INFORMATION
1. The Customs administrations of Contracting Parties shall communicate to the Secretary General of the Council the information specified hereafter insofar as it is of international interest.
2. The Secretary General of the Council shall institute and keep up-to-date a central index of information communicated to him by Contracting Parties and shall use information from it to prepare summaries and studies of new and recurring trends in Customs fraud. He shall periodically review the index to eliminate information which, in his opinion, has outlived its utility or become out-of-date.
3. The Customs administrations of the Contracting Parties shall, upon request by the Secretary General of the Council and subject to the other provisions of the Convention and this Annex, provide the Secretary General with such complementary information as may be necessary to prepare the summaries and studies referred to in paragraph 2 of this Annex.
4. The Secretary General of the Council shall circulate to the services of officials named by the Customs administrations of the Contracting Parties specific information contained in the central index, to the extent that he deems such circulation useful, and any summaries and studies referred to in paragraph 2 of this Annex.
5. The Secretary General of the Council shall, upon request, supply Contracting Parties with any other information available to him under this Annex.
6. The Secretary General of the Council shall honour any restrictions that a Contracting Party having provided information may have placed on its circulation.
7. A Contracting Party having communicated information shall be entitled to require that it be subsequently deleted from the central index and from any registers established by Contracting Parties to which it has been communicated and that no further use be made of it.
Part I: PERSONS
Section
I: SMUGGLING
8. Notifications under this Section shall provide information concerning:
(a) persons finally convicted of smuggling; and
(b) where appropriate, persons suspected of smuggling or apprehended in the act of smuggling in the territory of the Contracting Party making the notification, even though legal proceedings have not been completed,
it being understood that when Contracting Parties refrain from notifying the names and descriptions of the persons involved because such notification is prohibited by their national law, they shall nevertheless make a notification containing as many as possible of the items listed in this Section.
In principle, the information notified shall be limited to offences which have resulted in or could lead to imprisonment or a fine exceeding the equivalent of US$2,000.
9. The information to be furnished shall, so far as possible include the following:
(A)
Natural persons
(a) Surname
(b) Forenames
(c) Maiden name (if applicable)
(d) Nickname or alias
(e) Occupation
(f) Address (present)
(g) Date and place of birth
(h) Citizenship/Nationality
(ij) Country of residence and countries visited during the past 12 months
(k) Type and number of identity papers, including country and date of issue
(l) Physical description
(1) Sex
(2) Height
(3) Weight
(4) Build
(5) Hair
(6) Eyes
(7) Complexion
(8) Distinctive marks or peculiarities
(m) Brief particulars of offence (including particulars of type, quantity and origin of goods, involved in the offence, manufacturer, shipper and consignor) and circumstances which led to its detection
(n) Nature and amount of penalty and/or sentence imposed
(o) Other observations, including languages spoken and (if available) any previous convictions recorded
(p) Contracting Party furnishing the information (including reference number).
(B) Legal persons (firms)
(a) Name
(b) Address
(c) Names of principal officers or employees of the firm against whom legal action has been taken and, if appropriate, identifying data as indicated under Part (A), Items (a) – (1)
(d) Related multinational company
(e) Nature of business carried on
(f) Nature of offence
(g) Particulars of offence (including manufacturer, shipper and consignor) and circumstances which led to its detection
(h) Amount of penalty
(ij) Other observations, including (if available) any previous convictions recorded
(k) Contracting Party furnishing the information (including reference number).
10. As a general rule, the Secretary General of the Council shall circulate information relating to natural persons at least to the countries of citizenship/nationality and residence and to the countries visited by the persons during the past 12 months
Section II: CUSTOMS FRAUD OTHER THAN SMUGGLING
11. Notifications under this Section shall provide information concerning:
(a) persons finally convicted of Customs fraud other than smuggling;
(b) where appropriate, persons suspected of such fraud, even though legal proceedings have not been completed,
it being understood that when Contracting Parties refrain from notifying the names and descriptions of the persons involved because such notification is prohibited by their national law, they shall nevertheless make a notification containing as many as possible of the items listed in this Section.
In principle, the information notified shall be limited to offences which have resulted in or could lead to imprisonment or a fine exceeding the equivalent of US$2,000
12. The information to be furnished shall, so far as possible, include the following:
(a) Name (or firm name) and address
(b) Names and identifying data of principal officers of the firm against which legal action has been taken
(c) Kind of goods
(d) Country of origin
(e) Related multinational company
(f) Name and address of seller
(g) Name and address of shipper
(h) Names and addresses of other parties involved (buying or selling agent, other middlemen, etc.)
(ij) Port(s) or place(s) at which goods were exported
(k) Brief particulars of offence and circumstances which led to its defection
(l) Amount of penalty and loss of revenue, if any
(m) Other observations, including (if available) any previous convictions recorded
(n) Contracting Party furnishing the information (including reference number).
Part II: METHODS OF SMUGGLING AND OTHER FRAUD, INCLUDING FRAUD BY FORGERY, FALSIFICATION AND COUNTERFEITING
13. Notifications under this Part shall provide information relating to methods of smuggling and other fraud, including methods of concealment, fraud by forgery, falsification or counterfeiting, in all cases of significant international interest. Contracting Parties shall report each use of a known method of smuggling and other fraud as well as new, unusual or possible method so that current trends in this field can be detected.
14. The information to be furnished shall so far as possible, include the following:
(a) Decription of methods of smuggling and other fraud, including fraud by forgery, falsification or counterfeiting. If available, the description (make, model, registration number etc.) of any means of transport used. Where applicable, data from the approval plate or certificate of containers or vehicles, the designs of which were approved under an international Convention, and information about any violation of seals, bolts, sealing devices or other parts of containers or vehicles.
(b) Description, if applicable, of the place of concealment, including, where possible, a photograph or sketch
(c) Description of goods concerned
(d) Nature and description of forgery, falsification or counterfeiting; use to which the forged, fasifield or counterfeited documents, Customs seals, registration plates, etc., were put
(e) Other observations, including the circumstances which led to detection
(f) Contracting Party furnishing the information (including reference number).
Part III: VESSELS INVOLVED IN SMUGGLNG
15. Notifications under this Part shall provide information relating to vessels, of all types, that have been involved in smuggling, but should be limited, in principle, to cases which are considered to be of international interest.
16. Insofar as it is available and can be communicated under national law, the information to be furnished shall include the following:
(a) Name and brief identification of vessel (S.S., M.V., tonnage, silhouette, etc.)
(b) Name and address of owner/chartered
(c) Flag
(d) Port of registry and, if different, home port
(e) Name and citizenship/nationality of master (and, if applicable, principal officers)
(f) Nature of the offence, including description of goods seized
(g) Description, if applicable, of the place of concealment (including, where possible, a photograph or sketch) and of the circumstances which led to the discovery
(h) Country of origin of goods seized
(ij) First port of lading
(k) Final port of destination
(l) Ports of call between (ij) and (k)
(m) Other observations (number of cases in which the same vessel, shipping company, charter or other vessel operator had been involved in smuggling, etc.)
(n) Contracting Party furnishing the information (including reference number).
ANNEX X
ASSISTANCE IN ACTION AGAINST THE SMUGGLING OF NARCOTIC DRUGS AND PSYCHOTROPIC SUBSTANCES
1. The provisions of this Annex shall not preclude the application of measures in force at the national level in the matter of co-ordination of the activities of the various authorities competent to take action against the abuse of narcotic drugs and psychotropic substances. They shall also not impede, but complement, the implementation of the provisions of the Single Convention on Narcotic Drugs 1961, and of the 1971 Convention on Psychotropic Substances by Parties to these Conventions which have also accepted this Annex.
2. The provisions of this Annex concerning the smuggling of narcotic drugs and psychotropic substances shall wherever appropriate and to the extent of the competence of the Customs administrations, apply also to the financial operations undertaken in connection with such smuggling.
Exchange of information by Customs administrations on their own initiative
3. The Customs administrations of Contracting Parties shall, on their own initiative and without delay, communicate to other Customs administrations which may be directly concerned, any available information concerning:
(a) operations which are known or suspected to constitute, or which seem likely to give rise to, smuggling of narcotic drugs or psychotropic substances;
(b) persons known to be engaged in or, insofar as information concerning such persons can be communicated under national law, persons suspected of engaging in operations referred to in paragraph (a) above, and vehicles, ships, aircraft and other means of transport used, or suspected of being used, for such operations;
(c) new means or methods used for smuggling narcotic drugs or psychotropic substances;
(d) products which are newly developed or newly used as narcotic drugs or psychotropic substances and which are the subject of smuggling.
Assistance on request, relating to surveillance
4. At the request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall, to the extent of its competence and ability, maintain special surveillance for a specified period over:
(a) the movements, particularly the entry into and exit from its territory, of particular persons reasonably believed to be professionally or habitually engaged in the smuggling of narcotic drugs and psychotropic substances in the territory of the requesting Contracting Party;
(b) movements of narcotic drugs or psychotropic substances which are reported by the Customs administration of the requesting Contracting Party as giving rise to important illicit traffic towards or from the territory of that Contracting Party;
(c) particular places where stocks of narcotic drugs and psychotropic substances have been built up, giving reason to assume that they are to be used for illicit importation into the territory of the requesting Contracting Party;
(d) particular vehicles, ships, aircraft or other means of transport reasonably believed to be used for smuggling narcotic drugs or psychotropic substances into the territory of the requesting Contracting Party.
and shall communicate a report thereon to the Customs administration of the requesting Contracting Party.
Enquiries, on request, on behalf of another Contracting Party
5. At the request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall, subject to the laws and regulations in force in its territory, make enquiries to obtain evidence concerning any smuggling of narcotic drugs or psychotropic substances under investigation in the territory of the requesting Contracting Party, and take statements from any persons sought in connection with that smuggling or from witnesses or experts, and communicate the results of the enquiry, as well as any documents or other evidence, to the Customs administration of the requesting Contracting Party.
Action by Customs officials of one Contracting Party in the territory of another Contracting Party
6. Where it is not sufficient for evidence to be given solely in the form of a written statement, at the request of the Customs administration of a Contracting Party the Customs administration of another Contracting Party, to the extent of its ability, shall authorize its officials to appear before a court or tribunal in the territory of the requesting Contracting Party as witnesses or experts in the matter of smuggling of narcotic drugs or psychotropic substances. The request for appearance shall specify. in particular, in what case and in what capacity the official is to be heard. The Customs administration of the Contracting Party accepting the request shall, in authorizing appearance, state any limits with which its officials should comply in giving evidence.
7. At the written request of the Customs administration of a Contracting Party, the Customs administration of another Contracting Party shall, where deemed appropriate and to the extent of its competence and ability, authorize officials of the requesting administration to be present in the territory of the requested Contracting Party in connection with enquiries into or the official reporting of smuggling of narcotic drugs or psychotropic substances of concern to the requesting Contracting Party.
8. Where deemed appropriate by both Contracting Parties and subject to the laws and regulations in force in their territories, the officials of the Customs administration of a Contracting Party shall, at the request of another Contracting Party, participate in investigations carried out in the territory of that other Contracting Party.
Pooling of information
9. The Customs administrations of Contracting Parties shall communicate to the Sercretary General of the Council, to the extent that such information of international interest, information specified hereafter.
10. The Secretary General of the Council shall institute and keep up-to-date a central index of information communicated to him by Contracting Parties and shall use information from it to prepare summaries and studies of new and recurring trends in the smuggling of narcotic drugs or psychotropic substances. He shall periodically review the index to eliminate information which, in his opinion, has outlived its utility or become out-of-date.
11. The Customs administrations of the Contracting Parties shall, upon request by the Secretary General of the Council and subject to the other provisions of the Convention and this Annex, provide the Secretary General with such complementary information as may be necessary to prepare the summaries and studies referred to in paragraph 10 of this Annex.
12. The Secretary General of the Council shall circulate to the services or officials named by the Customs administrations of the Contracting Parties specific information contained in the central index, to the extent that he deems such circulation useful, and any summaries and studies referred to in paragraph 10 of this Annex.
13. The Secretary General of the Council shall, unless advised to the contrary by the Contracting Party furnishing the information, also circulate to the services or officials named by the other Members of the Council, to the competent bodies of the United Nations and to the International Criminal Police Organization/Interpol and to other international organizations with which arrangements have been made in this respect, any information concerning the smuggling of narcotic drugs and psychotropic substances contained in the central index, to the extent that he deems such circulation useful, and any summaries of studies that he may have prepared on this subject under paragraph 10 of this Annex.
14. The Secretary General of the Council shall, upon request, supply a Contracting Party having accepted this Annex with any other information available to him in connection with the pooling of information provided by this Annex.
Central index, Part I: PERSONS
15. Notifications under this Part of the central index shall provide information concerning:
(a) persons finally convicted of smuggling; and
(b) where appropriate, peersons suspected of smuggling or apprehended in the act of smuggling in the territory of the Contracting Party making the notification, even though legal proceedings have not been completed,
it being understood that when Contracting Parties refrain from notifying the names and descriptions of the persons involved because such notification is prohibited by their national legislation, they shall nevertheless make a notification containing as many as possible of the items listed in this Part of the central index.
16. The information to be furnished shall, so far as possible, include the following:
(a) Surname
(b) Forenames
(c) Maiden name (if applicable)

ANNEX XI
ASSISTANCE IN ACTION AGAINST THE SMUGGLING OF WORKS OF ART, ANTIQUES AND OTHER CULTURAL PROPERTY
1. The provisions of this Annex apply to works of art, antiques and other »cultural property« which, on religious or secular grounds, is held to be of importance for archaeology, prehistory, history, literature, art or science, within the meaning of paragraphs (a)-(k) of Article I of the UNESCO Convention on the means of prohibiting and preventing the illicit import, export and transfer of ownership of cultural property (Paris, 14 November 1970), insofar as such works of art, antiques and other cultural property are subject of smuggling. They do not preclude the application of national measures of co-operation with national services for the protection of the cultural heritage and, in the Customs field, they supplement the implementation of the provisions of the UNESCO Convention by Contracting Parties to that Convention which have also accepted this Annex.
2. The provisions of this Annex concerning the smuggling of works of art, antiques and other cultural property shall, wherever appropriate and to the extent of the competence of the Customs administrations, apply also to the financial operations undertaken in connection with such smuggling.

PREAMBULA
UGOVORNE STRANKE ove Konvencije, sačinjene pod pokroviteljstvom Vijeća za carinsku suradnju,
Smatrajući da su prekršaji carinskog zakona štetni za gospodarske, socijalne i fiskalne interese država i za zakonite interese trgovine,
Smatrajući da se djelovanje protiv carinskih prekršaja može učiniti djelotvornijim putem suradnje između carinskih uprava, i da je takva suradnja jedan od ciljeva Konvencije kojom se uspostavlja Vijeće za carinsku suradnju,
Dogovorile su sljedeće:
Poglavlje I
Definicije
Članak 1.
U svrhu ove Konvencije:
(a) izraz »carinski zakon« znači sve zakonske ili regulatorne odredbe koje carinske uprave provode ili izvršavaju u vezi uvoza, izvoza ili provoza roba;
(b) izraz »carinski prekršaj« znači svako kršenje ili pokušaj kršenja carisnkog zakona;
(c) izraz »carinska prijevara« znači carinski prekršaj kojim osoba vara carinu i tako izbjegava, u cijelosti ili djelomično, plaćanje uvoznih i izvoznih pristojbi i taksi ili primjenu zabrana ili ograničenja određenih carinskim zakonom ili dobiva bilo kakvu olakšicu protivno carinskom zakonu;
(d) izraz »krijumčarenje« znači carinsku prijevaru koja se sastoji u potajnom kretanju roba preko carinske granice;
(e) izraz »uvozne ili izvozne pristojbe i takse« znači carinske pristojbe i sve ostale pristojbe, takse, dadžbine ili druga davanja koja se naplaćuju na uvoz ili izvoz roba ili u vezi s uvozom ili izvozom roba s time da to ne uključuje dadžbine i davanja koji su ograničeni u iznosu na približan trošak pruženih usluga;
(f) izraz »osoba« znači i fizičke i pravne osobe, osim ako kontekst ne nalaže drugačije;
(g) izraz »Vijeće« znači organizaciju utemeljenu Konvencijom za uspostavljanje Vijeća za carinsku suradnju, sastavljenom u Bruxellesu 15. prosinca 1950;
(h) izraz »Stalni tehnički odbor« znači Stalni tehnički odbor Vijeća;
(i) izraz »ratifikacija« znači ratifikaciju, prihvaćanje ili odobrenje.
Poglavlje II
Polje
primjene Konvencije
Članak 2.
1. Ugovorne stranke Konvencije vezane jednim ili više priloga Konvencije suglasne su da se njihove carinske uprave međusobno pomažu u cilju sprječavanja, istraživanja i suzbijanja carinskih prekršaja, u skladu sa odredbama ove Konvencije.
2. Carinska uprava ugovorne stranke može zatražiti uzajamnu pomoć predviđenu stavkom 1. ovog članka tijekom bilo koje istrage ili u vezi bilo kojeg sudskog ili upravnog postpuka kojeg je dotična ugovorna stranka pokrenula. Ukoliko carinska uprava ne vodi postupak sama, može zatražiti uzajamnu pomoć samo u granicama svoje nadležnosti u tom postupku. Isto tako, ako se postupak pokreće u zemlji uprave čija se pomoć traži, ova potonja pruža zatraženu pomoć u granicama svoje nadležnosti u dotičnom postupku.
3. Uzajamna pomoć sukladno stavku 1. ovog članka ne proteže se na zahtjeve za uhićenje osoba niti za naplatu pristojbi, taksi, davanja, kazni ili bilo kojih drugih novčanih iznosa u korist neke druge ugovorne stranke Konvencije.
Članak 3.
Ako neka ugovorna stranka smatra da bi zatražena pomoć narušavala njezin suverenitet, sigurnost ili druge bitne nacionalne interese ili bila štetna za legitimne komercijalne interese bilo kojeg poduzeća, javnog ili privatnog, ona može odbiti pružanje takve pomoći ili istu pružiti uz određene uvjete ili zahtjeve.
Članak 4.
Ako carinska uprava neke ugovorne stranke zatraži pomoć koju sama ne bi mogla dati da to od nje zatraži druga ugovorna stranka, ona će na tu činjenicu upozoriti u svom zahtjevu. Postupanje po takvom zahtjevu ostaje na volju ugovorne stranke zatražene za pomoć.
Poglavlje III
OpĆi postupci pomoĆi
Članak 5.
1. Sve obavijesti, dokumenti ili druge informacije dostavljeni ili dobiveni po ovoj Konvenciji:
(a) koristit će se isključivo u svrhe navedene u ovoj Konvenciji, uključujući uporabu u sudskom ili upravnom postupku i ovisno o onim ograničenjima koje eventualno odredi carinska uprava koja je iste dala; i
(b) uživat će u zemlji koja ih prima istu zaštitu u pogledu povjerljivosti i službene tajne kakva se primjenjuje u toj zemlji za istu vrstu obavijesti, dokumenata i ostalih informacija dobivenih na njezinom području.
2. Takve obavijesti, dokumenti i ostale informacije smiju se koristiti u druge svrhe isključivo uz pismenu suglasnost carinske uprave koja ih je dala, te podložno svim ograničenjima koje je ta uprava odredila kao i odredbama stavka 1. (b) ovog članka.
Članak 6.
1. Komunikacije između ugovornih stranaka predviđene ovom Konvencijom odvijat će se direktno između carinskih uprava. Carinske uprave ugovornih stranaka odredit će službe ili službenike odgovorne za te komunikacije i javit će glavnom tajniku Vijeća imena i adrese tih službi ili službenika. Glavni tajnik će proslijediti te informacije ostalim ugovornim strankama.
2. Carinska uprava ugovorne stranke zatražene za pomoć poduzet će, ovisno o zakonima i propisima koji su na snazi na njenom području, sve potrebne mjere za postupanje prema zahtjevu za pomoć.
3. Carinska uprava ugovorne stranke zatražene za pomoć odgovorit će na zahtjev za pomoć čim prije bude moguće.
Članak 7.
1. Zahtjevi za pomoć po ovoj Konvenciji normalno se daju pismenim putem; oni će sadržavati potrebne informacije i biti popraćeni dokumentima koji se eventualno smatraju korisnima.
2. Pismeni zahtjevi bit će na jeziku prihvatljivom za dotične ugovorne stranke. Svi popratni dokumenti uz te zahtjeve bit će prevedeni, ako je potrebno, na obostrano prihvatljiv jezik.
3. Ugovorne stranke će u svim slučajevima prihvatiti zahtjeve za pomoć i popratne dokumente na engleskom ili francuskom jeziku popraćene prijevodom na engleski ili francuski jezik.
4. Kada, posebice iz razloga žurnosti, zahtjevi za pomć nisu dani u pismenom obliku, ugovorna stranka zatražena za pomoć može tražiti pismenu potvrdu istog.
Članak 8.
Sve troškove nastale po ovoj Konvenciji u pogledu stručnjaka ili svjedoka snosi ugovorna stranka koja traži pomoć. Ugovorne stranke odriču se svih potraživanja za povrat bilo kojih drugih davanja nastalih prilikom izvršenja ove Konvencije.
Poglavlje IV
MjeŠovite
odredbe
Članak 9.
Vijeće i carinske uprave ugovornih stranaka uredit će da službe odgovorne za sprječavanje, istragu i suzbijanje carinskih prekršaja održavaju osobne i direktne odnose u cilju unapređenja općih ciljeva Konvencije.
Članak 10.
U svrhu ove Konvencije, svaki prilog ili prilozi za koje je neka ugovorna stranka u obvezi tumačit će se kao sastavni dio Konvencije, a u odnosu na tu ugovornu stranku svako pozivanje na Konvenciju smatrat će se da uključuje i pozivanje na dotični Prilog ili Priloge.
Članak 11.
Odredbe ove Konvencije ne isključuju primjenu bilo kakve šire uzajamne pomoći koju neke ugovorne stranke pružaju ili mogu pružiti u budućnosti.
Poglavlje V
Uloga
VijeĆa i Stalnog tehniČkog odbora
Članak 12.
1. Vijeće je, sukladno odredbama ove Konvencije, odgovorno za upravljanje i razvoj ove Konvencije.
2. U tu svrhu Stalni će tehnički odbor, po ovlaštenju Vijeća i u skladu s direktivama Vijeća, imati sljedeće funkcije:
(a) dostavljati Vijeću prijedloge za one izmjene ove Konvencije koje eventualno smatra potrebnima;
(b) davati mišljenja o tumačenju odredaba Konvencije;
(c) održavati odnose s ostalim zainteresiranim organizacijama, a posebice, s nadležnim tijelima Ujedinjenih naroda, sa UNESCO-om i s Međunarodnom organizacijom kriminalističke policije/Interpolom, u pogledu djelovanja protiv nezakonite trgovine drogama i psihotropnim tvarima, te djelovanja protiv nezakonite trgovine umjetničkim djelima, antikvitetima i ostalim kulturnim dobrima;
(d) poduzimati svaku akciju koja može unaprijediti opće ciljeve Konvencije, a posebice proučavati nove metode i postupke za lakše sprječavanje, istraživanje i suzbijanje carinskih prekršaja, sazivati sastanke, itd.;
(e) obavljati one zadaće koje Vijeće može naložiti u odnosu na odredbe Konvencije.
Članak 13.
U svrhu glasovanja u Vijeću i u Stalnom tehničkom odboru svaki se Prilog smatra zasebnom Konvencijom.
Poglavlje VI
ZavrŠne
odredbe
Članak 14.
Svaki spor između dviju ili više ugovornih stranaka u vezi tumačenja ili primjene ove Konvencije riješit će se njihovim međusobnim pregovorima.
Članak 15.
1. Svaka država članica Vijeća i svaka država članica Organizacije Ujedinjenih naroda ili njenih specijaliziranih ustanova može postati stranka potpisnica ove Konvencije:
(a) potpisivanjem Konvencije bez rezerve ratifikacije;
(b) deponiranjem isprave o ratifikaciji nakon potpisivanja Konvencije pod uvjetom ratifikacije;
(c) ili pristupanjem Konvenciji.
2. Ova Konvencija će biti otvorena za potpisivanje državama iz stavka 1. ovog članka do 30. lipnja 1978. u sjedištu Vijeća u Bruxellesu. Nakon toga, bit će otvorena za njihovo pristupanje.
3. Svaka će država iz stavka 1. ovog članka prilikom potpisivanja, ratificiranja ili pristupanja Konvenciji navesti Prilog ili Priloge koje prihvaća, s time da treba prihvatiti najmanje jedan Prilog. Ona može glavnog tajnika Vijeća naknadno obavijestiti da prihvaća jedan ili više Priloga.
4. Isprava o ratifikaciji ili pristupanju deponira se kod glavnog tajnika Vijeća.
5. Carinske ili gospodarske unije mogu, zajedno sa svim svojim zemljama članicama ili u bilo koje vrijeme nakon što njihove zemlje članice postanu ugovorne stranke ove Konvencije, također postati ugovorne stranke ove Konvencije u skladu s odredbama stavaka 1., 2. i 3. ovog članka. Međutim, takve unije nemaju pravo glasa.
Članak 16.
1. Ova Konvencija stupa na snagu tri mjeseca nakon što pet država iz stavka 1. članka 15. iste potpiše Konvenciju bez rezerve ratifikacije ili deponira svoje isprave o ratifikaciji ili pristupanju.
2. Za bilo koju ugovornu stranku koja potpiše bez rezerve ratifikacije, ratificira ili pristupi ovoj Konvenciji nakon što ju je pet država potpisalo bez rezerve ratifikacije ili je deponiralo svoje isprave o ratifikaciji ili pristupanju, ova Konvencija stupa na snagu tri mjeseca nakon što je dotična stranka potpisnica potpisala bez rezerve ratifikacije ili deponirala ispravu o ratifikaciji ili pristupanju.
3. Svaki Prilog ove Konvencije stupa na snagu tri mjeseca nakon što dvije države prihvate taj Prilog. Za bilo koju ugovornu stranku koja naknadno prihvati neki Prilog nakon što su ga prihvatile dvije države, taj Prilog stupa na snagu tri mjeseca nakon što je dotična stranka potpisnica obavijestila o svom prihvaćanju. Međutim, nijedan Prilog neće stupiti na snagu za neku ugovornu stranku prije nego što Konvencija stupi na snagu za tu ugovornu stranku.
Članak 17.
1. Bilo koja država može, u vrijeme potpisivanja ove Konvencije bez rezerve ratifikacije ili u vrijeme deponiranja isprave o ratifikaciji ili pristupanju, ili u bilo koje vrijeme nakon toga, izjaviti putem obavijesti dane glavnom tajniku Vijeća da se ova Konvencija proteže na sva ili na neka od područja za čije je međunarodne odnose ona odgovorna. Ta obavijest postaje važeća tri mjeseca nakon datuma primitka iste od strane glavnog tajnika Vijeća. Međutim, Konvencija se ne primjenjuje na područja navedena u obavijesti prije nego što Konvencija stupi na snagu za dotičnu državu.
2. Svaka država koja dostavi obavijest prema stavku 1. ovog članka o protezanju ove Konvencije na neko područje za čije je međunarodne odnose ona odgovorna, može obavijestiti glavnog tajnika Vijeća, po postupku iz članka 19. ove Konvencije, da dotično područje više neće primjenjivati Konvenciju.
Članak 18.
Smatrat će se da je svaka ugovorna stranka pristupila ili prihvatila sve odredbe Konvencije ili Priloga, osim ako u vrijeme pristupanja Konvenciji ili odvojenog prihvaćanja nekog Priloga ili u bilo koje vrijeme nakon toga, ne obavijesti glavnog tajnika Vijeća o bilo kakvim rezervama u pogledu odredaba sa kojima se ne može suglasiti. Svaka ugovorna stranka se obvezuje da će periodično preispitivati odredbe u pogledu kojih je stavila rezerve i da će glavnog tajnika Vijeća obavijestiti u slučaju povlačenja rezervi.
Članak 19.
1. Ova Konvencija je neograničenog trajanja, ali je svaka ugovorna stranka može otkazati u bilo koje vrijeme nakon njezinog stupanja na snagu po članku 16. Konvencije.
2. O otkazu se obavještava ispravom u pisanom obliku, koju se deponira kod glavnog tajnika Vijeća.
3. Otkaz stupa na snagu šest mjeseci nakon što glavni tajnik Vijeća primi ispravu o otkazu.
4. Odredbe iz stavka 2 i 3 ovog članka primjenjuju se također u pogledu svih Priloga ove Konvencije, s time što svaka ugovorna stranka ima pravo u bilo koje vrijeme nakon datuma njihovog stupanja na snagu po članku 16. Konvencije, povući svoje prihvaćanje jednog i više Priloga. Svaka ugovorna stranka koja povuče prihvaćanje svih Priloga smatrat će se da je otkazala Konvenciju.
5. Svaka ugovorna stranka koja otkaže Konvenciju ili povuče svoje prihvaćanje jednog ili više Priloga ostaje u obvezi po odredbama članka 5. ove Konvencije tako dugo dok je u posjedu bilo kakvih obavijesti, dokumenata ili drugih informacija dobivenih po Konvenciji.
Članak 20.
1. Vijeće može preporučiti izmjene na ovu Konvenciju.
2. Test svake tako preporučene izmjene dostavlja se glavnom tajniku Vijeća, svim ugovornim strankama ove Konvencije, ostalim državama potpisnicama i onim državama članicama Vijeća koje nisu ugovorne stranke ove Konvencije.
3. Svaka predložena izmjena dostavljena sukladno odredbama prethodnog stavka stupa na snagu u odnosu na sve ugovorne stranke tri mjeseca nakon isteka perioda od dvije godine od datuma dostave predložene izmjene tijekom kojeg perioda nijedna država koja je ugovorna stranka nije dostavila glavnom tajniku Vijeća nikakvu primjedbu na predloženu izmjenu.
4. Ukoliko neka država koja je ugovorna stranka dostavi glavnom tajniku Vijeća neku primjedbu na predloženu izmjenu prije isteka dvogodišnjeg perioda iz stavka 3. ovog članka, smatrat će se da izmjena nije prihvaćena i ista uopće neće stupiti na snagu.
Članak 21.
1. Smatrat će se da svaka ugovorna strana koja ratificira ovu Konvenciju ili pristupa istoj prihvaća sve izmjene Konvencije koji su stupili na snagu u vrijeme deponiranja njezine isprave o ratifikaciji ili pristupanju.
2. Smatrat će se da je ugovorna stranka koja prihvaća neki Prilog prihvatila i sve izmjene tog Priloga koji su stupili na snagu u vrijeme kada dotična ugovorna stranka obavijesti glavnog tajnika Vijeća o svom prihvaćanju.
Članak 22.
Glavni tajnik Vijeća obavijestit će ugovorne stranke ove Konvencije, ostale države potpisnice, one države članice Vijeća koje nisu ugovorne stranke ove Konvencije te glavnog tajnika Ujedinjenih naroda o:
(a) potpisivanjima, ratifikacijama, pristupanjima i obavijestima po članku 15. ove Konvencije;
(b) datumu stupanja na snagu ove Konvencije i svakog Priloga u skladu sa člankom 16;
(c) obavijesti primljenoj u skladu sa člankom 17;
(d) otkazu po članku 19;
(e) svaka izmjena za koju se smatra da je prihvaćena sukladno članku 20. kao i o datumu stupanja na snagu istog.
Članak 23.
Nakon njezinog stupanja na snagu ova će Konvencija biti registrirana u Tajništvu Ujedinjenih naroda, u skladu sa Člankom 102. Povelje Ujedinjenih naroda.
U potvrdu naprijed narečenog niže potpisani, za to propisno ovlašteni, potpisali su ovu Konvenciju.
Sačinjeno u Nairobiu na današnji deveti dan mjeseca lipnja tisuću devetsto sedamdesetsedme godine na engleskom i francuskom jeziku, pri čemu su oba teksta jednako vjerodostojna, u jednom izvorniku koji se polaže kod glavnog tajnika Vijeća koji će dostaviti ovjerene prijepise svim državama iz stavka 1. članka 15. ove Konvencije.
PRILOG I
POMOĆ CARINSKE
UPRAVE NA VLASTITU INICIJATIVU
1. Carinska uprava neke ugovorne stranke dostavit će, na vlastitu inicijativu, carinskoj upravi ugovorne stranke koje se to tiče, sve važne informacije do kojih je došla tijekom svojih normalnih aktivnosti, a koje daju dobar razlog za vjerovanje da će na području te druge ugovorne stranke biti izvršen ozbiljan carinski prekršaj. Informacije koje treba dostaviti odnose se, posebice, na kretanje osoba, stvari i prijevoznih sredstava.
2. Carinska uprava jedne ugovorne stranke će, kada to smatra primjerenim, dostaviti na vlastitu inicijativu carinskoj upravi druge ugovorne stranke dokumente, izvještaje, evidencijske dokumente ili potvrđene kopije istih kojima potkrepljuje informacije dostavljene po stavku 1.
3. Carinska uprava jedne ugovorne stranke dostavit će, na vlastitu inicijativu, carinskoj upravi druge ugovorne stranke koje se to direktno tiče, svaku informaciju koja bi toj strani potpisnici mogla biti od bitne pomoći u vezi sa carinskim prekršajima i, posebice, u vezi s novim načinima i metodama za izvršenje tih prekršaja.
PRILOG II
POMOĆ, NA ZAHTJEV,
U ODREĐIVANJU UVOZNIH ILI IZVOZNIH PRISTOJBI I POREZA
1. Na zahtjev carinske uprave neke ugovorne stranke koja ima dobar razlog za vjerovanje da je u njezinoj zemlji počinjen ozbiljan carinski prekršaj, carinska uprava ugovorne stranke zatražene za pomoć dostavit će sve raspoložive informacije koje mogu pomoći da se osigura pravilno određivanje uvoznih ili izvoznih pristojbi i poreza.
2. Smatrat će se da je neka ugovorna stranka ispunila svoje obveze u tom pogledu ako, primjerice, u odgovoru na zahtjev dostavi na primjereni način sljedeće informacije ili dokumente s kojima raspolaže:
(a) u pogledu vrijednosti robe u svrhu carinjenja: komercijalne fakture predočene carini zemlje izvoza ili uvoza ili kopije tih faktura, ovjerene ili neovjerene po carini, već prema potrebi u datim okolnostima; dokumentaciju koja pokazuje sadašnje izvozne ili uvozne cijene; kopiju izjave o vrijednosti date za izvoz ili uvoz robe; trgovačke kataloge, cjenike, itd. objavljene u zemlji izvoza ili u zemlji uvoza;
(b) u pogledu razvrstavanja robe u carinsku tarifu: analize koje su laboratorijske službe napravile kako bi se utvrdilo razvrstavanje robe u carinsku tarifu; tarifni naziv deklariran prilikom uvoza ili izvoza;
(c) u pogledu podrijetla robe; deklaraciju o podrijetlu prilikom izvoza, kada se takva deklaracija traži; carinski status robe u zemlji izvoza (provoz, carinsko skladište, privremeni uvoz, slobodna zona, slobodan promet, izvezeno uz povrat carine, itd.).
PRILOG III
POMOĆ, NA ZAHTJEV, U VEZI KONTROLA
Na zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke dostavit će toj carinskoj upravi informacije u vezi slijedećih stvari:
(a) vjerodostojnost službenih dokumenata priloženih uz deklaraciju za robu podnešenu carinskim organima ugovorne stranke koja traži pomoć;
(b) da li je roba koja je uvezena na područje ugovorne stranke koja traži pomoć zakonito izvezena sa područja druge ugovorne stranke;
(c) da li je roba koja je izvezena sa područja ugovorne stranke koja traži pomoć zakonito uvezena na području ugovorne stranke zatražene za pomoć.
PRILOG IV
POMOĆ, NA ZAHTJEV,
U VEZI NADZORA
Na zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke će, u granicama svojih nadležnosti i mogućnosti, vršiti posebni nadzor kroz određeni period nad:
(a) kretanjima, posebice nad ulaskom na njezino područje i izlaskom sa njezinog područja, određenih osoba za koje se s razlogom vjeruje da su profesionalno ili uobičajeno uključeni u carinske prekršaje na području ugovorne stranke koja traži pomoć;
(b) kretanjima određenih roba za koje je carinska uprava ugovorne stranke koja traži pomoć izvijestila da dovode do značajne nezakonite trgovine prema području ili sa područja te ugovorne stranke;
(c) posebnim mjestima gdje se stvaraju zalihe roba, što opravdano navodi na pretpostavku da se iste koriste za nezakoniti uvoz na područje ugovorne stranke koja traži pomoć;
(d) određenim vozilima, brodovima, letjelicama ili drugim prijevoznim sredstvima za koja se s razlogom vjeruje da se koriste za vršenje carinskih prekršaja na području ugovorne stranke koja traži pomoć,
i o tome će dostaviti izvješće carinskoj upravi ugovorne stranke koja traži pomoć.
PRILOG V
ISTRAGE I
OBAVIJESTI, NA ZAHTJEV, U KORIST DRUGE UGOVORNE STRANKE
1. Na zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke će, ovisno o zakonima i propisima na snazi na njezinom području, izvršiti istrage radi pribavljanja dokaza u vezi carinskog prekršaja koji se istražuje na području ugovorne stranke koja traži pomoć, i uzet će izjave od svih traženih osoba u vezi s tim prekršajem ili od svjedoka ili vještaka, a rezultate istrage, kao i sve dokumente ili drugi dokazni materijal, dostavit će carinskoj upravi ugovorne stranke koja traži pomoć.
2. Na pismeni zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke će, ovisno o zakonima i propisima na snazi na njezinom području, obavijestiti odgovarajuće osobe koje borave na njezinom području ili će dati da ih obavijeste nadležni organi o svakom postupku kojeg je pokrenula ili o odlukama koje je donijela stranka potpisnica koja traži pomoć u vezi predmeta koji spada u područje ove Konvencije.
PRILOG VI
POJAVLJIVANJE
CARINIKA PRED SUDOM ILI SUDSKIM VIJEĆEM U INOZEMSTVU
U slučajevima kada nije dovoljno da dokaz bude dat isključivo u obliku pismene izjave, na zahtjev carinske uprave jedne ugovorne stranke carinska uprava druge ugovorne stranke će, u onoj mjeri u kojoj je to moguće, dopustiti svojim službenicima da se pojave pred sudom ili sudskim vijećem na području ugovorne stranke koja traži pomoć kao svjedoci ili vještaci u predmetu carinskog prekršaja. U zahtjevu za pojavljivanje treba navesti, posebice, u kojem slučaju i u kojem svojstvu službenika treba saslušati. Carinska uprava ugovorne stranke koja prihvaća zahtjev navesti će, kada daje dopuštenje za pojavljivanje, sva ograničenja kojih se njezini službenici trebaju pridržavati prilikom saslušanja.
PRILOG VII
PRISUSTVO CARINIKA
JEDNE UGOVORNE STRANKE NA PODRUČJU DRUGE UGOVORNE STRANKE
1. Na pismeni zahtjev carinske uprave jedne ugovorne stranke koja istražuje neki specifični carinski prekršaj, carinska uprava druge ugovorne stranke dopustit će, kada to smatra primjerenim, stručnjacima koje stranka potpisnica koja traži pomoć posebno navede da pregledaju, u njezinim uredima, relevantne knjige, registre i ostale dokumente ili nosioce podataka koji se drže u tim uredima, da naprave kopije istih, ili da izvade sve informacije ili podatke koji se odnose na prekršaj.
2. Prilikom primjene odredaba iz stavka 1. u gornjem tekstu stručnjacima ugovorne stranke koja traži pomoć bit će pružena sva moguća pomoć i suradnja kako bi im se olakšala istraga.
3. Na pismeni zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke će, kada to smatra primjerenim, dopustiti službenicima uprave koja traži pomoć da budu prisutni na području ugovorne stranke zamoljene za pomoć u vezi sa istragom carinskog prekršaja ili službenog izvještavanja o carinskom prekršaju koji se tiče ugovorne stranke koja traži pomoć.
PRILOG VIII
SUDJELOVANJE U
ISTRAGAMA U INOZEMSTVU
U slučaju kada obje ugovorne stranke to smatraju primjerenim, službenici carinske uprave jedne ugovorne stranke će, na zahtjev druge ugovorne stranke, sudjelovati u istragama koje se vrše na području te druge ugovorne stranke.
PRILOG IX
OBJEDINJAVANJE
INFORMACIJA
1. Carinske uprave ugovornih stranaka dostavit će glavnom tajniku Vijeća niže navedene informacije ukoliko su iste od međunarodnog interesa.
2. Glavni tajnik Vijeća ustanovit će i voditi ažurno jedan centralni indeks informacija koje mu dostavljaju ugovorne stranke i koristit će informacije iz istog za izradu sažetaka i studija o novim trendovima kao i trendovima koji se ponavljaju na području carinske prijevare. Povremeno će revidirati taj indeks kako bi uklonio informacije koje više nisu korisne ili su zastarjele.
3. Carinske uprave ugovornih stranaka će, na zahtjev glavnog tajnika Vijeća te ovisno o ostalim odredbama Konvencije i ovog Priloga, dostavljati glavnom tajniku one dodatne informacije koje mu mogu trebati za izradu sažetaka i studija iz stavka 2 ovog Priloga.
4. Glavni tajnik Vijeća dostavljat će službama ili službenicima koje imenuju carinske uprave ugovornih stranka određene informacije sadržane u centralnom indeksu, u onoj mjeri u kojoj takvu dostavu smatra korisnom, te bilo koje sažetke i studije iz stavka 2 ovog Priloga.
5. Glavni tajnik Vijeća će, na zahtjev, dostavljati ugovornim strankama sve ostale informacije koje su mu na raspolaganju po ovom Prilogu.
6. Glavni tajnik Vijeća poštivati će sva ograničenja koja neka ugovorna stranka koja daje informacije eventualno postavi u vezi s njihovim širenjem.
7. Ugovorna stranka koja je dala informacije ima pravo tražiti da se te informacije naknadno brišu iz centralnog indeksa i iz svih registara uspostavljenih po ugovornim strankama kojima su te informacije priopćene, i da se više ne koriste.
Dio I: OSOBE
Odlomak I: KRIJUMČARENJE
8. Obavijesti po ovom odlomku sadržavat će informacije u vezi:
(a) osoba koje su konačno osuđene za krijumčarenje; i
(b) kada je primjereno, osoba za koje se sumnja da krijumčare ili koje su uhvaćene na djelu krijumčarenja na području ugovorne stranke koja daje obavijest, iako sudski postupak još nije završen, s time što se podrazumijeva da će, u slučaju kada se ugovorne stranke uzdržavaju od davanja imena i opisa dotičnih osoba jer je davanje takvih obavijesti zabranjeno njihovim nacionalnim zakonom, one ipak dati obavijest sa što je moguće više stavaka iz ovog odlomka.
U principu, informacije koje se dostavljaju ograničene su na prekršaje koji su doveli ili bi mogli dovesti do kazne zatvora ili do novčane kazne veće od iznosa koji odgovara iznosu od 2,000 USD.
9. Informacije koje treba dati sadržavat će, u najvećoj mogućoj mjeri, slijedeće podatke:

10. Kao opće pravilo, Glavni tajnik Vijeća dostavlja informacije o fizičkim osobama barem zemljama čije su one državljani i u kojima imaju mjesto boravka te zemljama koje je dotična osoba posjetila tijekom posljednjih 12 mjeseci.
Odlomak II: DRUGE CARINSKE PRIJEVARE OSIM KRIJUMČARENJA
11. Obavijesti po ovom Odlomku sadržavat će informacije u vezi:
(a) osoba koje su na konačno osuđene za drugu carinsku prijevaru, a ne krijumčarenje; i
(b) kada je primjereno, osoba na koje se sumnja za takvu prijevaru, iako sudski postupak još nije završen,
s time što se podrazumijeva da će, u slučaju kada se ugovorne stranke uzdržavaju od davanja imena i opisa dotičnih osoba jer je davanje takvih obavijesti zabranjeno njihovim nacionalnim zakonom, one ipak dati obavijest sa što je moguće više stavaka iz ovog odlomka.
U principu, informacije koje se dostavljaju ograničene su na prekršaje koje su doveli ili bi mogli dovesti do kazne zatvora ili do novčane kazne veće od iznosa koji odgovara iznosu od 2,000 USD.
12. Informacije koje treba dati sadržavat će, u najvećoj mogućoj mjeri, slijedeće podatke:
(a) Ime (ili naziv tvrtke) i adresu
(b) Imena i identifikacijske podatke glavnih službenika tvrtke protiv koje je pokrenut sudski postupak
(c) Vrstu robe
(d) Zemlju porijekla
(e) Srodnu multinacionalnu kompaniju
(f) Ime i adresu prodavatelja
(g) Ime i adresu prijevoznika
(h) Imena i adrese ostalih uključenih strana (zastupnik pri kupnji ili prodaji, ostali posrednici, itd.)
(ij) Luku (luke) ili mjesto (mjesta) kuda je roba izvezena
(k) Kratke podatke o prekršaju i o okolnostima koje su dovele do njegovog otkrivanja
(l) Visinu kazne i eventualni gubitak prihoda
(m) Ostale napomene, uključujući sve evidentirane ranije osude (ukoliko postoje)

Dio II: NAČINI KRIJUMČARENJA I OSTALIH PRIJEVARA, UKLJUČUJUĆI PRIJEVARU KRIVOTVORENJEM, FALSIFICIRANJEM I PREŠTAMPAVANJEM
13. Obavijesti po ovom Dijelu daju informacije u vezi načina krijumčarenja i drugih prijevara, uključujući načine sakrivanja, prijevaru putem krivotvorenja, falsificiranja i preštampavanja, u svim slučajevima od većeg međunarodnog interesa. Ugovorne stranke javit će svaku primjenu neke poznate metode krijumčarenja i druge prijevare kao i novu, neuobičajenu ili moguću metodu tako da se mogu otkriti aktualni trendovi na tom području.
14. Informacije koje se dostavljaju sadržavat će, u najvećoj mogućoj mjeri, slijedeće:
(a) Opis metoda krijumčarenja i druge prijevare, uključujući prijevaru krivotvorenjem, falsificiranjem ili preštampavanjem. Opis, ukoliko se njime raspolaže korištenog prijevoznog sredstva (proizvod, model, registracijski broj itd.). Kada je primjereno, podatke sa ploče ili potvrde o odobrenju za kontejnere ili vozila, čiji su modeli odobreni po nekoj međunarodnoj konvenciji i informacije o svakom prekršaju u vezi pečata, zasuna, naprava za pečaćenje ili drugih dijelova kontejnera ili vozila
(b) Opis, kada je takav slučaj, mjesta sakrivanja, uključujući po mogućnosti fotografiju ili skicu
(c) Opis dotične robe
(d) Vrstu i opis krivotvorenja, falsificiranja ili preštampavanja; u koju su svrhu korišteni krivotvoreni, falsificirani ili preštampani dokumenti, carinski pečati, registracijske pločice, itd.
(e) Ostale napomene, uključujući okolnosti koje su dovele do otkrivanja
(f) Ugovornu stranku koja dostavlja informacije (uključujući referentni broj).
Dio III: BRODOVI UMIJEŠANI U KRIJUMČARENJE
15. Obavijesti koje se dostavljaju u skladu s ovim Dijelom sadrže informacije u vezi brodova, sviju vrsta, umiješanih u krijumčarenje, s time da iste trebaju biti ograničene, u principu, na slučajeve koji se smatraju od međunarodnog interesa.
16. Informacije koje treba dati, ukoliko se njima raspolaže i ukoliko se smiju priopćiti po nacionalnom zakonu, sadržavat će slijedeće:
(a) Ime i kratku identifikaciju broda (parobrod, motorni brod, tonaža, oblik, itd.)
(b) Ime i adresu vlasnika/brodara
(c) Zastavu pod kojom plovi
(d) Luku upisa broda i, ukoliko je različita, matičnu luku
(e) Ime i državljanstvo/nacionalnost zapovjednika broda (i, ako je takav slučaj, prvih časnika)
(f) Vrstu prekršaja, uključujući opis zaplijenjene robe
(g) Opis mjesta sakrivanja, ukoliko je takav slučaj (sa, po mogućnosti, fotografijom ili skicom), te okolnosti koje su dovele do otkrivanja
(h) Zemlju porijekla zaplijenjene robe
(ij) Prvu luku ukrcaja
(k) Zadnju luku odredišta
(l) Luke pristajanja između (ij) i (k)
(m) Ostale napomene (broj slučajeva u kojima su isti brod, međunarodno otpremništvo, ugovaratelj pomorskih prijevoza ili druga osoba koja radi na poslovima zaključivanja pomorskih prijevoznih ugovora bili umiješani u krijumčarenje, itd.)
(n) Ugovornu stranku koja daje informacije (uključujući referentni broj).
PRILOG X
POMOĆ U AKCIJI PROTIV KRIJUMČARENJA DROGA I PSIHOTROPNIH TVARI
1. Odredbe ovog Priloga nisu na uštrb primjene mjera važećih na nacionalnoj razini po pitanju suradnje u djelovanju raznih tijela vlasti nadležnih za poduzimanje akcije protiv zlouporabe droga i psihotropnih tvari. Iste također ne samo da neće spriječavati već će upotpunjavati provedbu odredaba Jedinstvene konvencije o drogama iz 1961. i Konvencije o psihotropnim tvarima iz 1971. godine po stranama iz tih Konvencija koje su istovremeno prihvatile i ovaj Prilog.
2. Odredbe ovog Priloga u vezi krijumčarenja droga i psihotropnih tvari primjenjuju se, također, u slučajevima kada je to primjereno i u onoj mjeri u kojoj je to u nadležnosti carinskih uprava, i na financijske operacije poduzete u vezi s takvim krijumčarenjem.
Razmjena informacija od strane carinskih uprava na vlastitu inicijativu
3. Carinske uprave stranaka potpisnica će, na vlastitu inicijativu i bez odlaganja, javiti drugim carinskim upravama kojih se to možda direktno tiče, sve raspoložive informacije o:
(a) operacijama za koje se zna ili sumnja da predstavljaju krijumčarenje ili za koje se čini da mogu dovesti do krijumčarenja drogama ili psihotropnim tvarima;
(b) osobama za koje se zna da su uključene ili, ukoliko se informacije o takvim osobama mogu davati po nacionalnom zakonu, osobama za koje se sumnja da su uključene u operacije iz stavka (a) u prednjem tekstu, te o vozilima, brodovima, letjelicama i ostalim prijevoznim sredstvima koja se koriste ili za koje se sumnja da se koriste za takve operacije;
(c) novim sredstvima ili metodama koje se koriste za krijumčarenje droga ili psihotropnih tvari;
(d) proizvodima koji su novo proizvedeni ili se novo koriste kao droge ili psihotropne tvari a predmet su krijumčarenja.
Pomoć, na zahtjev, u vezi nadzora
4. Na zahtjev carinske uprave neke ugovorne stranke, carinska uprava druge ugovorne stranke će, u okviru svojih nadležnosti i mogućnosti, vršiti posebni nadzor kroz određeni period nad:
(a) kretanjima, posebice nad ulaskom na njezino područje i izlaskom sa njezinog područja, određenih osoba za koje se s razlogom vjeruje da su profesionalno ili često uključene u krijumčarenje drogama i psihotropicima na području ugovorne stranke koja traži pomoć;
(b) kretanjima droga ili psihotropnih tvari za koje je carinska uprava ugovorne stranke koja traži pomoć izvijestila da dovode do značajne nezakonite trgovine prema području ili sa područja te ugovorne stranke:
(c) posebnim mjestima gdje se stvaraju zalihe droga i psihotropnih tvari, što s razlogom navodi na pretpostavku da se ista koriste za nezakoniti uvoz na području ugovorne stranke koja traži pomoć;
(d) određenim vozilima, brodovima, letjelicama ili drugim prijevoznim sredstvima za koja se s razlogom vjeruje da se koriste za vršenje carinskih prekršaja na području ugovorne stranke koja traži pomoć,
i o tome će dostaviti izvješće carinskoj upravi ugovorne stranke koja traži pomoć.
Istrage, na zahtjev, u korist druge ugovorne stranke
5. Na zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke će, ovisno o zakonima i propisima na snazi na njezinom području, izvršiti istrage radi pribavljanja dokaza u vezi nekog krijumčarenja droga ili psihotropnih tvari koje se istražuje na području ugovorne stranke koja traži pomoć, i uzet će izjave od svih traženih osoba u vezi s tim krijumčarenjem ili od svjedoka ili stručnjaka, a rezultate istrage, kao i sve dokumente ili drugi dokazni materijal, dostavit će carinskoj upravi ugovorne stranke koja traži pomoć.
Djelovanje carinika jedne ugovorne stranke na području druge ugovorne stranke
6. U slučaju kada nije dovoljno svjedočenje samo u obliku pismene izjave, na zahtjev carinske uprave jedne ugovorne stranke carinska uprava druge ugovorne stranke će, u okviru svojih mogućnosti, dopustiti svojim službenicima da se pojave pred sudom ili sudskim vijećem na području ugovorne stranke koja traži pomoć kao svjedoci ili stručnjaci u predmetu krijumčarenja droga ili psihotropnih tvari. U zahtjevu za pojavljivanje će stajati, posebice, u kojem slučaju i u kojem svojstvu službenika treba saslušati. Carinska uprava ugovorne stranke koja prihvaća zahtjev navest će, prilikom davanja dozvole za pojavljivanje, sva ograničenja kojih se njezini službenici trebaju pridržavati prilikom saslušanja.
7. Na pismeni zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke će, kada to smatra primjerenim te u granicama svojih nadležnosti i mogućnosti, dopustiti službenicima uprave koja traži pomoć da budu prisutni na području ugovorne stranke zamoljene za pomoć u vezi s istragama ili službenim izvještavanjem u predmetu krijumčarenja droga ili psihotropnih tvari koji se tiču ugovorne stranke koja traži pomoć.
8. U slučaju kada obje ugovorne stranke to smatraju primjerenim, te ovisno o zakonima i propisima na snazi na njihovim područjima, službenici carinske uprave jedne ugovorne stranke će, na zahtjev druge ugovorne stranke, sudjelovati u istragama koje se provode na području te druge ugovorne stranke.
Objedinjavanje informacija
9. Carinske uprave ugovornih stranaka dostavit će glavnom tajniku Vijeća niže navedene informacije u onoj mjeri u kojoj su iste od međunarodnog interesa.
10. Glavni tajnik Vijeća ustanovit će i voditi ažurno jedan centralni indeks informacija koje mu dostavljaju ugovorne stranke i koristit će informacije iz istog za izradu sažetaka i studija novih trendova kao i onih trendova koji se ponavljaju u carinskim prijevarama. Povremeno će revidirati taj indeks kako bi uklonio informacije koje, po njegovom mišljenju, više nisu korisne ili su zastarjele.
11. Carinske uprave ugovornih stranaka će, na zahtjev glavnog tajnika Vijeća te ovisno o ostalim odredbama Konvencije i ovog Priloga, dostaviti glavnom tajniku one dodatne informacije koje mogu biti potrebne za izradu sažetaka i studija iz stavka 10 ovog Priloga.
12. Glavni tajnik Vijeća dostavljat će službama ili službenicima koje imenuju carinske uprave ugovornih stranka određene informacije sadržane u centralnom indeksu, u onoj mjeri u kojoj tu dostavu smatra korisnom, te sažetke i studije iz stavka 10 ovog Priloga.
13. Glavni tajnik Vijeća će, ukoliko nema suprotna uputstva ugovorne stranke koja daje informacije, također dostavljati službama ili službenicima imenovanima po drugim članicama Vijeća, nadležnim organima Ujedinjenih naroda i Međunarodnoj organizaciji kriminalističke policije/Interpolu te ostalim međunarodnim organizacijama sa kojima su napravljeni odgovarajući aranžmani, sve informacije koje se odnose na krijumčarenje droga i psihotropnih tvari iz centralnog indeksa, u onoj mjeri u kojoj takvu dostavu informacija smatra korisnom, te sve sažetke ili studije koje je eventualno izradio po tom predmetu prema stavku 10 ovog Priloga.
14. Glavni tajnik Vijeća će, na zahtjev, dostaviti ugovornoj stranci koja je prihvatila ovaj Prilog sve informacije koje su mu dostupne u vezi sa objedinjavanjem informacija prema ovom Prilogu.
Centralni indeks, Dio I: OSOBE
9. Obavijesti po ovom Dijelu centralnog indeksa sadržavat će informacije o:
(a) osobama koje su konačno osuđene za krijumčarenje; i
(b) kada je primjereno, osobama na koje se sumnja da krijumčare ili koje su uhvaćene na djelu krijumčarenja na području ugovorne stranke koja daje obavijest, iako sudski postupak još nije završen,
s time što se podrazumijeva da će u slučaju kada se ugovorne stranke uzdržavaju od davanja imena i opisa dotičnih osoba jer je davanje takvih obavijesti zabranjeno njihovim nacionalnim zakonom, one ipak dati obavijest sa što je više moguće stavaka navedenih u tom dijelu centralnog indeksa.

Ugovorne stranke javit će svaku uporabu poznate metode krijumčarenja i kao novu, neuobičajenu ili moguću metodu tako da se mogu otkriti aktualni trendovi na tom području.
19. Informacije koje se dostavljaju sadržavat će, u najvećoj mogućoj mjeri, slijedeće:

PRILOG XI
POMOĆ U AKCIJI
PROTIV KRIJUMČARENJA UMJETNIČKIH DJELA, ANTIKVITETA I DRUGIH KULTURNIH
DOBARA
1. Odredbe ovog Priloga primjenjuju se na umjetnička djela, antikvitete i ostala »kulturna dobra« koja se, na religioznim ili svjetovnim osnovama, smatra od važnosti za arheologiju, pretpovijest, povijest, literaturu, umjetnost ili znanost, u značenju iz stavaka (a)-(k) članka i Konvencije UNESCO-a o mjerama zabrane i sprječavanja nedozvoljenog uvoza, izvoza i prijenosa vlasništva kulturnih dobara (Pariz, 14. studenoga 1970.), ukoliko su takva umjetnička djela, antikviteti i ostala kulturna imovina predmet krijumčarenja. One ne isključuju primjenu nacionalnih mjera suradnje s nacionalnim službama za zaštitu kulturne baštine i, na području carine, dopunjuju provedbu odredaba Konvencije UNESCO-a po onim ugovornim strankama te Konvencije koje su ujedno prihvatile ovaj Prilog.
2. Odredbe ovog Priloga u vezi krijumčarenja umjetničkih djela, antikviteta i ostalih kulturnih dobara primjenjuju se, kada je primjereno i u onoj mjeri u kojoj je to u nadležnosti carinskih uprava i na financijske operacije poduzete u vezi s tim krijumčarenjem.
Razmjena informacija od strane carinskih uprava na vlastitu inicijativu
3. Carinske uprave ugovorna stranka će, na vlastitu inicijativu i bez odlaganja, javiti drugim carinskim upravama kojih se to može direktno ticati, sve raspoložive informacije o:
(a) operacijama za koje se zna ili sumnja da čine krijumčarenje ili koje se čine da mogu dovesti do krijumčarenja umjetničkim djelima, antikvitetima ili drugim kulturnim dobrima;
(b) osobama za koje se zna da su uključene ili, ukoliko se informacije o takvim osobama smiju davati po nacionalnom zakonu, osobama za koje se sumnja da su uključene u operacije iz stavka (a) u prednjem tekstu, te o vozilima, brodovima, letjelicama i ostalim prijevoznim sredstvima koja se koriste ili za koje se sumnja da se koriste za takve operacije;
(c) novim sredstvima ili metodama koje se koriste za krijumčarenje umjetničkih djela, antikviteta i drugih kulturnih dobara.
Pomoć, na zahtjev, u vezi nadzora
4. Na zahtjev carinske uprave neke ugovorne stranke, carinska uprava druge ugovorne stranke će, u okviru svojih nadležnosti i mogućnosti, vršiti posebni nadzor kroz određeni period nad:
(a) kretanjima, posebice ulaskom na njezino područje i izlaskom sa njezinog područja, određenih osoba za koje se s razlogom vjeruje da su profesionalno ili učestalo uključeni u krijumčarenje umjetničkih djela, antikviteta ili drugih kulturnih dobara na području ugovorne stranke koja traži pomoć;
(b) kretanjima umjetničkih djela, antikviteta ili drugih kulturnih dobara za koje je carinska uprava ugovorne stranke koja traži pomoć izvijestila da dovode do značajne nezakonite trgovine sa područja te ugovorne stranke;
(c) određenim vozilima, brodovima, letjelicama ili drugim prijevoznim sredstvima za koja se s razlogom vjeruje da se koriste za krijumčarenje umjetničkih djela, antikviteta ili drugih kulturnih dobara na području ugovorne stranke koja traži pomoć,
i o tome će dostaviti izvještaj carinskoj upravi ugovorne stranke koja traži pomoć.
Istrage, na zahtjev, u korist druge ugovorne stranke
5. Na zahtjev carinske uprave neke ugovorne stranke, carinska uprava druge ugovorne stranke će, u okviru svojih mogućnosti te ovisno o zakonima i propisima na snazi na njezinom području, izvršiti istrage radi pribavljanja dokaza u vezi nekog krijumčarenja umjetničkih djela, antikviteta ili drugih kulturnih dobara koje se istražuje na području ugovorne stranke koja traži pomoć, i uzet će izjave od svih osoba koje se traže u vezi s tim krijumčarenjem ili od svjedoka ili stručnjaka, a rezultate istrage, kao i sve dokumente ili drugi dokazni materijal, dostavit će carinskoj upravi ugovorne stranke koja traži pomoć.
Djelovanje carinika jedne ugovorne stranke na području druge ugovorne stranke
6. U slučaju kada nije dovoljno da se svjedoči samo putem pismene izjave, na zahtjev carinske uprave jedne ugovorne stranke carinska uprava druge ugovorne stranke će, u okviru svojih mogućnosti, dopustiti svojim službenicima da se pojave pred sudom ili sudskim vijećem na području ugovorne stranke koja traži pomoć kao svjedoci ili stručnjaci u predmetu krijumčarenja umjetničkih djela, antikviteta ili drugih kulturnih dobara. U zahtjevu za pojavljivanje će stajati, posebice, u kojem predmetu i u kojem svojstvu službenika treba saslušati. Carinska uprava ugovorne stranke koja prihvaća zahtjev će, prilikom davanja dozvole za pojavljivanje, navesti sva ograničenja kojih se njezini službenici trebaju pridržavati prilikom saslušanja.
7. Na pismeni zahtjev carinske uprave jedne ugovorne stranke, carinska uprava druge ugovorne stranke će, kada to smatra primjerenim te u granicama svoje nadležnosti i svojih mogućnosti, dopustiti službenicima uprave koja traži pomoć da budu prisutni na području ugovorne stranke zamoljene za pomoć u vezi sa istragama ili službenim izvještavanjem u predmetu krijumčarenja umjetničkih djela, antikviteta ili drugih kutlurnih dobara koji se tiču ugovorne stranke koja traži pomoć.
8. U slučaju kada obje ugovorne stranke to smatraju primjerenim te ovisno o zakonima i propisima na snazi na njihovim područjima, službenici carinske uprave jedne ugovorne stranke će, na zahtjev druge ugovorne stranke, sudjelovati u istragama koje se provode na području te druge ugovorne stranke.
Objedinjavanje informacija
9. Carinske uprave ugovornih stranaka dostavljat će glavnom tajniku Vijeća niže navedene informacije u onoj mjeri u kojoj su iste od međunarodnog interesa.
10. Glavni tajnik Vijeća će ustanoviti i voditi ažurno jedan centralni indeks informacija koje mu dostavljaju ugovorne stranke i koristit će informacije iz istog za izradu sažetaka i studija o novim trendovima kao i trendovima koji se ponavljaju u krijumčarenju umjetničkih djela, antikviteta i drugih kulturnih dobara. On će povremeno revidirati taj indeks kako bi uklonio informacije koje, po njegovom mišljenju, više nisu korisne ili su zastarjele.
11. Carinske uprave ugovornih stranaka će, na zahtjev glavnog tajnika Vijeća te ovisno o ostalim odredbama Konvencije i ovog Priloga, dostaviti glavnom tajniku one dodatne informacije koje mogu biti potrebne za izradu sažetaka i studija iz stavka 10 ovog Priloga.
12. Glavni tajnik Vijeća dostavljat će službama ili službenicima koje imenuju carinske uprave ugovornih stranaka određene informacije sadržane u centralnom indeksu, u onom obimu u kojem tu dostavu smatra korisnom, te sažetke i studije iz stavka 10 ovog Priloga.
13. Glavni tajnik Vijeća će, ukoliko nije dobio suprotna uputstva od ugovorne stranke koja daje informacije, također dostaviti UNESCO-u i Međunarodnoj organizaciji kriminalističke policije/Interpolu sve informacije koje se odnose na krijumčarenje umjetničkih djela, antikviteta ili druge kulturne imovine iz centralnog indeksa, ukoliko je bilo nezakonitog prijenosa vlasništva i on takvu dostavu smatra korisnom, zajedno sa svim sažecima ili studijama koje je eventualno izradio po tom predmetu prema stavku 10 ovog Priloga.
14. Glavni tajnik Vijeća će, na zahtjev, dostavljati ugovornoj stranci koja je prihvatila ovaj Prilog sve ostale informacije koje su mu na raspolaganju u vezi sa objedinjavanjem informacija prema ovom Prilogu.
Centralni indeks, Dio I: OSOBE
15. Obavijesti po ovom Dijelu centralnog indeksa sadržavat će informacije o:
(a) osobama koje su konačno osuđene za krijumčarenje; i
(b) kada je primjereno, osobama na koje se sumnja da krijumčare ili koje su uhvaćene na djelu krijumčarenja na području ugovorne stranke koja daje obavijest, iako sudski postupak još nije završen,
s time što se podrazumijeva da će, u slučaju kada se ugovorne stranke uzdržavaju od davanja imena i opisa dotičnih osoba jer je davanje takvih obavijesti zabranjeno njihovim nacionalnim zakonom, one ipak dati obavijest sa što je više moguće stavaka navedenih u tom dijelu centralnog ineksa.
16. Informacije koje treba dati sadržavat će, u najvećoj mogućoj mjeri, slijedeće podatke:
(a) Prezime
(b) Imena
(c) Djevojačko prezime (ukoliko je takav slučaj)
(d) Nadimke ili slično1
(e) Zanimanje
(f) Adresu (sadašnju)
(g) Datum i mjesto rođenja
(h) Državljanstvo/Nacionalnost
(ij) Mjesto boravka i zemlje posjećene u posljednjih 12 mjeseci
(k) Vrstu i broj osobnih dokumenata, uključujući zemlju i datum izdavanja
(l) Fizički opis
(1) Spol
(2) Visina
(3) Težina
(4) Građa tijela
(5) Kosa
(6) Oči
(7) Boja lica
(8) Prepoznatljive ili posebne oznake
(m) Ukratko podatke o prekršaju (uključujući podatke o vrsti, količini i porijeklu robe sa kojom je izvršen prekršaj, te da li je bilo nezakonitog prijenosa vlasništva) i okolnostima koje su dovele do otkrivanja prekršaja
(n) Vrstu i visinu kazne i/ili presude.
(o) Ostale napomene, uključujući jezike koje govori i ranije evidentirane osude (ako postoje)
(p) Ugovornu stranku koja daje informacije (uključujući referentni broj).
17. Kao opće pravilo, glavni tajnik Vijeća dostavit će informacije u vezi dijela I centralnog indeksa u najmanju ruku zemlji državljanstva i boravka dotične osobe te zemljama koje je dotična osoba posjetila tijekom posljednjih 12 mjeseci.
Centralni indeks, Dio II. METODE 11
18. Obavijesti po ovom dijelu centralnog indeksa sadržavat će informacije u vezi načina krijumčarenja umjetničkih djela, antikviteta ili drugih kulturnih dobara, uključujući načine sakrivanja, u svim slučajevima od većeg međunarodnog interesa, ugovorne stranke javit će svaku uporabu poznate metode krijumčarenja i kao novu, neoubičajenu ili moguću metodu tako da se mogu otkriti aktualni trendovi na tom području.
19. Informacije koje se dostavljaju sadržavat će, u najvećoj mogućoj mjeri, slijedeće:
(a) Opis metoda krijumčarenja. Opis, ukoliko se njime raspolaže, korištenog prijevoznog sredstva (proizvod, model, registracijski broj itd.). Kada je primjereno, podatke sa ploče ili potvrde o odobrenju za kontejnere ili vozila, čiji su modeli odobreni po nekoj međunarodnoj konvenciji, i informacije o bilo kakvom prekršaju u pogledu pečata, zasuna, naprava za pečaćenje ili drugih dijelova kontejnera ili vozila
(b) Opis, kada je takav slučaj, mjesta sakrivanja, uključujući po mogućnosti fotografiju ili skicu
(c) Opis dotične robe
(d) Ostale napomene, uključujući okolnosti koje su dovele do otkrivanja
(e) Ugovornu stranku koja dostavlja informacije (uključujući referentni broj).
